NASA OGC Reviewed 8/11/2020; ASU Reviewed 8/12/2020 NONREIMBURSABLE SPACE ACT AGREEMENT BETWEEN ARIZONA STATE UNIVERSITY / INSTITUTE OF HUMAN ORIGINS (ASU IHO) AND THE NATIONAL AERONAUTICS AND SPACE ADMINISTRATION (NASA) FOR THE LUCY IN SPACE CONTEST ARTICLE 1. AUTHORITY AND PARTIES In accordance with the National Aeronautics and Space Act (51 U.S.C. § 20113(e)), this Agreement is entered into by the National Aeronautics and Space Administration, located at 300 E Street SW, Washington, DC 20546 (hereinafter referred to as “NASA”) and the Arizona Board of Regents for and on behalf of Arizona State University and its Institute of Human Origins, located at 951 South Cady Mall, Social Sciences #103, PO Box 874101, Tempe, AZ 85287-4101 (hereinafter referred to as “ASU IHO” or “Partner”). NASA and Partner may be individually referred to as a “Party” and collectively referred to as the “Parties.” ARTICLE 2. PURPOSE The purpose of this agreement (“Agreement”) is to set forth the terms and conditions under which the Parties will cooperate in the conduct of the Lucy in Space Contest for grades 6–12, wherein U.S. students nationwide will be prompted to submit patch designs along with an essay describing their design (grades 6–8) or artwork/media and an essay/poem describing their art (grades 9–12) (the “Contest”). The Contest is intended to engage middle school through high school students in the human drive to explore, discover, and acquire knowledge about our origins and our place in the natural world on Earth, as epitomized by the Lucy fossil, and in the Solar System, as epitomized by the NASA Lucy Mission. NASA views such contests as opportunities that further its objectives to inform the public and distribute knowledge gained from the space program to a broad audience. NASA seeks to engage U.S. students in the engineering and scientific enterprise behind space exploration in furtherance of national goals to stimulate interest in science, mathematics, engineering, and technology. The NASA Lucy Mission to the Jupiter Trojan asteroids was named in honor of the 3.2-million-year-old human ancestor fossil “Lucy,” discovered by Donald Johanson, Founding Director of IHO. The Parties believe that by engaging students in a contest connecting the human ancestor “Lucy” and the exploration of some of the oldest objects in the Solar System—the Trojan Asteroids or “fossils of the Solar System”—they will understand more about the science of our origins and our place in the Solar System. This Contest, supporting and identifying applicable Next Generation Science Standards, will engage students in our connection to science, engineering, and technology. The themes of exploration and discovery will show students how they are connected to humankind’s history and their future as well. Because such contests draw considerable public interest, the process of registering, sorting, evaluating, and judging entries is labor intensive and requires careful consideration of entries and feedback to entrants. At the same time, such contests present excellent opportunities to engage the interest of young Americans in space science and exploration, its objectives, and the advances it produces in science, math, engineering, and technology, and knowledge in general. ASU IHO believes there is a societal benefit in generating students’ interest in STEM through real-life challenges. ASU IHO knows that connecting the NASA Lucy Mission to students across the country will help inspire the next generation of STEM talent to ensure our nation is able to support scientific research throughout the 21st Century. 1 NASA OGC Reviewed 8/11/2020; ASU Reviewed 8/12/2020 While ASU IHO recognizes the extraordinary public awareness and interest the Contest will generate, ASU IHO knows the true value is in the science, research, and discovery that the NASA Lucy Mission represents and the curiosity it inspires. ARTICLE 3. RESPONSIBILITIES A. ASU IHO will use reasonable efforts to: 1. In coordination with NASA, design, conduct, and manage the Contest to collect, evaluate, select, and deliver to NASA a mission patch design and essay/poem (grades 6–8) and message/artwork and essay/poem (grades 9–12), and the associated nomination materials (submitted content, student name, student grade, student school, if applicable, and student hometown) submitted by the students. 2. Coordinate with NASA on all matters pertaining to Contest publicity and news coverage and adhere to NASA’s Media Usage Guidelines (https://www.nasa.gov/multimedia/guidelines/index.html). 3. To the extent of existing networks, broadly disseminate information regarding the existence of, and promote participation in, the Contest. 4. Offer the Contest to eligible students who, in the Fall of 2020, will be in grades 6–12 in the U.S. (including U.S. territories and schools operated by the U.S. for the children of American personnel overseas), except dependents of employees directly affiliated with NASA, ASU IHO, the Partner’s organizations/companies, additional partnering organizations/companies involved in the selection of finalists, and their immediate families. 