The 261st Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 24th – 25th September, 2018 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 261st ERC Meeting.

As per the notice for meeting issued by this office, the 261st meeting of ERC scheduled from 24th – 25th September, 2018. The Chairperson, ERC is unable to attend the meeting on 24th – 25th September, 2018 and given consent to continue the meeting in her absence. The members present in the meeting hereby unanimously decided that in absence of Chairperson ERC, Prof. Brajanath Kundu, Member, ERC shall function as Chairperson.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

ATTENTION!

1. The Committee unanimously decided that the institution may reply in response to the decision of the Committee uploaded on the ERC website without waiting for formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution needs to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier.

5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 6. The Committee suggested to prepare Data Bank for the teachers. 7. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier.

(i) Show Cause Notice was issued on 01.08.2018 for compliance of conditions relating to faculty as per Gazette Notification dated 09.06.2017. (ii) The institution submitted reply vide letter dated 21.08.2018 enclosing the list of faculty appointed on 22.05.2017 and joined on 25.05.2017. (iii) The institution is still deficient with regard to appointment of faculty as per NCTE Regulations, 2014 and its amendment dated 09.06.2017. (iv) For additional intake of 50 (one basic unit), the institution is required to appoint 07 faculties afresh with the qualification NET/Ph.D. as per Gazette Notification dated 09.06.2017 replacing the earlier one.

In view of the above, the Committee decided as under: Show Cause Notice be issued to the institution as to why the application applied for permission be not refused on the above point. The Committee therefore, provides last opportunity under section 15(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision. After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to SCN issued before VT, the Committee discussed the matter in detail and observed as under:

(i) Submitted land deed in the name of Ravi Shankar Singh instead of institution/trust name i.e. individual name, which is not accepted as per NCTE Regulations, 2014. (ii) As per online application, the name of institution is ‘Kaushalya Ramadhar Educational Trust’, whereas in the building plan, the name of institution mentioned is ‘K.R. B.Ed. College’, which mismatch each other. (iii) Building plan is not duly approved by the Govt. Engineer. (iv) Total built up area mentioned in the building plan (48399 Sq. ft.) and building completion certificate (2787 Sq. Mts.) mismatch each other. (v) As per building completion certificate, the total built up area mentioned as 2787 Sq. Mts. which is less than the required 3000 Sq. Mts. stipulated for proposed B.Ed. & D.El.Ed. Course with 50 intake each under NCTE Regulations, 2014.

ER-261.7 [Reply of SCN after VT] District Institute of Education and Training (DIET), Kaimur, Mohania, Plot No.- 1071-1078, Street No.-1, Vill.-Darwan, PO.-Mohania, Tehsil/Taluka- Mohania, 14. 261.7.1 Town/City-Mohania, Dist-Kaimur, Bihar-821109 (D.El.Ed.-Addl. Intake) (Government) (Bihar School Examination Board) (ERCAPP2218) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to SCN issued after VT, the Committee discussed the matter in detail and observed as under:

(i) Show Cause Notice u/s 15(3)(b) was issued to the institution vide letter No.57670 dated 03.08.2018 to comply the condition i.e. building is under construction. The institution submitted reply dated 29.08.2018, however deficiency mentioned in SCN still exists. (ii) The Principal Secretary, Education, Government of Bihar was appraised of the said position of the institution vide letter No.57669 dated 03.08.2018. Reply awaited.

In view of the above, the Committee decided as under: A reminder be issued to the Principal Secretary, Education, Government of Bihar with request to provide infrastructural and instructional facilities to the institution as per NCTE Regulations, 2014 and submit reply within 21 days.

ER-261.12 [Misc. Case] Uttaran College of Education, Plot No.- 851, 852, 853, 854, 855, 856, 857, 15. 261.12.1 Vill.-Deshbandh, P.O.- Damodarbati, Dist.- Bankura, West Bengal- 722144 (B.Ed.-Addl. Course) (Private) (University of Burdwan) (ERCAPP3623) Recognition granted to D.El.Ed. and B.Ed. Course with an intake of 50 each (one basic unit) from the academic session 2012-13 and 2016-17 respectively by ERC. NCTE.

