PAYNE GALLEYSPROOFS1 7/2/2013 1:01 PM REDEFINING “ATHEISM” IN AMERICA: WHAT THE UNITED STATES COULD LEARN FROM EUROPE’S PROTECTION OF ATHEISTS ABSTRACT There continues to be a pervasive and persistent stigma against atheists in the United States. The current legal protection of atheists is largely defined by the use of the Establishment Clause to strike down laws that reinforce this stigma or that attempt to deprive atheists of their rights. However, the growing atheist population, a religious pushback against secularism, and a neo- Federalist approach to the religion clauses in the Supreme Court could lead to the rights of atheists being restricted. This Comment suggests that the United States could look to the legal protections of atheists in Europe. Particularly, it notes the expansive protection of belief, thought, and conscience and some forms of establishment. -

Chef van de redactie buitenland was dr. Anton Constandse. Van 1946 tot en met 1948 had ik de opleiding voor de diplomatieke dienst gevolgd van het Nederlands Opleidings Instituut voor het Buitenland (NOIB) op Nijenrode. Van 1948 tot en met 1950 volgde ik op het Yale College in New Haven, Connecticut, de studie Political Science and International Relations. Inmiddels 25 jaar geworden twijfelde ik steeds meer aan een leven als ambtenaar van het Ministerie van Buitenlandse Zaken. Was ik niet een te vrijgevochten en te zelfstandig denkende vogel om zonder tegensputteren of mokken braaf Haagse opdrachten uit te voeren waar ik het wellicht faliekant mee oneens zou zijn? Van een dergelijke incompatibilité d'humeurs zou immers alleen maar gedonder kunnen komen. Op het Yale College had ik in dit verband al het een en ander meegemaakt. In 1949 was ik tot praeses van de Yale International Club gekozen, een organisatie voor de in New Haven studerende buitenlandse studenten. Nederland knokte in die dagen onder de noemer van ‘politionele acties’ tegen Indonesië. Ik nodigde ambassadeur F.C.A. -

He saw Marxism as an economic and historical science that lacked a philosophical and ethical basis. Consequently, he tried to justify the Marxian dialectic by using a philosophy indebted to German idealism to show that the dialectic was a fact about reality itself, and he also tried to provide an ethical defence of Marxism in terms of a positivist ethic enshrining the goals of the French Revolution. Such an understanding of Bax's philosophy makes his political activities appear more rational than historians have previously thought. 2 ERNEST BELFORT BAX: MARXIST, IDEALIST AND POSITIVIST I Ernest Belfort Bax (1854-1926) was the leading philosopher of the British Marxist movement during its formative years. In 1881 he wrote an article which was the first to proclaim Marx to the British public and which - together with an article by H. M. Hyndman - signalled the start of the socialist revival in Britain. 1 Marx told Sorge that Bax's article was "the first publication of that kind which is pervaded by a real enthusiasm for the new ideas themselves and boldly stands up against British philistinism"; though he also complained that "the biographical notices the author gives of me are mostly wrong" and "in the exposition of my economic principles and in his translations (i.e., quotations of the Capital ) much is wrong and confused." 2 Scholars have paid little attention to Bax despite the originality and historical interest of his philosophy. -

CHAYrERTEN THE ENUGHTENMENT IN CONTEMPORARY CULTURAL DEBATE Paul Cliteur and GeofI Gordon Everywhere in the world there seems to be a new orientation on religion as an importantpolitical factor. "Whoevermisunderstands religion, does not understand politics", is the title of a book by German authors also to be found among the contributors to the present volume 0#0 Religion, Po/ilia and Law.1 In the United States of America the secular tradition lies under siege by the so-called 'theocons', scholars and intellectuals who favour a breach with thesecularroots of the American Constitution.2 No less indicative is the upsurge in the Islamic·world of countless move· ments that claim political significance, some of them with a violent character, others more peacefully.3 It is not very surprising that under those circumstances there is also renewed interest in the tradition that is well known for its secular orientation: 4 the Enlightenment.
