INFRASTRUCTURE, HIGHWAY INVESTMENT PROMINENT IN GOVERNOR’S ECONOMIC RECOVERY PLAN

On Wednesday, February 8, Governor Justice delivered his first State of the State Address. Faced with a $500 million budget gap, the governor outlined a plan that called for $27 million in spending cuts and approximately $450 million in tax and fee increases. Highway funding was at the forefront of his speech.

Calling bad roads the “800 pound gorilla in the room,” the governor outlined a $2.4 billion to $4 billion road program that will put 45,000 West Virginians to work by completing the state’s transportation system within three to five years. This would be done by a series of new revenue and bonding, including raising the retail gas tax 10 cents a gallon and increasing DMV fees from $30 to $50 annually. The governor’s proposal would also restore the wholesale gas tax to recoup the 3.5 cents per gallon lost over the last three years due to the declining price of gasoline. “If you do this, you’ll see those jobs,” Governor Justice stated. The governor’s budget also includes $100 million for infrastructure and economic development projects.

Of the $450 million in tax increases, approximately $300 million will be on businesses. Governor Justice's budget calls for the elimination of the sales tax exemption for professional services, which would affect legal, accounting, engineering, architectural and advertising services among others. Governor Justice's plan also calls for a .2% tax on the gross revenues of businesses in . This tax is very similar to the B&O tax that was phased out on all businesses except electric utilities in the 1980s.

CAWV LEGISLATIVE BULLETINS TO BEGIN MONDAY

Starting Monday, February 13, members will receive, via e-mail, the CAWV Legislative Bulletin. It will contain up-to-the-minute information on issues affecting the contracting industry and association members. The Legislative Bulletin will not be included with the weekly Newsletter. In addition to the Monday morning Legislative Bulletins, the CAWV will be sending out Legislative Alerts throughout the coming weeks to members via email. The 2017 legislative session began Wednesday, February 8, and will run until April 8, 2017.

Members will also find requests to send letters through the CAWV’s Legislative Action Center, powered by BIPAC. When necessary, the CAWV will provide members with a letter template, and with just a few clicks, a personalized letter or email can be sent. BIPAC also provides a “Find Your Legislator” feature, election information and a refresher on government. Members will be encouraged to contact their senators and delegates on key legislative issues, and instructions on how to do so through BIPAC will be included in Legislative Alerts.

Members can access the 2017 Legislative Information Packet, a comprehensive reference tool that includes room numbers for all legislators; seating charts for the Senate and House Chambers; Senate, House and Congressional district maps; photographs and contact information for all members of the Legislature; and, phone numbers and addresses for Congressional representatives. Also included are toll-free telephone numbers and web site addresses for state agencies, colleges and universities. MEMBERS EXPRESS OPTIMISM AT MIDYEAR MEETING

Thank you to all of those who attended last week's CAWV Midyear Meeting at the Hyatt Regency Aruba and a special thanks to sponsors for helping to make this year’s meeting a success. For those who missed it, the speaker's presentations and list of sponsors is on the website at www.cawv.org/events/midyear-meeting.html. Additionally, for those who attended the event, a brief meeting survey will be sent to help the CAWV Program Committee continue to strive toward providing quality CAWV programming for the future.

“This year’s meeting covered a lot of ground in addressing issues affecting our members and our industry,” said CAWV President C.R. Neighborgall. “The division meetings were well attended and there was much discussion on where West Virginia’s construction industry is headed in 2017. Everyone knows it will be a challenging year but I saw more optimism about the future than I’ve seen in quite some time.” The President said that he was encouraged that members were ready to come to Charleston and the West Virginia Legislature to meet with their legislators on highway and infrastructure funding.

There was an impressive list of speakers. They included: Greg Burton, BrickStreet Mutual CEO, who spoke on BrickStreet’s expansion with Motorist Mutual; Allan Williams and Lisa Teel who outlined BrickStreet’s discount to CAWV members on the insurance agency’s workers’ compensation program and how contractors’ perception of safety affects a company’s safety record; and Jeff Shoaf, Senior Director Government Affairs, AGC of America, who spoke on how the Trump presidency is or is not changing construction’s legislative agenda.

