13-2-1986 The Commission decided to make a local inspection of two places within Bokaro Steel City area with a view to appreciating evidence recorded by it. Accordingly, accompanied by the Secretary to the Commission as also the Investigating Agency, the Commission 'visited between 8.30 a.m. and 9.30 a.m. today, Dashmesh Nagar area where the kacha-pucca construction housing the Gurbdwara and a row of kacha houses (jhuggis) where Sikhs were residing had been totally demolished. There is hardly any trace of construction on the area left now. This place is sur- rounded by jhuggis and small pucca construction which are said to be unauthorised. The place is not conveniently approachable on account of lack of road facility and is in fact somewhat cut off from the main link.

The Commission next went to the Gurudwara in Sector 2 on which an attack had been made. During the riots a lot of victims and Sikhs who were afraid of their safety had taken shelter here.

A memorandum be left on record for consideration in due course.

Sorabjee and participation of CJC in the proceedings of the Commission. V. M. Tarkunde In view of the discussion which took place yesterday between Your Lordship and Mr. Phoolka, and out of deference to certain observations which you were pleased to make during the course of the discussion, an emergent meeting of the CJC was convened yesterday evening. After deep and careful reconsideration of the matter, CJC regretfully finds itself unable to alter its previous decision as set out in the said submissions.

CJC would like to make it absolutely clear that its decision and the said submis- sions filed by it do not in any manner imply lack of personal confidence in Your Lord- ship or any mark of disrespect for the Commission.

For reasons already stated in the said submissions CJC is of the view that the procedure adopted and followed by the Commission has rendered its continued presence and participation ineffective and pointless. Yours Sincerely,

CONCLUSION OF INVESTIGATING AGENCY WITH REFERENCE TO CAPT. BARETH'S STA I LAWNY Dy. S.P. Shri Narayana was asked to collect further details about statement of Capt. B. Bareth. It is found that by and large there is a similarity in the statement of Capt. Bareth and statement of Mrs. Tomar, the then City Magis- trate, Kanpur and incharge of military column, deputed to maintain law and order on 1-11-1984 in Kidwainagar area. It is also noticed from the statements of both the officers, City Magistrate and Captain that D,M. himself remained at the spot and appeared to be hesitant to take any firm 'action. It appears, from the facts collected that his conduct was not above board in tackling the situation. On the one hand he asked his personal security men to fire at the mob but on the Wilier hand he has not brought the army people to the forefront. It appears that Capt. Bareth insisted for firing telling that mob should be dispersed first. Mrs. Tomar, City Magistrate also was not in a position to do anything since a senior officer, (D.M.) was present at the spot who was talking to the members of the crowd. It may be a fact that situation was tense throughout the city of Kanpur but attempt should have been made by contacting control room to strengthen the force position at that particular place, to rescue sikhs.

Another aspect of the situation was that in spite of repeated appeals and request sikhs members of the family parti- cularly head of the family, continued firing. They were requested/advised to come out to go to police station but all fell flat, such adatnent attitude of sikh people certainly might have irritated authorities and local gentlemen to leave them at the mercy of God. Moreover, continuous firing by sardars (sikh persons) fomented anger of the mob.

Besides all, Harmail Singh was stubborn and over confident to protect himself and others, owing to Harmail Singh's audacity mob got swallen and fury of the mob mounted to a height. Ultimately, D.M. also lost patience and moved away from the post with force to see the situation elsewhere.

I have perused the report of investigation and the covering note of Mr. Meena. I agree that Harmail Singh mis- read the situation and maintained a hardstrong attitude in not listening to advice.

The District Magistrate, to my mind, could not have reacted the way he did. He had to meet the situation, if neces- sary by resorting to physical force and could not lose his patience and leave the spot by abdicating his responsibility. That is not the role of the leader.

