PUBLIC AI Index: MDE 30/31/00 21 December PUBLIC AI Index: MDE 30/31/00 21 December 2000 Further information on 379/00 (MDE 30/29/00, 15 December 2000) - Fear for safety TUNISIA Human Rights Defenders Nejib Hosni, a human rights lawyer and member of the the Conseil National des Libertés en Tunisie (CNLT), National Council for Liberties in Tunisia was arrested today, 21 December, from his home in El Kef, a village about 100 km South-West of the capital. He was beaten by the police officers who arrested him. The harassment, intimidation and strict surveillance of human rights defenders in Tunisia continues. Many have had their telephones cut off. The police continue to guard the CNLT office closely and to prevent victims and families of victims from accessing the building. The office of the Ligue tunisienne des droits de l’homme (LTDH) Tunisian Human Rights League, also remains closed and under the control of the authorities (See UA 365/00, MDE 30/27/00, 28 November 2000). Nejib Hosni, a father of five, is now in detention and will have to serve a 15-days prison sentenced imposed by the District court of El Kef on 18 December. He was sentenced for having resumed practicing his profession as a lawyer, from which he was banned following his detention on trumped-up charges from 1994 to 1996, during which time Amnesty International considered him to be a prisoner of conscience. The ban was arbitrarily imposed by the authorities without the authorization of the Conseil de l’Ordre des Avocats, the Tunisian Bar Association, the only institution which may decide if a lawyer is to be suspended or disbarred. The trial of CNLT spokesperson Moncef Marzouki was postponed on 16 December by the court of first instance in Tunisia and is now due to start on 30 December. He is charged with “maintaining an unauthorized association” (that is, the CNLT) and “spreading false information with the aim of disturbing public order” (that is, publically condemning human rights violations in Tunisia.) FURTHER RECOMMENDED ACTION: Please send telegrams/telexes/faxes/express/ airmail letters in French, English, Arabic or in your own language: - expressing concern at the arrest, ill-treatment and imprisonment of prisoner of conscience Nejib Hosni and calling for his immediate and unconditional release; - seeking assurances that Nejib Hosni is protected from further ill-treatment while in custody; - expressing concern at the continuing attacks against human rights defenders and calling for these attacks, harassment and intimidation to cease immediately. Dr. Al Marri opened the Forum by welcoming participants to Doha and stressing that the recovery of assets required the cooperation by all countries represented at the Forum. He further underscored both the ethical and legal responsibility of all states to aid in the return of stolen assets to the legitimate owners. 2. H.E. Sheik Hamad bin Khalifa al Thani warmly welcomed all the delegations to Qatar and recognized that the Forum came at a crucial moment in the international effort to recover stolen and misappropriated monies and return the same to the Arab countries in transition.     religions Article Post-Islamism in Tunisia and Egypt: Contradictory Trajectories Houssem Ben Lazreg Department of Modern Languages & Cultural Studies, University of Alberta, Edmonton, AB T6G 2R3, Canada; [email protected] Abstract: In the wake of the Tunisian Revolution of 2011, Ennahda leader Rached Ghannouchi distanced his party from the main Islamist paradigm, which is spearheaded primarily by the Muslim Brotherhood in Egypt, and announced the separation of the religious movement entirely from its political wing (al-Siyasi and al-da’awi). In addition to reassuring Tunisians that Ennahda’s socio- political project is rooted in its “Tunisianity,” these measures aimed at signaling Ennahda’s joining the camp of post-Islamist parties and Muslim democrats such as the AKP in Turkey and the JDP in Morocco. In this article, using the comparative case studies, I examine the patterns, similarities, and differences between the Tunisian Ennahda party and the Egyptian Muslim Brotherhood in terms of their evolutions from an Islamist to a post-Islamist discourse and identity. I argue that the Ennahda party outpaced the Muslim Brotherhood in that shift considering the local/regional realities and the new compromises dictated by the post-revolutionary political processes in both countries. Although the Muslim Brotherhood managed to come to power and govern for only one year before being deposed by the army, Ennahda’s political pragmatism (consensus, compromise, and coalition) enabled it to fare well, ultimately prodding the party to adapt and reposition itself intellectually and politically. Electoral Process: 12 / 12 Tunisia’s 2014 constitution established a unicameral legislative body, the Assembly of the Representatives of the People (ARP), and a semipresidential system in which the majority party in parliament selects a head of government, while a popularly elected president serves as head of state and exercises restricted powers. The ARP consists of 217 representatives serving five-year terms, with members elected on party lists in 33 multimember constituencies. Parliamentary elections were held in October 2014 with a high turnout of 67 percent of registered voters. Nidaa Tounes won a plurality of the vote and 86 seats. Ennahda placed second with 69 seats, 20 fewer than in 2011. Three other parties won enough seats to play significant roles in government formation: the populist- centrist Free Patriotic Union won 16 seats, the leftist Popular Front won 15, and the center-right Afek Tounes won 8. Eleven other parties won between one and four seats each, and two seats went to independents. Presidential elections were held the following month, with about 64 percent of registered voters casting a ballot in the first round. Beji Caid Essebsi of Nidaa Tounes won 40 percent of the vote, followed by Mohamed Moncef Marzouki of Congress for the Republic at 33 percent. Some 20 additional candidates ran; Ennahda did not put forward a candidate. Because no candidate won a majority, a runoff was held in December, in which Essebsi won with 55 percent of the vote against 44 percent for Marzouki.

    Human Development in Morocco and the Arab Spring Region By Dr. Yossef Ben-Meir Abstract: The Arab Spring marks a time of great urgency to address the primary challenge now facing governments in the region: to advance human development at a rate and effectiveness not before seen, and that failure to do so for the majority of people directly feeds potentially devastating political instability. In order for local communities and neighborhoods to identify, plan, and implement socio-economic and environmental projects they most need – which is the engine for sustainable human development – governments must play a critical role in catalyzing and furthering these local processes by: 1) decentralizing power and the needed capabilities, and creating the necessary administrative structures that promote local development, and 2) supporting experiential training in facilitating participatory planning to members of communities, civil organizations, and government - and implementing the projects communities determine. Morocco has created a number of essential national frameworks that promote development through people’s participation, but their implementation is critically lacking for identifiable reasons that can be addressed. This essay provides recommendations to directly promote human development driven by local communities, which is vitally needed in the Arab Spring. The recommendations develop from Morocco’s experience and major ideas and lessons from the field of international development since the 1940s. The essay also connects decentralization and human development models to the cases and opportunities in Egypt, Iraq, and Palestine, as well as to the contexts of free trade and rural areas, where most poverty is concentrated.
