The Combined World of Iconic Confectionery Brands Presents Its Exciting Novelties in Cannes eNews October 2010 THE COMBINED WORLD OF ICONIC CONFECTIONERY BRANDS PRESENTS ITS EXCITING NOVELTIES IN CANNES An exciting array of novelties from both Kraft Foods and Cadbury will be presented at the Kraft Foods World Travel Retail (KFWTR) booth at the TFWA World Exhibition in Cannes this year. Bringing together the key strengths of both companies, KFWTR has chosen a strong portfolio of novelties for the coming year. ”Having a diverse and strong brand portfolio in all key confectionery segments – chocolate, gum and candy – to present to our trade partners at the TFWA World Exhibition in Cannes is very exciting for us,” comments KFWTR Managing Director Andreas Fehr. ”We have such a delightful array of novelties for 2011 and look forward to sharing our combined plans for the coming year with our retail partners.” Chewing gum gets travel exclusive with new offerings Among the 2011 novelties, chewing gum will take center stage. The launch of a travel exclusive multipack gum range for Trident, the no. 1 chewing gum brand in the world (source: Euromonitor), and Stimorol, a strong gum favorite in many regions across the world, will further accelerate the impulse driven character of the gum seg- ment. Especially designed to fit travelers’ needs, the new convenient pack formats will fit perfectly in traveler’s bags while providing them with their favorite gum for their trip. Both Trident and Stimorol offerings include carefully se- lected flavours such as refreshing mint flavours (the number one gum flavour) and a variety of fruit flavours enabling exciting flavour experiences. The new products include innovative liquid gums (Trident Splash, Stimorol Fresh Zone, Stimorol Fusion), soft gums (Trident Senses) and the traditional hard gums (Stimorol Classic) – all in multipack formats for added convenience. To support the launch of the multipacks, a new merchandising solution for placement at the cash till area has been developed. The eye-catching, versatile displays are guaranteed to sup- port impulse sales at the counter. A convenient way to enjoy the most popular flavor of Toblerone Presenting the classic Toblerone taste in a snack size format, Toblerone Gold Minis Pouch extends the snacking sharing offer to the most popular flavor – milk. Toblerone Minis deliver the delicious, chunky eating experience Toblerone fans love, while being easy to share and enjoy on-the-go. This Toblerone pro- duct builds on the success of the previously released Mix Pack, and is presented in a proven travel retail format: the easy-to- carry pouch for convenient sharing and own consumption. A unique treat from the Alpine world of Milka In the delicious recipe of its latest creation, Milka presents a highly gift-worthy praline product: Milka Imagine. The light crispy pralines are made of a delicious combination of milk & cocoa cream, crispy wafer coated with tender Alpine milk cho- colate. Presented in an attractive gift box with a window panel that offers a tempting glimpse of the 24 elegant individually wrapped pralines inside, this new product will prove an exciting, though accessible addition to the gifting-driven con- fectionery category. Expansion of Cadbury Pralines for many occasions The Cadbury Luxury Selection is a strongly differentiated travel exclusive offering. For 2011, the popular Cadbury Luxury Selection 335g Pralines box will be extended to two new for- mats. The 190g format consists of 17 of these delicious, indivi- dually wrapped milk and dark pralines with hazelnut or almond cream and is ideal as an affordable gift perfectly suitable for in-flight sales. The Cadbury Luxury Selection 510g Pralines box is comprised of 45 indulgent treats ideal for sharing or those looking for larger boxes of these delicious pralines. Gifting is even more enjoyable with the new Côte d’Or Chocolate Minis Travel retail’s most popular Côte d’Or tablet flavor is now offe- red in a bite size format – ideal for gifting and sharing. The in- dividually wrapped milk chocolate pieces with whole hazelnuts will appeal to lovers of the intense cacao taste of Côte d’Or. The re-closeable box makes an attractive gift of the individually wrapped minis, providing an indulgent moment for oneself or to share with friends and family. The new product is ideal to broaden the eating occasion and to attract new consumers mo- ving from the traditional tablets to a more sophisticated gifting item. Mirabell offers snack-size Mozartkugeln The famous Austrian specialty Mirabell Salzburger Mozartkugeln, an exquisite praline filled with marzipan and nougat cream, will now be presented in a snack size format offering the same recipe for snacking consumption. Offered in a modern looking, conveni- ent reclosable cup, the completely new and unique Mirabell Mozartkugeln Minis will attract new consumers who will enjoy the delicious Mirabell Mozartkugeln as a great on-the-go snack. Freia Kvikk Lunsj tablet – two become one Two of Norway’s biggest brands, Freia Melkesjokolade and Kvikk Lunsj come together in a unique mouth-wa- tering tablet of Freia Milk Chocolate, pieces of Kvikk Lunsj wafer and a sprinkle of sea salt. Kvikk Lunsj has an extraordinary emotional heritage for Norwegians, as it has been a part of their acti- ve lifestyle for over 70 years. Already a big success in the domestic market, the king size format of Freia Kvikk Lunsj will strengthen the informal sharing segment of Freia in travel retail. A collection of the Freia best selling tablet flavours In 2011, Freia brings together five of its best-selling travel retail tablet flavours in single bite-sized squares in an attractive XXL-size bag: Freia Gullruter (Golden squares). After the success of the Freia Klassikere bag, which offers the most popular Freia bars, mixed in a snacking format, Freia Gullruter is a perfect addition to the snacking sharing segment of Norway’s number one chocolate brand. The combination of Freia Melkesjokolade, Firkløver, Daim, Walters Mandler and Fruktnøtt as bite-size favourites offers a per- fect mix for friends and family. The Kraft Foods and Cadbury travel retail teams look forward to present these novelties and invite trade partners to experience their iconic brand worlds at the Tax Free World Exhibition in Cannes, Riviera Village RG5..

While all these marks function as marketplace signs, they are regulated differently to serve different purposes. There are some known, accepted, and even encouraged overlaps between different kinds of marks in this ecosystem. This paper, however, raises a previously undiscussed overlap, the use of what I term “pseudo-certification marks”. This is where a mark appears to be signalling a characteristic of a goods or service and functioning as a certification mark, but is in fact registered and protected as an individual trademark.2 The contribution of