Dear Sri Gtipta, Please refer to your D.O. letter No. 1/86/KPR/MCI(J), dated 8th May 1986, regarding measures relating to r.. tation of riot victims discussed with the Hon'ble Chairman during his visit to Lucknow on 12th April 1986. Please als,, refer to your telex dated 19-5-1986, conveying the orders of the Commission of the same date.

2. The State Government had agreed during these discussions to consider such cases as exceptional in the rn2!:c-- of providing relief and rehabilitation in which the Commission was satisfied that they were especially hard cases and deserved exceptional treatment and recommended as such to the State Government.

3. The first such case recommended by the Commission to the State Government was that of Smt. Harminder Kaur in respect of-whom the Commission was pleased to pass an order dated 12-4-1986 but a copy of which order was provided to the State Government only vide your letter No. 8.110135-MR(J), dated 28th April 1986 which was received in my office on 1-5-1986. This case is being processed expeditiously. • 4. The second such case is that of Smt. Satwant Kaur in which your letter dated 14-5-1986 was personally received Shri Naresh Dayal, Special Secretary, Home, Government of U.P., at your office at New Delhi on 14-5-1986. This is also being processed.

5. At its sitting at Lucknow on 12-4-1986, the Commission had also directed the Home Secretary, U.P. to consider the transfer of Inspectors and Sub-Inspectors of Police who were posted at Kanpur during the riots and that if it was rot ;- sible to transfer them out of Kanpur, they may be transferred to other Police Stations. I would like to inform the mission that this has been done.

6. The Commission had also directed the Home Secretary that the State Government may give financial aid to nc„- of kin of four persons reported missing from Kanpur during the riot and if considered necessary a bond may be taken from them that if it is proved that they did not die in the riots the money would be returned. Accordingly, instructions were sent to District Magistrate, Kanpur on 25-4-1986, and the report received from District Magistrate, Kanpur, in the case of Shri Gurjit Singh who was reported to be missing after the riots, financial aid of Rs. 20,000 has been paid to next of kin and a bond has been executed by them.

7. In addition to the above case, five other cases of persons missing after the riots were reported to the District Magis- trate, Kanpur (City). These cases are of (1) Shri Bhagat Singh s/o Shri Narayan Singh, (2) Shri Joginder Singh, (3) Shri Partap Singh, (4) Shri Jagir Singh, and (5) Shri Raghubir Singh Bhatia. At the district level, these claims were not sub- sta ntiated as per report dated 8-5-1986 and in some cases it was found that the person concerned died well before the riots and in others the person concerned never resided at the address given. However, further details of these cases are ag ascertained by the State Government.

8. As is evident from the above, the State Government are doing every thing possible to comply with the directions :vett by the Commission and there is no question of any refusal to comply with the assurances given before the Commis:: The above information may kindly be conveyed to the Hon'ble Chairman.

Kindly refer to the Commission's Order dated 2-5-1986 with regard to the investigation of First Information Reports, lodged by victims of Octobei-November, 1984 riots in Kanpur City.. The State Government had been directed in thiS Order to inform the Commission of all the actions,taken in this regard by 31st May, 1986. In this connection I would like to inform you that State Government has constituted a Committee of three persons, as directed by the Hon'bie-Commis- sion to sort out the cases appropriate for reinvestigation to supervise the reinvestigation of the cases after obtaining the permission of the competent Court and thereafter to supervise the effective prosecution of the cases in Court. A copy of the Office Memorandum, issued in this respect is annexed.

2. 1 would like to inform you that the State Government has also constituted a Special Investigation Team, headed by a Deputy Superintendent of Police to re-investigate the cases, which are found appropriate for re-investigation by the Com- mittee mentioned in the preceeding paragraph. Copies. 6f the orders, sent to the Director General of Police to appoint suitable investigating officers for this special Investigation Team, are also annexed.

3. The State Government has also issued directions to the District Magistrate, Kanpur (City) to re-examine the cases connected with the riots in which the accused have been granted bail by the Courts. In cases where there are sufficient grounds for moving the Courts for cancellation of bail, the District administration has been instructed to do the same ex- peditiously. Copies of orders, issued to the District Magistrate, Kanpur (City) in this regard, are also annexed.

