PROCEEDINGS OF 180TH MEETING OF THE ERC-NCTE HELD ON 5TH – 6TH FEBRUARY, 2015

The 180th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 5th-6th February, 2015 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 180th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision. Sl. ATTENTION!

1. The committee unanimously decided that the institution may reply in response to the decision of the committee uploaded on the ERC website without waiting formal letters from the office of ERC. The replies so received will also be considered by the committee.

2. The institution whose applications are pending and reached to the stage of 7(9) [7(13) as per New Regulation] including the institution already submitted the reply of 7(13) prior to publication/implementation of NCTE Regulations 2014 are advised to submit/re-submit their reply as per New Regulations alongwith other required documents at the earliest to enable to ERC to take appropriate decision.

3. The cut-off date for grant of recognition is 3rd March 2015 for the session 2015-16. Institution are personally responsible if they lose the session due to non-submission or late submission of replies.

4. The institutions which have not submitted the balance amount of Rs.4.00 Lacs towards Reserve Fund expected to submit the same.

5. The institution need to submit list of 10 schools for internship and school based activities duly approved by District Education Officer.

6. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier.

District Institute of Education and Training (DIET), Sambalpur, Plot No.- 357/2169, 4. 180.5.4 Street No.- Near N.H.6, PO – Budharaja, Tehsil/Taluka – Sambalpur, Town/City – Sambalpur, Dist – Sambalpur, Odisha – 768004 9 (Code No. ERCAPP1870) The institution namely District Institute of Education and Training (DIET), Sambalpur, Plot No.- 357/2169, Street No.- Near N.H.6, PO – Budharaja, Tehsil/Taluka – Sambalpur, Town/City – Sambalpur, Dist – Sambalpur, Odisha – 768004 9 (Code No. ERCAPP1870) was granted permission for conducting D.El.Ed. Course with an additional annual intake of 50 students thus making the total annual intake of 100 (one hundred) vide order No.24197 dated 24.02.2014 from the academic session 2014-2015 subject to fulfilling the following conditions. The NCTE Hqrs. vide letter No.48-9/2013/NCTE/N&S/A78554 dated 03.12.2013 has already given procedural relaxation to the all existing institution in the State of Odisha and directed to submit the faculty list along with budgetary provision before issuance of formal recognition order as detailed below :- (i) All staff as per the norms and standards of NCTE is in place by February 2014. (ii) There is an adequate budgetary allocation in the budget of the State Government for the year 2014-15, for provision of requisite infrastructure as per the norms and standards of NCTE.

Further, the ERC in its 163rd Meeting the VT letter to the institution as well as VT experts was issued on 12.12.2013, 24.01.2014, 22.07.2014 and 28.11.2014. The inspection of the institution conducted on 20.12.2014. As per VT report the institution is deficient as follows:

1. Laboratories like Psychology, educational technology and language learning etc. are not available. 2. The size of science & Mathematics resource centre, psychology resource centre, Art & Craft resource centre, health & physical education resource centre, visitors room, girl’s common room, seminar room etc. are left blank. 3. Safe guard against fire hazard is not provided in the institution building. 4. Separate cabins in staff room for faculty is not available. 5. The size of multipurpose hall is 1127 Sq. ft. which is less than the required 2000 Sq. ft. as per norms. 6. Playground for sports facility is not available in the institution. 7. Submitted building completion certificate is not issued from any Govt. authority. 8. The institution has not submitted the blue print building plan duly approved by any Govt. Engineer mentioning the plot No., khata No., total area & showing the extended built up area for granted additional intake of D.El.Ed. Course in the existing building.

The committee noted that the last date of relaxation was 31.12.2014 to compliance the teaching faculty and completion of building as per NCTE norms. The institution/state government has not compliance the above deficiencies till date and relaxation period has already been over.

In view of the above, the committee decided as under: Show Cause notice be issued to the institution as to why the recognition to the institution be not refused on the above points. The Committee therefore, provides an opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of the letter before the Committee takes final decision.

A copy of this letter may be endorsed to the Secretary, School and Mass Education as well as Director SCERT for information with a request to submit a consolidated compliance report of all the institutions granted recognition/permission as per the relaxation given by NCTE on or before 31st December 2014.

The institution viz. George College Department of Education, Plot No. L3-59/G/1/New, Tehsil/Taluka- Maheshtala, Town/City- Kolkata, Po. Maheshtala, Dist.- Kolkata, West Bengal – 700141 (B.Ed.) (Private) (University of Calcutta) (Code No.ERCAPP909) submitted an application through online on 16.09.2011 for grant of recognition for B.Ed. course and hard copy of the application received in ERC, NCTE on 26.09.2011.

