CRAHAN HUNTER COLLEGE AND THE GRADUATE CENTER, CITY UNIVERSITY OF NEW YORK he Latin American Program of the Woodrow Wilson International Center for Scholars hosted a seminar entitled T Religion, Culture, and Society on January 21-22, 2003 with special emphasis on the case of Cuba. Participants included scholars, as well as policymakers and practitioners. In an effort to better understand the interaction of religion, culture and society in Cuba, as well as else- where, the participants explored the applicability of the predominant ana- lytical models used to comprehend the interaction of these three elements. This was accompanied by a parallel exploration of concepts of civil socie- ty in both socialist and non-socialist societies, together with a review of the history of associationalism in Cuba and the impact of diasporas on Cuban identity. The impact of transnational links, both past and present, on the role of religions in Cuba was also analyzed in several presentations. This was particularly useful given the degree of permeability Cuban cul- ture and society have traditionally evidenced. While the seminar focused primarily on Catholicism, attention was also paid to Protestantism, Judaism and Spiritism given their contributions to the molding of Cuban culture and society. Among the principal issues discussed were: • How the study of the interaction of religion, culture and society in any country challenges existing theoretical and methodological models to define the units of analysis and locate each development, process, individual and group within a broader context in order to assess their actual impact. • To date five theoretical and methodological models have been widely employed in the study of the interaction of religion, culture and society: the institutional, popular (or Gramscian), phenomenological, rational choice and ideal interest (or Weberian). The logic of each helps determine the nature of the data sought, as well as the analytical approach. The institutional and rational choice approaches tend to focus on institutions and their drive to maintain influence and meet their goals, | vii | libro_Cuba_ok 1/12/03 6:09 PM Page viii Margaret E. Crahan both transcendental and material. Rational choice also assumes that reli- gious behavior is influenced by individual and group interests. The popular and phenomenological approaches tend to analyze the interaction of reli- gion, society and culture in terms of processes of social and political trans- formation which create new norms and actors that go beyond institutional needs. The phenomenological, in particular, examines concurrent cultural and institutional changes that may generate new capacities and modes of action that are reflected in such phenomena as increased activism. The ideal interest approach challenges rational choice by suggesting that religiously motivated behavior can reflect ideological and faith convictions that priori- tize the common good over individual or group interests. The most insight- ful analyses generally employ a combination of approaches. • In any analysis, it is essential to recognize the power of ideas and beliefs and their role in

The role played by some sectors of the Roman Catholic Church in the mediation efforts leading to this positive outcome has long been underestimated, as has the internal pluralism of the Church in this regard. This article specifically examines the transnational dimension of this mediation, including its symbolic aspect. The call to involve the Catholic institution transnationally was not limited to the tangible outcomes of mediation. The mere fact of involving transnational religious and non-religious actors represented a symbolic gain for the parties in the conflict struggling to impose their definitions of peace.     Borders by Consent: A Proposal for Reducing Two Kinds of Violence in Immigration Practice Richard Delgado* Jean Stefancic** ABSTRACT We describe a new consensual theory of borders and immigration that reverses Peter Schuck’s and Rogers Smith’s notion of citizenship by consent and posits that borders are legitimate—and make sense—only if they are products of consent on the part of both countries on opposite sides of them. Our approach, in turn, leads to differential borders that address the many sovereignty and federalist problems inherent in border design by a close examination of the policies that different borders—for example, the one between California and Mexico—need to serve in light of the populations living nearby. We build on our work on border laws as examples of Jacques Derrida’s originary violence. We assert that laws that exhibit a high degree of originary violence lead, almost ineluctably, to actual violence and cruelty, such as that perpetrated by Donald Trump’s child-separation policy, and that consensual and relatively open borders are the most promising way to minimize both forms of violence, originary and actual. 338 ARIZONA STATE LAW JOURNAL [Ariz. Powell Over the past two decades, the Western Hemisphere has seen dramatic advances in the institutionalization of democracy and the spread of free market economies. Today, the nations of the Americas are working in close partnership to build a hemisphere based on political and economic freedom where dictators, traffickers and terrorists cannot thrive. As fate would have it, I was in Lima, Peru joining our hemispheric neighbors in the adoption of the Inter-American Democratic Charter when the terrorists struck the United States on September 11, 2001. By adopting the Democratic Charter, the countries of our hemisphere made a powerful statement in support of freedom, humanity and peace. Conspicuous for its absence on that historic occasion was Cuba. Cuba alone among the hemispheric nations did not adopt the Democratic Charter. That is not surprising, for Cuba alone among the nations of Americas is a dictatorship. For over four decades, the regime of Fidel Castro has imposed upon the Cuban people a communist system of government that systematically violates their most fundamental human rights. Just last year, the Castro regime consigned 75 human rights activists, independent librarians and journalists and democracy advocates to an average of nearly 20 years of imprisonment. These prisoners of conscience are serving out their harsh sentences under inhumane and highly unsanitary conditions, where medical services are wholly inadequate. The Democratic Charter clearly states: “The peoples of the Americas have a right to democracy and their governments have an obligation to promote and defend it.” In fulfillment of that solemn obligation, the United States remains strongly committed to supporting the efforts of the Cuban people to secure the blessings of democracy for themselves and their children.