Marty Becker, CEO of QBE Insurance Group headquartered in Australia, outlined five issues that that would change West Virginia for the better, including selling bonds for infrastructure projects. Louie Southworth, Jackson Kelly, recapped the 2016 election and provided an outlook for the 2017 legislative session. Ray Benefield with Impac Universal Fuel Service outlined a fleet fueling program and the many discount programs available for CAWV members through National Purchasing Partners (NPP).

Josh Booth, chair of the Young Contractors Forum, encouraged CAWV members to have their young professionals participate in YCF functions, including a February volunteer project to help build a playground for the Ronald McDonald House in Huntington. CAWV Membership Chairman Doug Meeks outlined a new campaign to introduce new members to the association (see related article below).

“All of our speakers gave us hands-on information that were good take-aways,” said President Neighborgall. “We will use this information in our own companies as we chart our course of action this year and beyond.”

MEMBERSHIP RECRUITMENT REWARD PROGRAM LAUNCHED AT MIDYEAR MEETING

Doug Meeks, CAWV Membership Committee Chairman, announced the launch of a membership recruitment program at the CAWV Midyear Meeting. The program will reward members that recruit new members into the association. CAWV Members that recruit new members will receive a $100 certificate for a new contractor member and a $50 certificate for a new associate member. The certificates can be used for meeting registrations as well as other CAWV events and there is no limit on how many certificates can be used at once. Along with the redesigned membership section of the website, which makes it easier to share information about the CAWV to prospective members, the Membership Committee believes this program will help grow the association. Members will receive a separate email in the near future with more details of the program and information on how to claim your certificates for newly recruited members. CALL TO ACTION: REMINDER- MAKE PLANS TO ATTEND TRANSPORTATION DAY – FRIDAY, FEBRUARY 17

West Virginians for Better Transportation (WVBT) will be hosting “Transportation Day at the State Capitol” on Friday, February 17. Plan to join with others interested in the future of West Virginia’s transportation system and show support for a long-term solution for the state’s roads, bridges and highways. Members are urged to gather at the state Capitol and meet with legislators to help educate lawmakers about the challenges facing transportation across the state.

CAWV members are asked to arrive by 9:00 a.m. New security procedures are in place and visitors will have to go through a metal detector. Only two entrances are open to the public. One is the East Wing Entrance on California Avenue at the door closest to Washington Street. The second is the West Wing Entrance at the door directly across from the Culture Center. The program will begin at 10 a.m.

Also, WVBT will release a new The Road Information Program (TRIP) report on Thursday, February 16, in Governor’s Conference Room in the Secretary of State’s office. Members should be there by 10:15 a.m. See this week’s Highway Bulletin for complete details.

STREAM PROTECTION RULE PASSES SENATE

The U.S. Senate voted 54-45 to block the U.S. Department of Interior’s Stream Protection Rule. The bill was sponsored by all three of West Virginia’s Representatives, David B. McKinley, Alex Mooney, and Evan Jenkins, and passed the House on a 228-194 vote yesterday. The legislation now heads to President Trump for his signature. The National Mining Association has estimated that, if implemented, the Stream Protection Rule would have eliminated nearly one third of all coal jobs in the country and would have blocked potential mining of half of all coal reserves.

JUSTICE APPOINTS CHARLES CLEMENTS TO FILL SENATE VACANCY

Governor Jim Justice announced that he has appointed Charles Clements to the fill the 2nd district state senate seat vacated by Agriculture Commissioner Kent Leonhardt. The district covers all of Wetzel County, Tyler County, Doddridge County, Ritchie County and Calhoun County, and parts of Marshall County, Monongalia County, Marion County and Gilmer County. Clements is a former member of the West Virginia House of Delegates and currently serves as the executive director of the West Virginia Route 2 and I-68 Authority. He served as member of the Governor's transition policy committee on transportation. Clements served in the U.S. Army and was owner of Clements Oil Company for 34 years. Since 2004 he has operated H&R Block in New Martinsville.