As per the decision of the 140th meeting the institution has been inspected on 13.10.2012.

The Eastern Regional Committee in its 144th meeting considered the VT report and observed the following deficiencies. (i) Size of multipurpose hall is 1979.95 sq.ft. which is less than the required 2000 sq.ft. as per NCTE Regulations 2009. (ii) The institution is having only 58 Decimal land which is less than the required 2500 sq.mts. as per NCTE Regulations 2009. Accordingly, 1st Show cause notice was issued on 21.11.2012.

Accordingly Show Cause Notices were issued on 21.11.2012, 13.12.2012 & 03.06.2013 and 21-Nov-2012

The Eastern Regional Committee in its 158th meeting held on 23-24 July 2013 decided to refuse the application of the institution due to the major deficiencies as pointed above and refusal order was issued to the institution vide order No.ERC/7-158.7.5/ERCAPP909/ 2013/20034 dated 07.08.2013.

The institution preferred an appeal before the NCTE Hqrs. On 04.09.2013. The NCTE Hqrs. Vide its order No. F.No.89-586/2013 Appeal/17th Meeting-2013 dated 10.01.2014 concluded that the ERC was justified in refusing recognition and therefore, the appeal deserved to be rejected and the order of the ERC is confirmed.

Aggrieved by the decision of the Appeal Committee the institution filed Writ vide W.P.(c) 3371/2014 & CM APPL.6925/2014 before the Hon’ble High Court of Delhi.

The Hon’ble Court of Delhi has directed inter alia

“Consequently, in view of the order dated 10th September, 2013 passed by the Supreme Court in SLP No.4247-4248/2009 directing that all pending applications shall be decided in accordance with new regulations, which the respondent-NCTE is yet to notify, present writ petition is disposed of with a direction that the application of the petition shall be considered by respondent-NCTE for academic year 2015-2016 in accordance with new guidelines which shall be notified in compliance of the directions of the Supreme Court.

If any deficiency is found the same shall be conveyed to the petitioner, who shall be given an opportunity to remove the said deficiency, in a time bound matter. In the case deficiencies are removed within the given time, the application shall be processed in accordance with the relevant rules. If the deficiencies are not removed, the application shall stand rejected.”

By a public notice dated 02.01.2014 the institutions whose applications are pending were requested to submit their willingness along with an affidavit to process the application as per New Regulation 2014. In response to the public notice the institution has submitted the reply along with some documents received in ERC office on 19.01.2015.

Without waiting for the consideration / decision of the Eastern Regional Committee after submission of the reply the institution has filed a contempt petition vide Contempt Case (C) 52/2015 George College Department of Education-Vs- Juglal Singh & Ors. in the Hon’ble High Court of Delhi at New Delhi.

The Hon’ble High Court vide its order dated 21.01.2015 has directed inter alia:

“Mr. T. Singhdev, learned counsel accepts notice on behalf of both the respondents and submits that in terms of the order dated 10.09.2014 passed in SLP No 4247- 4248/2009 by the Supreme Court; New Regulations have been notified on 01.12.2014. Thereafter, the respondents issued a Public Notice dated 02.01.2015 by asking all concerned Colleges to furnish the documents as mentioned therein. Pursuant thereto, the respondents have received documents from the petitioner college on 19.01.2015. Learned counsel further submits that case of the petitioner will be considered expeditiously and decision will be communicated to the petitioner accordingly.

I note, as per the direction of the Supreme Court, case of the petitioner has to be considered for the Academic Year 2015-16 and 10.02.2015 is the last date for issuance of letter of Intent to the institutions with respect to grant or refusal of recognition in terms of the New Regulations, 2014. In view of the above, the respondents are directed to take a decision regarding issuance of Letter of Intent to the petitioner College with respect

The institution viz. Sum College of Education, Plot No. 627, 1463, Vill.-Panchpota, P.O.-Babla Gobindapur, Tehsil/Taluka-Ranghat, Town/City-Santipur, Dist.-Nadia, West Bengal-741404 (Code No. ERCAPP117/2012) submitted an application through online on 31.12.2012 for grant of recognition for D.El.Ed. course and hard copy of the application received in ERC, NCTE on 05.01.2013.

The ERC in its 151st meeting held on 26th – 27th February, 2013 considered the matter of the said institution and as decided by ERC, summarily rejection order u/c 7(1-A)(ii) was issued vide No. 16786 dated 02.03.2013 on the following grounds:

(1) Online application made by the society/trust/institution on 31.12.2012. (2) Processing fee through cash challan submitted on 04.01.2013 i.e. after the date of online submission of the application.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 02.03.2013. The Appellate Authority vide Order No. 89-235/2013-Appeal/12th Meeting-2013/A76474 dated 25.10.2013 concluded that the ERC was justified in refusing recognition and therefore the appeal deserved to be rejected and the order of ERC confirmed.

