Date ................................................................... ii Summary In the 2011/2012 Budget Speech delivered by the Minister of Finance, Pravin Gordhan, it was announced that a 15% withholding tax on gambling winnings above R 25 000 was to be introduced with effect from 1 April 2012. This treatise was undertaken to critically analyse the different elements of the proposed new withholding tax. It was established that the fiscus already benefits significantly from the gambling industry and levies and taxes from the gambling industry dwarf the revenue SARS collect from other forms of taxes such as Donations tax and Estate Duty tax. The necessity, therefore, of taxing gambling winnings in the hands of the individual is debatable. A comparison with the three foreign countries used by the Minister as an example of countries who have successfully implemented a withholding tax on gambling winnings exposed operational or other characteristics which bear no significant relationship to the situation in which the industry operates in South Africa.

    THE LEGALITY OF BANNING ONLINE GAMBLING IN SOUTH AFRICA: IS ONLINE GAMBLING NOT A COMPONENT OF GAMBLING? Segoane Lawrence Monnye* I. INTRODUCTION Gambling has undergone a metamorphosis from being immoral, to becom- ing amoral,1 and from being a leisure activity, to becoming an income-generat- ing recreational activity. In South Africa, the regulation of gambling is no longer based on morality, but on a set of principles ranging from income-gener- ation through taxes, job creation, and economic empowerment2, as well as pro- motion of tourism and other recreational activities.3 That legalization of gambling has become, and still is, motivated by its revenue-generating capabil- ity is evident from the amounts exchanging hands in this industry. In the fiscal year 2009-2010, the total amount of money wagered in South Africa-including money wagered from winnings-amounted to almost US $375 million (an equivalent of 2.8 billion ZAR).4 In the European Union the annual revenues generated in 2008 by the gambling service sector, measured on the basis of * Senior Lecturer of Law, University of South Africa and Attorney of the High Court of South Africa. While the rationale behind such prohibition and stigmatization has varied—from religious rejections of the immorality and irrationality of gambling to public concern over the proliferation of organized and street crime around casinos themselves (Reith 1999)—the need for casino operators to justify their existence, activities and operations has remained constant. In the words of Meyer (1977), a gambling industry represents an extreme case of an institutional field which must produce and disseminate myths legitimating its practices. Despite such stigmatized status, the past decade has witnessed a vast and rapid expansion of the casino industry throughout both the U.S. and world—the number of U.S. states permitting casinos increased from 2 to 27 from 1988 to 1999, while the number of countries increased from 77 to 109 (Nevada Gaming Control Board; Bear Stearns 2000; Eadington 1999; Thompson 1998).

Introduction 1.1. Gambling was illegal in South Africa prior to 1996, the exception being betting on horses. A study by the Wiehahn Commission in 1995 recommended that the government regulate gambling to protect society from overstimulation, raise revenue through taxes, create employment and empower the historically disadvantaged. The National Gambling Act, 1996, was passed incorporating recommendations from the commission. 1.2. In 2004, the Act was amended to introduce the establishment of a National Gambling Policy Council, which would ensure policy alignment in both national and provincial government. 1.3. The National Gambling Amendment Act, 2008, was passed to regulate interactive gambling, although it was yet to be promulgated for implementation. 1.4. The Gambling Review Commission (GRC) was appointed in 2009 to holistically review gambling successes and failures in the country and determine if more gambling activities could be introduced. In 2010, the GRC released its report recommending policy reforms. 1.5.     May 2016 REPORT ON THE DURATION OF LICENCES ISSUED IN TERMS OF THE EASTERN CAPE GAMBLING AND BETTING ACT 5 OF 1997 The ECGBB appointed consultants to perform the following activities and to prepare a detailed report that considers the appropriateness of issuing fixed term licences to licensees in terms of the Eastern Cape Gambling Act, 1997 (Act 5 of 1997 (EC)). 1. Consider the developmental impact of different categories of fixed term licences issued in terms of the Eastern Cape Gambling Act, 1997 by, inter alia, unpacking – Commitments by licensees to progressively invest in infrastructural development for the duration of the licence term; Long-term reinvestments without the benefit or option of re-licensing as a controlling instrument; Sustainability of existing infrastructure in the event where licences are not re-issued or extended; The determination and enforcement of additional conditions of licence with permanent licences. 2. Reflect on the benefits and disadvantages of fixed-term and permanent licences with accompanying recommendations; 3. Research and report on how the duration of gambling licenses have been considered in other developed and developing countries; 4. Research and report on policy considerations that informed the current gambling licence term dispensation in South Africa; and 5. Conduct interviews with existing licence holders and with the national gambling regulator. The expected outcome of this brief is to critique the functionality of licence terms as determined and issued by the ECGBB. The brief is furthermore to consider the effectiveness and efficiency of fixed term and indefinite licences to extract maximum value from licences issued by the Board.