The Committee considered the matter for change of management and observed as under:

(i) As per NCTE Regulations, 2014, there is no provision for change of Management. Therefore, ERC is not in a position to consider prayer of the institution for change of management.

(ii) Change of management of the Trust/Society/Company is asked by the institution. However, they have two different recognized institutions in two different districts and ERC needs confirmation that the Institute in Bankura District is actually running from the approved location as per recognition issued to that Institution.

In view of the above, the Committee decided as under: (a) Request of the institution for change of management is not accepted.

(b) The Vice-Chancellor, West Bengal University of Teachers Training, Education Planning and Administration is requested to confirm whether the institution viz. Uttaran College of Education is running from its approved location at Plot No.- 851, 852, 853, 854, 855, 856, 857, Vill.-Deshbandh, P.O.- Damodarbati, Dist.- Bankura, West Bengal- 722144 and requested to send the report within 15 days of the issue of the letter.

After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time and reply in response to Show Cause Notice, the Committee discussed the matter in detail and observed as under:

(i) Show Cause Notice was issued on 01.08.2018 for compliance of conditions relating to faculty as per Gazette Notification dated 09.06.2017. (ii) The institution informed vide letter dated 14.08.2018 seeking extension of 45 days time to complete all formalities. (iii) The Committee has allowed 21 days time.

In view of the above, the Committee decided as under: Show Cause Notice be issued to the institution as to why the recognition granted be not withdrawn on the above point. The Committee therefore, provides last opportunity under section 17(1) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision.

ER-261.2 [Court Case] Kuntala Das College of Education, Plot No.4299, 4302, 4708, Vill - Basukati, P.O.- Anandanagar, Tehsil/ Taluka - Bally Jagacha, Town/ City - Howrah, Dist - Howrah, 17. 261.2.1 West Bengal - 711227. (D.El.Ed.-Additional Intake) (Private) (West Bengal Board of Primary Education) (ERCAPP3505)

As per decision of 257th ERC Meeting, permission was granted to D.El.Ed. Course with an additional intake of 100 (existing 50 intake + additional 100 intake), thus making the sum total grant of 150 intake from the academic session 2019-2020 vide order No.ER-257.6.11/ERCAPP3505/(D.El.Ed.-Addl. Intake)/2018/57449 dated 12.07.2018.

That the institution filed W.P. No 18051 (w) of 2018 in the Hon’ble High Court of Calcutta and the Hon’ble High Court disposed of the matter on 19.09.2018 with the following directions:

“Mr. Mukherjee learned advocate appears on behalf of petitioner and submits, this direction is not being complied with at cost of time running in spite of Eastern Regional Committee (ERC) having sought clarification/direction from its headquarters regarding grant of permission from academic session 2018/2019 instead of 2019/2020 already granted by it. Time consumed for taking decision while current academic year is running is oblique method of denying petitioner sanction to conduct the course. A decision one way or the other be taken is prayer of the petitioner in this writ petition.

Mr. Nandy learned advocate appears on behalf of the Council and submits, headquarters of his client has issued instruction for preferring appeal against the order dated 28th August, 2018.

Petitioner by having filed and moved these two writ petitions has evinced desire to conduct the course in current academic year. That they are equipped to do so from next academic year has already received sanctioned, Petitioner’s such sanction, this Court presumes, was granted on inspection and satisfaction on infrastructure and faculty already available. However, the Council has statutory right of appeal.

At this present time, as has been ascertained from Mr. Nandy, appeal has not yet been preferred. The Council will forthwith, by 28th September, 2018 make known its decision on representation made pursuant to order dated 28th August, 2018 (supra).

Letter No.Legl064/665/2017-Legal Section-HQ dated 24th September, 2018 received from NCTE HQrs. is placed before the Committee. As per this letter “in light of the order dated 13.12.2012 passed by Hon’ble Supreme Court of India in W.P.(C) No.276 of 2012 titled as ‘Maa Vaishno Devi Mahila Mahavidyalaya Vs.