5. In coordination with additional partnering organizations/companies, provide NASA details on the Contest on a monthly basis from one month prior to the Contest launch date, October 16, 2020, through May 14, 2021, the date the winners will be announced, consisting of: a. The number of schools, teachers, and students registered for the Contest b. Number of potentially eligible entrants from each school/city/state in each judging category (as determined by grade level) c. Post-selection plan for making any awards or prizes d. Overall status of the project and milestones 6. In coordination with additional partnering organizations/companies, provide NASA with the recommended ten (10) patch designs and essays (grades 6–8) and ten (10) artwork/media and essay/poem (grades 9–12) (finalists), the associated, necessary student submission materials (submitted essay/poem/artwork/media, student name, student grade, student school, if applicable, and student hometown), and rationale for their selection, including; a. A statement from the students (or parents as applicable) who submitted the twenty (20) proposed essay/poem/artwork/media that they are not ineligible to enter the contest because they are dependents of employees of NASA, ASU IHO, the Partner’s organizations/companies, additional partnering organizations/companies or their immediate families; and waivers from the parents/guardians of the students who submitted the twenty (20) proposed essay/poem or artwork/media, stating that the submitted essay/poem or artwork/media shall become the property of the Institute of Human Origins, Arizona State University. b. Partner hereby provides NASA with a non-exclusive, royalty-free, worldwide 2 NASA OGC Reviewed 8/11/2020; ASU Reviewed 8/12/2020 license to use the submitted essays/poems or artwork/media described above for informational purposes in sharing information about NASA’s involvement in the Contest and this Agreement, and to permit others to do the same. In the event the submitted essay/poem or artwork/media makes any use of NASA program identifiers, including the NASA Insignia or the NASA Logotype, Partner’s use of such essay/poem or artwork/media shall be subject to the provisions of Article 12. c. Publicity and information releases of the students who submitted the twenty (20) proposed essay/poem or artwork/media, including any student information and/or education programs to be used for publicity. 7. Curate age-appropriate, standards-aligned educational curriculum and materials, including publicly available NASA materials, to support and complement the Contest. 8. Participate in a scheduled monthly status teleconference with NASA. 9. Preserve and deliver relevant data on the numbers of entries received and the locations in the U.S. or its territories from which entries are received. 10. Protect any personally-identifiable information of the Contest participants as prudent and required by law. 11. Recognize student submissions at a variety of Contest gates (e.g. finalist, winner). This may, but is not required to, include a certificate of participation, a signed NASA Lucy Mission photo, and/or a plaque or Lucy model. B. NASA will use reasonable efforts to: 1. Provide feedback, scientific expertise, and cooperation on the Contest, including: a. Access to publicly available imagery, artwork, and archival material for announcing and implementing the Contest; b. Web links from relevant NASA website(s) to the Contest website to be established by the Partner; c. Contest notification to teachers and students via appropriate e-mail lists maintained by NASA; and d. Opportunities, in NASA’s discretion and as opportunities may arise, for Partner to interview key individuals associated with the creation and development of the Lucy spacecraft and instruments. 2. Coordinate with the Partner on all matters pertaining to Contest publicity and news coverage. 3. Participate in a scheduled monthly status teleconference with Partner. 4. Protect any personally-identifiable information of the Contest participants which is submitted to NASA by Partner upon NASA’s request. 5. Review the ASU IHO waiver agreement template described in Article 3, Paragraph A.6.a., which agreement shall permit the license to NASA described in Article 3, Paragraph A.6.b. 6. Review the selected final essays/poems or artwork/media prior to the launch of the mission. 7. Public health conditions permitting, provide invitations to view the launch of the NASA Lucy Mission at Kennedy Space Center to the Partner, Contest judges, the families of the finalists and winners of the Contest, and the teachers of the finalists and winners. Note the invitation to view the launch does not provide any travel or pay any other costs of attending the event to those invited. 3 NASA OGC Reviewed 8/11/2020; ASU Reviewed 8/12/2020 ARTICLE 4. MILESTONES The planned major milestones for the activities for this Agreement defined in the “Responsibilities” Article are as follows, in line with the NASA Lucy Mission.