4. As will be apparent from the above, the State Government is taking urgent action to implement the directions of the Hon-ble Commission dated 2-5-1986. The State Government will also maintain close watch on the implementation or these directions so that it is ensured that they are implemented in letter and spirit. With regards,

(I) Out of the total 103 applications, 69 have been forwarded for appointment to Directorate of Education, Punjabi Academy and Police Department for consideration for appointment on suitable posts. (2) The four cases, figuring on serial No. 158 to 161, belong to a single family and our criteria is one job per family. (3) As regards rest of the 30 cases, bonafides of applications are being verified from the site. Effarts are also being made by us to rehabilitate the widows in Government/Semi-Government organisation/depart- ments. About 300 applications of riot affected widows have already been sent to various departments for their absorption. We hope a sizeable number of widows will receive their axpointment letters soon. 8 widows have already been appointed in Slum Department of DDA, Punjabi Academy and DESU. Dear Shri Guptaji Kindly refer to the cases of four widows sent by Mrs. Jatinder Kaur Lall vide her letter dated 31-5-86 to Hon'ble Justice R.N. Misra Commission of Inquiry. As far as the cases of Mrs. Gurmeet Kaur and Mrs. Devinder Kaur arc concerned apparently their applications were not received by us. However, they are being approached to apply so that immediate allotment of living accommodation can be given to them. As far as the case of Mrs. Surjeet Kaur is concerned, she was given allotment on exchange basis while she wants on tenant basis. Unless she surrenders her house we cannot make allot- ment as per general policy followed by us so far.

2. Regarding the case of Mrs. Mohinder Kaur, as per available information she is not a riot affected widow. Her ease, however, is being further examined and if she is found eligible she would be provided suitable accommodation.

Kindly refer to the case of 7 widows and one Shri Wazir Singh. I may mention that we have taken up the rehabilitation of the riot affected widows. In pursuance of a recent decision to absorb them in Government/Semi-Government organi- sation we have already sent cases of 300 widows to various departments for their employment. In addition to this NAYE is conducting training courses in tailoring and it is expected that many of the widows will be able to get employment in various industries. We also expect to start an electronic unit with the help of a voluntary organisation at Tilak Vihar which is expected to provide employment to about 60 widows. As far as the seven cases are concerned they are also being con- sidered alongwith others for rehabilitation depending on the qualification and their willingness for a particular job or trade. 2. The case of Shri Wazir Singh at serial No. 8 is not covered under the policy guidelines for allotment of DDA tene- ment. However, the case is being put up separately to LG for his kind consideration whether he can be given an out of turn allotment of an MIG flat at Dilshad Garden. Kindly refer to your D.O. letter No. 185/86-MCI(J) dated 26-5-1986 addressed to the Secretary to Lt. Governor, Delhi, regarding 17 widows and 86 riot affected families living in Han Nagar Relief Camp for allotment of quarters. The position has been got checked which is as follows.

2. Regarding 17 widows, 6 at serial No. 1, 2, 3, 8, 11 and 12 have already been issued offer letters for allotment of tenements. One widow mentioned at serial No. 10 has refused allotment. In 4 cases (serial No. 5, 6, 13 and 14) the allot- ments were not made as they were not riot affected widows or had sold their own houses. These cases are, however, being reviewed. For the remaining 6 cases we have no record available whether they had applied for allotment to this office. These 6 widows are being approached to check up why they had not applied and whether they are interested in allotment. 3. As far as the list of 86 persons is concerned none of them is eligible as neither they were found during the survey conducted by us on 14th November, 1985 at Hari Nagar nor their names were included in the list of those who were staying in the camps. As such they are not eligible for allotment. Many of them might have come to Hari Nagar Camp with a view to get allotment. With kind regards,