VOLUNTEERS NEEDED FOR CYNTHIA SNYDER MEMORIAL BLOOD DRIVE AT EXPO

The CAWV is once again sponsoring a blood drive in memory of Cynthia Snyder on March 22 and 23 at the Charleston Civic Center in conjunction with EXPO. Volunteers are needed to work on-site registration and to help provide snacks to donors. Cynthia, who passed in 2011, was the wife of CAWV Past President Lee Snyder. The Cynthia Snyder Memorial Blood Drive will be held from 10:00 a.m. to 4:00 p.m. on March 22 and 9:00 a.m. to 3:00 p.m. on March 23. Over 57 pints of blood were donated at last year’s EXPO making a total of 262 pints donated since the drive’s inception. CONSTRUCTION’S “FATAL FOUR”

OSHA and our construction industry partners have initiated a “Focus Four Hazards” campaign throughout OSHA’s Region III’s jurisdiction. Out of 4,836* worker fatalities in private industry in calendar year 2015, 937 or 19% were in construction―that is, one in five worker deaths last year were in construction. The leading causes of worker deaths on construction sites were falls, followed by struck-by, electrocution, and caught-in/between. These "Fatal Four" hazards were responsible for well over half (64.2%) of the construction worker deaths in 2015*, according to BLS reports. Eliminating the Fatal Four would save 602 workers' lives in America every year.

. Falls — 364 out of 937 total deaths in construction in CY 2015 (38.8%) . Electrocutions - 81 (8.6%) . Struck by Object - 90 (9.6%) . Caught-in/between* - 67 (7.2%)(*This category includes construction workers killed when caught-in or compressed by equipment or objects, and struck, caught, or crushed in collapsing structure, equipment, or material)

February Focus -Electrical Safety

Electric shock from equipment installations or tool use rose from 5.7% of the total construction fatal injuries in 2015 to 12.7 in the first quarter of 2016.

How to assist a worker being shocked: • Ensure your own safety, by making the scene is safe • If possible, and if it is safe to do so, shut off the source of electricity. • Call 911 with explicit address & inform them the source of the current such as a downed pole, etc. Do not hang up on the 911 operator until told to do so. • If you cannot shut off the source of electricity, attempt to remove the worker from the electric line by using a non-conducting source such as a PVC pole or a dry piece of lumber without placing yourself at risk of electrocution. • High voltage lines will radiate current through the ground. Do not risk your own life. • Ensure the current is off and the area is safe, if possible, start CPR, use an AED, and keep the victim warm until EMS arrives. • Conduct a Lessons Learned and share.

In 2015, 8.6% of construction fatalities were electrocutions

TRUMP ADMINISTRATION CONTINUES TO ADVOCATE FOR NATIONAL INFRASTRUCTURE MEASURE

During the Congressional Republican meeting/retreat last month, President Trump met with Republican leaders to urge them to get moving on a national infrastructure bill to address the Nation’s urgent need to upgrade its infrastructure systems and to prime the national economy. President Trump expressed his frustration that an infrastructure bill was not included in Congress’s 100-day schedule.

House Speaker Paul Ryan indicated last week that Congress will take up infrastructure and tax reform bills in late spring after the House has completed its work on a new health care measure and spring budget. He further commented that he plans to create “fiscal space” for an infrastructure plan in upcoming budget negotiations. Senate Majority Leader Mitch McConnell has responded that any new infrastructure program must have a credible plan to pay for the program and that the Senate Republicans are not interested in increasing the national debt. Leader McConnell stated that he and his colleagues are waiting on a proposal from the Trump Administration and Secretary of Transportation for their consideration.

Senate Democrats, lead by Senate Minority Leader Chuck Schumer, have put forth their own $1 trillion infrastructure proposal (A Blueprint to Rebuild America’s Infrastructure). The Senate Democrats have stated that their plan mostly relies on direct federal funding and would partly be funded by closing tax loopholes. The $1 trillion plan details include the following:

 $110B for water and sewer systems $10B for ports and waterways  $100B for roads and bridges $130B for transit and bus systems  $30B for airports $50B for rail (including Amtrak and HSR)  $10B for TIGER Grants $75B for schools  $100B for energy infrastructure $100B "Main Streets" in local communities  $20B for expanded broadband $10B for VA hospitals and other VA facilities  $20B for infrastructure on tribal and public lands  $200B for a "Vital Infrastructure Program” for priority projects  $10B new innovative financing tools, such as TIFIA, RIFF, WIFIA and an infrastructure bank

NEW TRIP REPORT EVALUATES CONDITION AND FUNDING NEEDS OF WEST VIRGINIA’S ROADS AND BRIDGES; PLAN TO ATTEND THURSDAY’S PRESS CONFERENCE

A new report that evaluates the current condition, use and funding of West Virginia’s highway transportation system will be released at a news conference in Charleston at 10:30 a.m. on Thursday, February 16, in the Governor’s Conference Room in the Secretary of State’s office at the State Capitol. CAWV members are encouraged to attend.

