For more information, please contact [email protected]. : A Calculus of Interest Canadian Peacekeeping Diplomacy in Cyprus, 1963-1993 A Calculus of Interest Canadian Peacekeeping Diplomacy in Cyprus, 1963-1993 GREG DONAGHY Abstract: Fifty years ago, Canadian peacekeepers landed on the small Mediterranean island of Cyprus, where they stayed for thirty long years. This paper uses declassified cabinet papers and diplomatic records to tackle three key questions about this mission: why did Canadians ever go to distant Cyprus? Why did they stay for so long? And why did they leave when they did? The answers situate Canada’s commitment to Cypress against the country’s broader postwar project to preserve world order in an era marked by the collapse of the European empires and the brutal wars in Algeria and Vietnam. It argues that Canada stayed— through fifty-nine troop rotations, 29,000 troops, and twenty-eight dead— because peacekeeping worked. Admittedly there were critics, including Prime Ministers Pearson, Trudeau, and Mulroney, who complained about the failure of peacemaking in Cyprus itself. -

Report on ,the Canada-UK Colloquium Montehello, 27-30 September 1994 Introduction The Canadian Foreign Minister, the Hon Andre Ouellet, and the British Foreign Secretary, the Rt Han Douglas Hurd, addressing the recent Canada-UK Colloquium in Ottawa, spoke of the lively present of dealings between Canada and Britain, and of new energy following a traditional path. A characteristic of Canada-UK relations is the extraordinary amount of bilateral business and contacts there are, mostly unseen and unsung. The Canada- UK Colloquia are part of that “lively present”, and deserve wider recognition for the work they do in nurturing exchange between the two countries. The Canada-UK Colloquia hold annual bilateral meetings, usually on social and economic issues. Every five years, as was the case this year, the focus is on Canada-UK relations in the wider international context. The title of this year’s Colloquium was Prosperity and Stability in the International System: Canada-UK Cooperation in the Post Cold War World. The meeting was chaired by Senator Allan MacEachen, former Secretary of State for External Affairs, and currently Co-Chair of the Special Joint Parliamentary Committee reviewing Canada’s foreign policy, the report of which is due to be published in mid-November. The programme of the Colloquium is given at Annex A. The papers presented and a summary of the discussions, edited by Peter Lyon, are to be published in Spring 1995. -
Rediscovering Constitutional Law: Succession Upon the Death of the Prime Minister
REDISCOVERING CONSTITUTIONAL LAW: SUCCESSION UPON THE DEATH OF THE PRIME MINISTER Adam M. Dodek* Introduction Canadian legal academics have become mesmerized by the seductive dance of the Charter. Before the Charter■'s enactment in 1982, Canadian constitutional law was a rather arcane subject consisting almost solely of division of powers questions. Perhaps not surprisingly, the pronouncements of esteemed members of the Judicial Committee of the Privy Council on such exhilarating subjects as grain and margarine failed to capture the hearts and minds of generations of law students or legal academics. As the Bill of Rights proved to be no more than a cruel tease, it took the Charter to make constitutional law respectable, indeed popular, in the legal academy. However, in its excitement to embrace “the new Constitution”, the legal academy has almost wholly abandoned entire areas of constitutional law. Constitutional law consists of more than the coupling of traditional issues of federalism and the newfound infatuation with the Charter. Dicey defined constitutional law as including “all rules which directly or indirectly affect the distribution or the exercise of the Sovereign power in the State.”1 This definition of constitutional law has not shrunk over the years. Peter Hogg defines the subject as “the law prescribing the exercise of power by the organs of a State.”2 Yet like long- lost relatives, whole areas of constitutional law have been forgotten by the current *B.A. (McGill); J.D. Regionalism, Politics and Canadian Unity in the Age of a Global Economy CANADA IS A COUNTRY OF REGIONS existing in a global economy. Atlantic Canada, Western Canada, Quebec, Ontario, the North: each constitutes a distinct variable in the national equation. We even talk of sub-regions, that is regions within regions, such as the Acadian Peninsula of New Brunswick and Pictou County of Nova Scotia. At the same time, the world is rushing headlong towards a single economy