The institution preferred writ petition W.P. No 8712/2014 in the High Court of Delhi at New Delhi and the Hon’ble High Court has disposed of the writ petition on 09.12.2014 with a direction inter alia:

“Consequently, in view of the order dated 10th September, 2013 passed by the Supreme Court in SLP No 4247-4248/2009 directing that all pending applications shall be decided in accordance with new regulations, the present writ petition is disposed of with a direction that the petitioner shall apply afresh in accordance with new regulations, if required and the same shall be considered by respondents-NCTE/ERC for academic year 2015-2016 in accordance with new regulations which shall be notified in compliance with the directions of the Supreme Court.

If any deficiency is found, the same shall be conveyed to the petitioner, who shall be given an opportunity to remove the said deficiency, in a time bound manner. In case the deficiencies are removed within the given time, the application shall be processed in accordance with the relevant rules and regulations. If the deficiencies are not removed, the application shall stand rejected”.

The institution has filed Contempt Petition vide No.CONT. CAS ( C ) 78/2015 Sum College of Education PTTI -Vs- Juglal Singh & Ors In the Hon’ble High Court of Delhi at New Delhi. The Hon’ble High Court vide its order dated 03.02.2015 has directed inter alia:

“ I note as per the direction of this court, case of the petitioner has to be considered for the academic year 2015-16 and 10.02.2015 is the last date for issuance of letter of intent to the institution with respect to grant or refusal of recognition in terms of the new Regulation, 2014.

In view of the above, respondents are directed to take a decision regarding the issuance of letter of intent to the Petitioner College with respect to grant or refusal of recognition in terms of New Regulation-2014 and comply with the order dated 04.12.2014 passed by this court before the next date of hearing, failing which the respondents shall personally present in the court on next date of hearing. Re-notify on 10.02.2015

In compliance to the Order of Hon’ble High Court of Delhi dated 03.02.2015 the Eastern Regional Committee in its 180th Meeting held on 05th -06th February 2015 decided as under:

(i) The application has been summarily rejected as per the NCTE Regulation 2009 subsequently amended and notified in the Gazette of India on 26.11.2010. Ainel Primary Teachers Training Institute, Plot No. 8954-55/61, Street No. Gourhati, Vill/Po- Gourhati, Tehsil/Taluka- Arambagh, Town/City- Gourhati, Dist- Hooghly, West Bengal- 712613 (D.El.Ed.) (Private) (West Bengal Board of Primary Education) (Code No. ERCAPP1245) submitted an application through online on 30.09.2011 for grant of recognition for D.El.Ed. Course and hard copy of the application received in ERC, NCTE on 05.10.2011.

(i) VT conducted on 04.10.2012.

The ERC in its 144th meeting held on 29-31 October 2012 considered the VT Report and decided to issued show cause notice to the institution vide No. 14827 dated 21.11.2012 mentioning the reasons.

The ERC in its 146th meeting held on 29-30 November 2012 considered the matter of the said institution and as decided by ERC, refusal order u/s 14(3)(b) was issued vide No. 15285 dated 14.12.2012 on the following grounds:-

1. As per VT report, the inspection could not be conducted in view of the non-availability of the management and did not co-operate to the VT experts. 2. The building was not constructed. 3. The Visiting Team recommended that the application of the institution be refused due to non- cooperation of the management to the VT as well as non-availability of required infrastructural and instructional facilities for running D.El.Ed. course.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 14.12.2012. The Appellate Authority vide Order No. 89-53/2013-Appeal/6th Meeting-2013/A66455 dated 30.04.2013 concluded that there was no ground to accept the appeal. Accordingly, the appeal is rejected and the order of the ERC confirmed.

Decision of the Court Order:

That the petitioner institution preferred writ petition before the Hon’ble High court at Calcutta in W.P. No 1386 (w) of 2014 challenging the order dated 14.12.2012 and 30.04.2013 passed by the ERC-NCTE and the Appellate Authority i.e NCTE Hqrs. respectively.

That the Hon’ble High Court at Calcutta has disposed of the case on 11.02.2014 with a direction inter alia:

That an Appeal against the order dated 11.02.2014 has been filed in the Division Bench of the Hon’ble High Court at Calcutta on 20.06.2014.