The report, “West Virginia Transportation by the Numbers: Meeting the State’s Need for Safe and Efficient Mobility,” analyzes road and bridge conditions, traffic safety, traffic congestion, economic development, and transportation funding in West Virginia. TRIP’s report loos at the top transportation umbers as the state addresses modernizing and maintaining its system of roads, highways, bridges and transit. TRIP is a national nonprofit transportation research group based in Washington, DC.

Will Wilkins, TRIP’s executive director, will present the findings of the report at the news conference. The Chairwoman of West Virginians for Better Transportation (WVBT) will also be on hand to comment on the report. CAWV members should be at the Governor’s Conference Room at 10:15 a.m. Parking will be available at Laidley Field with shuttles available to the Capitol security entrance.

MAKE PLANS NOW TO ATTEND TRANSPORTATION DAY – FEBRUARY 17, 2017

West Virginians for Better Transportation (WVBT) will be hosting “Transportation Day at the State Capitol” on Friday, February 17. Plan to join with others interested in the future of West Virginia’s transportation system and show support for a long-term solution for the state’s roads, bridges and highways. Members are urged to gather at the state Capitol and meet with legislators to help educate lawmakers about the challenges facing transportation across the state.

“We are expecting another great day…with a large number of organizations and companies participating in the 2017 event,” said Carol Fulks, WVBT’s Chairwoman. This is the sixth year that WVBT has organized this gathering. “We’ve invited Gov. Jim Justice, Senate President Mitch Carmichael, House Speaker Tim Armstead, and new Senate Transportation Committee Chairman Greg Boso, R-Nicholas to speak to our group. I know that I am looking forward to hearing their plans for funding roads and bridges,” the chairwoman said. “We also will be unveiling the 2017 funding campaign that will kick off January 25. The campaign will talk about the needs to maintain our roads and bridges.”

CAWV members are asked to arrive by 9:00 a.m. Security procedures are in place and visitors will have to go through a metal detector. Only two entrances are open to the public. One is the East Wing Entrance on California Avenue at the door closest to Washington Street. The second is the West Wing Entrance at the door directly across from the Culture Center. The program will begin at 10 a.m.

After the presentations, members are asked to visit their legislators to talk about the impact the lack of highway funding is having on their companies and their employees. Companies and organizations wishing to exhibit will have prime space. There is no cost to exhibit, but pre- registration is required (these are available on a first-come, first reserve basis). 2017 TRANSPORTATION DAY AT THE WEST VIRGINIA CAPITOL Friday, February 17, 2017

MAKE PLANS NOW TO ATTEND TRANSPORTATION DAY – FEBRUARY 17, 2017; FUNDING CAMPAIGN TO BE UNVEILED

West Virginians for Better Transportation (WVBT) will be hosting “Transportation Day at the State Capitol” on Friday, February 17. Plan to join with others interested in the future of West Virginia’s transportation system and show support for a long-term solution for the state’s roads, bridges and highways. Members are urged to gather at the state Capitol and meet with legislators to help educate lawmakers about the challenges facing transportation across the state.

“We are expecting another great day…with a large number of organizations and companies participating in the 2017 event,” said Carol Fulks, WVBT’s Chairwoman. This is the sixth year that WVBT has organized this gathering. “We’ve invited Gov. Jim Justice, Senate President Mitch Carmichael, House Speaker Tim Armstead, and new Senate Transportation Committee Chairman Greg Boso, R-Nicholas to speak to our group. I know that I am looking forward to hearing their plans for funding roads and bridges,” the chairwoman said. “We also will be unveiling the 2017 funding campaign that will kick off January 25. The campaign will talk about the needs to maintain our roads and bridges.”

SECURITY AT STATE CAPITOL

Attendees are asked to arrive by 9:00 a.m. Security procedures are in place and visitors will have to go through a metal detector. Only two entrances are open to the public. One is the East Wing Entrance on California Avenue at the door closest to Washington Street. The second is the West Wing Entrance at the door directly across from the Culture Center. The program will begin at 10 a.m.

Companies and organizations wishing to exhibit will have prime space outside the House chamber. There is no cost to exhibit, but pre-registration is required (these are available on a first-come, first reserve basis).
