1. The work shall be completed within one month from the date of agreement subject to the condition of Issue of material from store center in due time. 2. The work may be varyupto± 25%. 3. The work shall be carried out in accordance with Indian Electricity Act and Rules & per construction manual of U.P. Power Corporation Ltd. and RESSPO Schedule. 4. All the material of standard quality associated with the work shall be provided by the contractor as per tender specification. 5. Any loss and damage shall be recovered from the contractor account. 6. No T & P shall be supplied by the department at any cost. The transportation arrangement for safe carriage of materials shall be made by the Contractor at his own risk. 7. All general conditions of contract for execution of work will be governed as per form ‘A’ (General condition for the supply of plant and the execution of work in U.P. Power Corporation Ltd.) 8. The work shall be carried out under the direct supervision of junior engineer and Sub divisional Officer concerned. 9. Department will not be responsible for any accident, casualties and loss occurred at the time of execution of work. The contractor shall be fully responsible for the same. 10. The necessary permit for shutdown etc. will be given to the contractor by the representative of the department as and when required for completion of work in a planned way. 11. The security @ 10% of the tender value shall be deducted from the contractor’s bill which shall be released after 6 month from the date of completion of work. 12. The income tax and other taxes will be deducted from the bill, if and as applicable. 13. Penalty @ ½% per week subject to maximum of 10% of the total value of contract will be levied and deducted if the work is not completed within the stipulated period.

Instructions to tenderers

1. Before submission of the tender, the contractors are required to make themselves fully conversant with the Technical Specifications, drawing, instructions to tenderers, General Requirement of Specifications, and General Conditions of Contract of Form 'B' as may be applicable so that no ambiguity arises at a later date in this respect. 2. Any inconsistence or ambiguity in the offers made by tenderers shall be interpreted to the maximum advantage of Lucknow Zone, MVVNL and disadvantage to the tenderer. The tenderer shall have no right to question the interpretation of the purchaser in all such cases and the same shall be binding on the tenderer. 3. The cuttings and corrections made in the tender offers should be duly initialed by the tender. 4. In case the tenderer does not supply any of the required information at the time of tender, necessary loading may be made while evaluating the prices of his offer. 5. Telegraphic tenders shall not be considered under any circumstances. 6. Tenderer, if so desire, may authorize one representative for attending tender opening on his behalf. 7. The tenderers shall either themselves be manufacturer of the material offered or accredited representatives of such manufacturers or experienced supplier. Relevant documents in support of the above must be furnished. 8. (a) The tenderer must have all necessary facilities at their works for carrying out such routine and acceptance tests as prescribed in the relevant ISS. (b) The offered material must have been type tested as per relevant ISS. Photocopy of such type test reports must be submitted along with tender bid part-I . 9. The tenderer shall submit his tender in two separate parts. a. Tender Bid Part-I This part shall contain the Earnest Money and a confirmation of validity of offer of 180 days. This part shall also contain List of previous supplies for such type of materials during last 3 years and other terms and conditions except prices. The cover of this part shall be superscribed Tender Bid Part-I against "Tender Specification No. 198/EDCU/2015-16 due for opening on dated 24-12-2015 at 16.00 hrs." b. Tender Bid Part-II This part shall contain prices and financial incidence of deviations only and the cover shall be superscribed''Tender Bid Part-II (PRICE BID) against "Tender Specification No. 198/EDCU/2015-16 due for opening on dated 24-12-2015 at 16.00 hrs." c. Tender Bid part-I & II: Shall be put in one big cover duly sealed and marked as ''Tender Specification No. 198/EDCU/2015-16 due for opening on dated 24-12-2015 at 16.00 hrs." It may be noted clearly that in case the offer is not with the valid Earnest money, Part-II of the tender bid will not be opened.

d. Earnest Money Tenderer is required to deposit earnest money as specified in the tender notice i.e. Rs 4,000.00 (Rs Four thousand only) issued by a Scheduled bank. There shall be no exemption from earnest money even if the tenderer is registered with DGS&D, Stores Purchase Section of U.P. or U.P. Small Scale Industries etc. The Earnest Money shall be accepted in form of FDR pledged/ drawn in favor of SUPERINTENDING ENGINEER, Electricity Distribution Circle, Unnao. Offers without proper Earnest Money shall not be considered. The Earnest Money shall be refunded after award is finalized. The earnest money of successful tenderer shall however be retained till such time he deposits security. Tenderer shall ensure to put initials on each and every page of the tender. Last page of each document forming part of the tender shall bear full signature under official seal fully disclosing the name, designation and relationship with the firm of the signatory. 10. The tenderer must quote Unit F.O.R. destination price. The Unit F.O.R. destination price shall include packing, forwarding, freight and insurance charges against all risks including insurance charges for 30 days storage after receipt of material at destination stores/substation against all risks. 11. The quoted prices shall be firm and firm in all respect throughout the currency of the contract / agreement. 12. The prices quoted should be exclusive of all taxes, duties, octroi charges etc. on finished products which will be paid at actual on production of relevant original vouchers. However, the tenderer must indicate the rate of various taxes/duties livable as on the date of tender opening in Annexure-III. Form C/O for those having their establishment outside U.P. and Form III '0' for those having their establishment in U.P. will be obtained by the contractor from the concerned consignee. In no case Form C/O or Form III '0' shall be demanded through Bank. Whenever Central Excise/Sales Tax and other statutory levies are not applicable, or the bidder is exempted at the time of tendering from payment of such duties/levies, he should clearly indicate whether he would charge the same or not at the time of supply. In the event of applicability at the time of supply (where there is possibility of charging) he should specify the maximum rates which may become applicable based on the present tax structure at the time of tendering. Where firm(s) has/have quoted ambiguous or contradictory terms or have not categorically committed regarding charging of the amount of Excise duty at the time of supply, their offer shall be loaded by the maximum rate of Excise duty applicable to tendered item among all bidders. The total ordered quantity of material will be delivered within 30 days from the date of receipt of order. The prices quoted by the tenderer shall be compared inclusive of Excise duty and Trade Tax. Loading on any account as may be deemed necessary in the opinion of purchaser to bring the various offers at par to each other for comparison purposes may be done at the discretion of the purchaser.

