Introduction 1.1 This report presents to the Successful Neighbourhoods Scrutiny and Development Board with information to support discussions on: • The degree to which CCTV is situated on public and private land • The legal powers available to use CCTV in different scenario’s • The way in which the South Yorkshire Police and the City Council supervise CCTV’s use • The degree to which such systems have proved to be useful in deterring and detecting crime and anti-social behaviour • Ethics and civil liberty issues which restrain the use of CCTV on public and private land 1.2 This information is provided in respect of the City Council’s CCTV monitoring station only. 2. Background 2.1 The City Councils CCTV monitoring station receives images from 136 cameras situated around Sheffield City Centre and a number of inner City locations. The equipment is linked by fibre optic network and images are shared with the SWISS (Sheffield Wide Imaging Switching System) partners. Partners include South Yorkshire Police, Meadowhall, Supertram and Urban Traffic Control. The station also monitors a range of audio feeds including Pubwatch, CCRAC (City Centre Retailers against Crime) and Airwaves (Police Communications System). 2.2 The Monitoring Station also monitors Bus Lane traffic in the Wicker and Hillsborough areas and provides images recording contraventions to Urban Traffic Control. 3. The degree to which CCTV is situated on public and private land 3.1 Attached at Appendix A is list of camera’s and their locations within the City. The camera’s are a mixture of pan, tilt and zoom equipment which will allow 360 degrees movements and fixed cameras. 3.2 Appendix A also shows the positioning of these camera’s and whether these are situated on Public or Private Land and/or buildings 3.3 The percentage split between public and private land is 90/10% 4. The legal powers available to use CCTV in different scenarios 4.1 The Council’s Monitoring Station engages primarily in Public space surveillance and operates overtly. Where CCTV coverage is applied, signage is clearly displayed according to Data Protection legislation.??? 4.2 Any storage and release of footage is subject to legislation contained within Data Protection Act 1998?? And is monitored by the Council’s Data Protection Officer. 4.3 Images and footage that are requested by South Yorkshire Police are controlled by the use of Section 29 protocols contained within the Data Protection Act 1998. 4.4 The exception to this is where a request is made for covert surveillance under RIPA (Regulatory Investigatory Powers Act 2000) legislation. These requests are received from South Yorkshire Police and other authorised agencies. The governance of this is controlled by the Council’s Monitoring Officer. 5. The way in which the South Yorkshire Police and the City Council supervise CCTV use 5.1 The governance of the operation of Council’s CCTV Monitoring Centre is directed through the Steering Group of the SWISS Partnership. The Steering Group meets on a quarterly basis and matters of operational issues are discussed. 5.2 In cases where a RIPA request is made surveillance is not permitted until appropriate written authorisations are received from authorised officers. 5.3 The monitoring of cameras is quality controlled in two ways. Firstly by the footage being monitored by the Duty Inspector of South Yorkshire Police via the live feed to the control room located at the Police Headquarters at Atlas Court. Secondly random weekly sampling of recorded images carried out by the Council’s CCTV management team to ensure that staff is carrying out their duties correctly. 5.4 The Council’s CCTV Monitoring Station is staffed by employees who hold the SIA (Security Industry Association) accreditation and license. This is a legal requirement for any individual or business engaged in any CCTV monitoring activity. 6 The degree to which such systems have proved to be useful in deterring and detecting crime and anti-social behaviour 6.1 From the point of view from the CCTV Monitoring Station the degree to which its system has proved to be useful in the detection of crime and anti-social behaviour is difficult to ascertain. However, we are able to report that over the past twelve months the CCTV Monitoring Station has provided around 500 Images and footage to South Yorkshire Police in connection to crime and anti-social behaviour. 6.2 The Council’s CCTV Monitoring Station supports a multi agency response to incidents of crime and anti-social behaviour. Particular consideration should be given to the support the service is able to provide in facilitating early action by the City Centre Ambassadors, South Yorkshire Police, and Store Security etc. This often supports prompt action and therefore prevents more serious incidents occurring. 7 Ethics and civil liberty issues which restrain the use of CCTV on public and private land 7.1 The Council’s CCTV Monitoring Station employees are trained to operate the system in a way that complies with Civil Liberty, Data Protection and Privacy legislation.