predicated on the ideology of free trade and its concomitants, privatization and deregulation. Indeed, I often wonder what holds Canada together, what keeps it from fracturing along linguistic, economic and geographic lines, and increasingly, what will keep Canada from altogether succumbing to the voracious appetite of the global economy. There is no single counterweight to the forces of regionalism and globalization. Rather there is a series of counterweights, or a continuum if you will: the specificity of the federal dollar marks one endpoint, the vagueness of patriotism the other. Four recent books explore, to varying degrees, the twin themes of regionalism and unity. The political journalist Jeffrey Simpson argues that patronage need not be a matter of appointing cronies, hacks and bagmen, but that if used judiciously patronage can serve a greater national purpose, the bridging of linguistic, cultural and regional differences. For his part, political scientist Herman Bakvis demonstrates that reports on the death of the regional minister have been greatly exaggerated. In the interest of national unity, prime ministers still rely on ministers who will represent regional interests in cabinet. -
Canada's Re-Engagement with India
CANADA’S RE-ENGAGEMENT WITH INDIA Arthur G. Rubinoff No state reacted more harshly to India’s May 1998 nu- clear tests—or maintained sanctions directed at New Delhi that were counter- productive to its own economic and political interests longer—than did Canada. Ottawa’s hostile reaction to the Pokharan tests was the product of long-standing disenchantment with India. After pursuing a special relation- ship based upon a common middle-power perspective and shared British Commonwealth experience in the 1950s, Canadian-Indian relations deterio- rated into irrelevance because of incompatible interests over such issues as Kashmir, the operation of the Indo-China Control Commission, and Suez. They reached their nadir in 1974 following India’s detonation of a nuclear device believed to have been conducted with Canadian materials. Bilateral relations never recovered, despite significant immigration from India to Can- ada and cooperation over terrorist issues connected to the explosion of an Air India plane that resulted in the death of over 200 Canadian citizens. How- ever, relations reached a new low after the 1998 nuclear tests because of the human-security agenda of then-Foreign Minister Lloyd Axworthy, which promoted global nonproliferation rather than Canada’s bilateral interests with India. His policies had adverse consequences for political, economic, and cultural linkages, as the Canadian government’s retrenchment of diplomatic contacts resulted in diminished trade and an attack on the Shastri Indo-Cana- dian Institute by Indian diplomats who were insensitive to Canada’s tradition of academic freedom. RECASTING SOCIAL CANADA: A RECONSIDERATION OF FEDERAL JURISDICTION OVER SOCIAL POLICYt I Introduction: The constitutionalframeworkof the politics of socialpolicy Who speaks for Canada? For the past fifty years, during both the expan- sion and the retraction of the Canadian welfare state, the politics of social policy has revolved around this single question. At issue, though, have been not only the respective roles of the federal and provincial govern- ments but, more fundamentally, the very nature of the Canadian political community. On the one hand, there are those who claim that we are a community of communities, or a union of founding nations, bound together for the limited purpose of cooperating on matters of mutual advantage. For them, social policy is the quintessential provincial area of responsibility, and federal attempts to direct the growth of Social Canada, except to facilitate and enable provincial decision making, run against the grain of the division of powers. On the other hand, there are those who assert the existence of a truly Canadian political identity, one that both encompasses and transcends our linguistic and regional diversity. Social Canada is the cement of that political identity, both acknowledg- ing the existence of and giving effect to obligations of distributive justice between the citizens of the constituent units of the federation, bound to- gether in a community of fate. For those who hold this view, the federal government, as the single government that represents all Canadians, has not only a legitimate but also a central role to play. The provinces' grow- ing resistance to federal involvement in the social policy arena thus represents a worrisome turn in the evolution of the federation. -