The Hon’ble Division Bench of Calcutta High Court has disposed of the appeal on 08.07.2014 with a direction inter alia:

“ Thus we make it clear that the petitioner’s application for grant of recognition should be treated as pending and the said application will be considered by the concerned authority after the new regulations are framed in terms of the order passed by the Hon’ble Supreme Court and the fate of the said application will be decided by the concerned authority afresh in the light of the new regulation to be framed by the concerned authority within a reasonable time after such new regulations are framed.

We are informed by Ms Gutgutia, learned Advocate for the appellant that after rejecting the petitioner’s application for recognition was returned to the petitioner.

Such submission of Ms Gutgutia is disputed by Mr. Bhattacharya, Learned Advocate for the respondent/writ petitioner.

Be that as it may, even without entering into this part of the dispute, we make it clear that in the event the said application has already been returned to the petitioner, the said application should again be submitted by the petitioner to the concerned authority immediately and the concerned authority will accept the same and process the same in terms of the direction passed by us hereunder”.

In view of the above the Eastern Regional Committee decided as under:

VT be constituted.

The institution is required to submit the willingness and affidavit for compliance as per new Regulation 2014 clearly stating the basic unit required by the institution.

(1) Online application made by the society/trust/institution on 31.12.2012. (2) Processing fee through cash challan submitted on 04.01.2013 i.e. after the date of online submission of the application.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 02.03.2013. The Appellate Authority vide Order No. 89-234/2013-Appeal/12th Meeting-2013/A76478 dated 25.10.2013 concluded that the ERC was justified in refusing recognition and therefore the appeal deserved to be rejected and the order of ERC confirmed (Pg. 176)

Decision of the Court Order:-

The institution preferred writ petition W.P. No 8552/2014 in the High Court of Delhi at New Delhi and the Hon’ble High Court has disposed of the writ petition on 04.12.2014 with a direction inter alia:

“Consequently, in view of the order dated 10th September, 2013 passed by the Supreme Court in SLP No 4247-4248/2009 directing that all pending applications shall be decided in accordance with new regulations, the present writ petition is disposed of with a direction that the petitioner shall apply afresh in accordance with new regulations, if required and the same shall be considered by respondents-NCTE/ERC for academic year 2015-2016 in accordance with new regulations which shall be notified in compliance with the directions of the Supreme Court.

If any deficiency is found, the same shall be conveyed to the petitioner, who shall be given an opportunity to remove the said deficiency, in a time bound manner. In case the deficiencies are removed within the given time, the application shall be processed in accordance with the relevant rules and regulations. If the deficiencies are not removed, the application shall stand rejected”.

As per the Hon’ble Court order, the institution is to apply afresh in accordance with new Regulation, 2014. As the Regulation, 2014 notified dated 28.11.2014, the new application shall be accepted by the Regional Committee from 01.03.2015 to 31.05.2015. The Hon’ble Court may be apprised that the application from the session 2015-17 shall be obtained from 01.03.2015 and the institution is required to make afresh application from 01.03.2015 onwards till 31.05.2015.

“ I note as per the direction of this court, case of the petitioner has to be considered for the academic year 2015-16 and 10.02.2015 is the last date for issuance of letter of intent to the institution with respect to grant or refusal of recognition in terms of the new Regulation, 2014.

In view of the above, respondents are directed to take a decision regarding the issuance of letter of intent to the Petitioner College with respect to grant or refusal of recognition in terms of New Regulation-2014 and comply with the order dated 04.12.2014 passed by this court before the next date of hearing, failing which the respondents shall personally present in the court on next date of hearing.

Re-notify on 10.02.2015

In compliance to the Order of Hon’ble High Court of Delhi dated 03.02.2015 the Eastern Regional Committee in its 180th Meeting held on 05th -06th February 2015 decided as under:

The ERC in its 151st meeting held on 26-27 Febryaru 2013 considered the matter of the said institution and as decided by ERC, summarily rejection order u/c 7(1-A)(ii) was issued vide No. 151.11(ii).51/2013/16725 dated 02.03.2013 on the following grounds.

1. Online application made by the society/Trust/Institution on 31.12.2012. 2. The Processing fee is not furnished on or before the date of submission of online application. Challan submitted is after the date of submission of online application i.e on 4.1.2013. The application of the institution along with the enclosure was also returned to the institution along with the Rejection order.

In response to the Rejection order the institution preferred an appeal before the NCTE Hqrs. The NCTE Hqrs. Vide its order No.F.No.89-232/2013 Appeal/12th Meeitng- 2013/A76466 dated 25.10.2013 has confirmed the ground of Rejection of the ERC.

The Appeal order was placed before the ERC in its 164th meeting held on 21st – 22nd November 2013 and the ERC noted the decision of Appeal Committee.

Decision of the Court Case :