The purchaser reserves the right to split the order among various successful tenderers in any manner he chooses without assigning any reason whatsoever. 13. Income and Trade Tax Clearance Certificate The tenderer shall furnish with the tender, Income Tax and Trade Tax clearance certificate to current as well as of the preceding year from the competent authority. 14. All material shall conform to the requirement of the latest editions of relevant ISS otherwise the adopted standards shall be compared with relevant ISS, clarity in the proposal. 15. Any overwriting/ omitting / erasing etc. in the tender should be duly signed and stamped. 16. Payment will be made by the letter of credit/ submission of RR. 17. The offerof tenderers quoting less than the specified validity i.e. 180 days from the date of opening of tenders may not be accepted at all. 18. Any approach etc. officially or otherwise on the part of the tender or his representative shall render his tender liable to be summarily rejected. 19. Guarantee/ Warranty of their product will be mentioned specifically. 20. Only tenders of those tenderers shall be considered who have sufficient experience of such type of supplies and have necessary resources &organization to undertake the work tendered for, to the satisfaction of the tendering authority. 21. All the tenderers must furnish a list of major orders placed on them (such type of supplies) supplied by them during last three years. 22. All the tenderers must submit past performance reports, if any, of the similar supplies made by them. 23. The quantity of the material indicated in the Tender Notice/Bill of quantity can vary to the extent of 10% on either side. 24. Any other information, which may be considered necessary by the tendered but not covered in the specification, may be submitted. 25. For any dispute arising out of this tender, Chief Engineer, Lucknow Zone, MadhyanchalVidyutVitran Nigam Ltd., Krishna Nagar, Lucknow will decide and his decision will be binding on both the parties.

SPECIAL TERMS & CONDITIONS

1. Electronic Meters with box and meter sealing books as per requirment will be made available by Executive Engineer, Electricity Test. Division. Unnao after testing and marking departmental number. 2. List of complete details of consumers will be provided to contractor by Sub Divisional officer, Electricity Distribution Sub Division-I, Shuklaganj, Unnao (Under Electricity Distribution Division-II, Unnao). 3. T&P will be arranged by Contractor. 4. Contractor will be responsible for sealing of terminal plate of meter after its installation and issue of sealing certificate to consumer and department duly signed by consumer and contractor and all column should be filled properly. In case of any revenue loss due to non issue of sealing certificate legal action will be taken against contractor. The sealing certificates must be verified and countersigned by Junior Engineer (Meter) concerned. 5. The tax will be deducted as per latest rules of taxation department. 6. Date of start of work shall be the date of issue of meters by Test Division. 7. Work will be carried out on live line and all risk /liabilities involved in the work will be responsibility of the contractor. 8. In case the Contractor does not complete the work and leave in between the remaining work shall be got completed by other agencies the cost so involve shall be charged from contractor. 9. Contractor will be liable to be penalized@ half percent per week subject to maximum to 10% of the whole agreement value for delayed work. 10. Assistant Engineer (Meter) Unnao will arrange to open a P.l. meters in multiple of 100 to contractor. The next lot shall be given to contractor after depositing the sealing certificate of previous lot consumers. 11. Contractor will submit the sealing certificates of installed meters . 12. Safe transportation of meters from Test Division to site shall be arranged by contractor. 13. If the meter installed is found not in working order the same will be replaced by contactor free of cost after getting approval form A.E (M), Unnao. 14. Contactor shall install meters strictly on new connections/defective meters connection and in no case shall replace theburnt meters. 15. The area of the contractor shall be the jurisdiction of Sub Divisional officers, Electricity Distribution Sub Division -I, Shuklaganj, Unnao (Under Electricity Distribution Division-II, Unnao). 16. In case it is proved that contractor has replaced burnt meter or has installed meter in the area other than the jurisdiction of contractor a penality @ Rs. 225.00 per case shall be charged from the contractor. 17. The work shall be carried out under the direct supervision of Junior Engineer and S.D.O., E.D.S.D-I, Shuklaganj, Unnao. 18. In case of any dispute or difference of opinion in the agreement, Chief Engineer(Lucknow Zone), Madhyanchal Vidhut Vitaran Nigam Limited, Lucknow will be sole orbitrator and his decision shall be final and binding on both of the parties. 1. The work shall be completed within one month from the date of agreement subject to the condition of Issue of material from store center in due time. 2. The work may be varyupto± 10%. 3. The work shall be carried out in accordance with Indian Electricity Act and Rules & per construction manual of U.P. Power Corporation Ltd. and RESSPO Schedule. 4. All the material of standard quality associated with the work shall be provided by the contractor as per tender specification. 5. Any loss and damage shall be recovered from the contractor account. 6. No T & P shall be supplied by the department at any cost. The transportation arrangement for safe carriage of materials shall be made by the Contractor at his own risk. 7. The work shall be carried out under the direct supervision of junior engineer and Sub divisional Officer concerned. 9.
