California Regulatory Update: Changes to Proposition 65 Clear & Reasonable Warnings

January 2017 Background - What is Proposition 65? . Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, was enacted as a ballot initiative in November 1986. The proposition protects the state's drinking water sources from being contaminated with chemicals known to cause cancer, birth defects or other reproductive harm, and requires businesses to inform Californians about exposures to such chemicals. . Proposition 65 requires the state to maintain and update a list of chemicals known to the state to cause cancer or . This list is maintained by the Office of Environmental Health Hazard Assessment (OEHHA), an agency operating under the umbrella of the California EPA. . Manufacturers – anyone who produces consumer products will need to phase in the new labels and warnings by 2018. . Commercial Property Owners – new warnings for parking structures and designated smoking areas . Industrial Facilities – anyone using and/or storing chemicals known to cause cancer or reproductive harm will need to redesign warnings . Transportation Authorities – Vehicle repair facilities will need to update warnings . Facilities – Updated warnings to be implemented by 2018 What changes are here/coming?

Additional language - § 25603 August 30, 2018 Consumer product label must have symbol and specific Consumer Product Exposure chemical names for each endpoint added. Warnings– Content
