This prehearing statement is submitted on behalf of Eastbanc-\V.D.C. Partners, LLC, with the consent of the property owners -the District of Columbia lmd 699 N, LLC (collectively, the "Applicant") in support of its application for consolidated review and approval of a planned unit development and related map amendment from R-5-B to CR on Lots 836, 837 and 855 in Square 37 (the "Property"). The Property is located on the north side of L Street, NW, between 23rd and 24th Streets, and has a total land area of 46,764 square feet. It is within the boundaries of ANC 2A02.

This prehearing statement addresses the comments raised by the Zoning Commission at the setdown meeting on July 25, 2011, and the Office of:Planning ("OP") in its setdown report dated July 15, 2011. This prehearing statement also includes additional information from the Applicant, including items required under Section 3013 of the Zoning Regulations.

A. Project Overview

The PUD is a mixed-use project with a total gross floor area of approximately 327,304 square feet. The development includes (i) a new public library with approximately 17,000 to 20,223 square feet of gross floor area, which fronts on L Street (the "Library"); (ii) approximately 7,100 to 10,100 square feet of neighborhood-serving retail along 23rd Street; and (iii) a multi-family residential building, above the Library and retail, consisting of approximately 287,184 square feet. The residential building will contain approximately 153 to 189 one-, two- and three-bedroom units. The project will be supported by a two-level underground parking garage with approximately 190 to 197 parking spaces. The building will have a maximum height of 11 0 feet, and the floor area ratio ("FAR") for the PUD will be approximately 7.0.

The PUD will significantly benefit the West End neighborhood by redeveloping the Property with a new West End Branch Library, new housing, and new neighborhood­ serving retail, including a privately operated cafe at the comer of 23rd and L Streets, through which people can access directly into and out of the Library, all of which will

#10509742 v3 add to the critical mass of people supporting street life. The Library wilL be designed to appeal to a wide cross-section of the community. It will feature a separate children's area that can be programmed with reading areas, storytelling and performanc~~ space, as well as a computer area. The Library will also have areas for adults and kens, as well as community meeting rooms that are located and designed to be available for use after hours. In addition to the Library, in connection with the PUD, the Applicant will construct and deliver to the District a new fire station to replace Engine Company #1 (the "Fire Station") within one block of the Property.' at the northeast comer of the intersection of M and 23rd Streets, in Square 50.

As a result of this PUD, the West End neighborhood will benefit from replacing two outmoded public buildings - a library and a fire station - with ergonomic, state-of­ the-art facilities, and redeveloping an underutilized site with a mixed-use development that is more in scale with the surrounding developments throughout the West End. The project will also include a number of community benefits and amenities, including, but not limited to, exemplary, world-class architecture, employment and training opportunities, sustainable design elements and new neighborhood serving retail uses.

B. Procedural Background

The application for the consolidated review and approval of the PUD was filed with the Zoning Commission on June 8, 2011. On July 25, 2010, the Zoning

Commission unanimously voted to set down the application for public ht~aring. With the filing of this prehearing statement, and the accompanying exhibits, the Applicant respectfully requests that this case be scheduled for the next available hearing of the Zoning Commission.

2 #10509742 v3 II. SUPPLEMENTAL INFORMATION ON THE APPLICATION

A. Information Requested by the Zoning Commission

At its meeting on July 25, 2011, the Zoning Commission voted unanimously to set down the Application for public hearing. In its discussion on the Application, the

Zoning Commission requested additional drawings and elevations ~howing (i) the proposed building in the context of the surrounding area; (ii) an. enlarged drawing of the loading area circulation; and (iii) clarification on the roof structures, including the proposed penthouse. Additionally, the Zoning Commission inquired about the size of the Library; the construction management plan for the project; and the development costs for the Library and Fire Station and how those costs impact the ability to provide on-site affordable housing. Following is the Applicant's response to those issues.

1. Additional Architectural Drawings and Elevations. Additional architectural drawings and elevations are attached as Exhibit A, including the following:

a. Sheets A-46 through A-49 show how the proposed building relates to the surrounding area.

b. Sheets C-11 through C-16 contain the enlarged drawings of the loading area circulation.

c. Sheets A-14 through A-16 and Sheets A-41 and A-42 provide additional details on the roof plan, including the proposed penthouse. As depicted in the plans, the main roof of the building is at elevation 109±; the maximum height permitted under the Zoning Regulations is 110 feet. The penthouse rises to a height of approximately 17 feet above the main roof. The penthouse includes an enclosed area that extends above the roof to elevation 119±; the maximum height permitted under the Act of 1910 is 120 feet. An unenclosed pool deck and roof terrace, atop the enclosed area, extend to elevation 126±. In addition to mechanical equipment, elevator overrides and stair towers, the enclosed area will be used for communal recreation space, including fitness rooms, media rooms, game rooms, communal rooms, kitchenettes, and similar uses, as permitted by Section 411.1 of the Zoning Regulations.

The Zoning Commission asked why the Library was designed with 17,000 to 20, 223 square feet, given that, in other cases, new public libraries have included more floor area (approximately 22,000 square feet). The Applicant is working closely with DC Public Library on the library design. A letter from DC Public Library explaining the size of the library and the number of dedicated parking spaces for the Library is attached as Exhibit B.

3. Construction Management Plan. The Applicant will furnish a construction management plan no less than 20 days prior to the public hearing on the application.

4. Cost of Library and Fire Station

. Attached as Exhibit C is a letter from the Deputy Mayor for Planning and Economic Development, Victor Hoskins, explaining the agreement between the Applicant and the District for the redevelopment of the Property in consideration of the delivery of the Library and the Fire station, and how the deal structure affects the Applicant's ability to construct affordable housing on the Property. The calculations for the development of the project are set forth in Exhibit D of this prehearing statement.

B. Information Requested by the Office Of Planning

In Section IV of its setdown report dated July 15, 2011, the Office of Planning ("OP") requested that the Applicant provide additional information on various aspects of the project. Following are the issues raised by OP and the Applicant's reBponse to same.

1. Status of Funding for Affordable Units Proposed in Square 50. The Applicant will update the Office of Planning and the Zoning Commission on the status of the funding for the affordable units proposed in Square 50 no less than 20 days prior to the public hearing on the Application.

2. Justification for Flexibility Requested a. Retail and Library Parking. The Applicant seeks flexibility to have 6 parking spaces for the retail use where 12 parking spaces are required, and to have 6

4 #10509742_v3 parking spaces for the library use where 18 parking spaces are required. OP has requested additional information to justify and assess the potential impact of the parking relief on the adjacent streets.

The retail space for the PUD is designed to accommodate neighborhood serving retail uses intended to primarily serve people who live in the project and the immediate surrounding area - people that are most likely to walk or ride their bicycle to the project versus driving a private automobile._ With regard to the library parking~ as noted in its letter attached as Exhibit B, DC Public Library has determined that 6 parking spaces is adequate to serve its projected parking demand. Like the existing library and the proposed retail uses, the new library is intended to serve the immediatt:: neighborhood, making it very convenient for pedestrian and bicycle access.

On-street and off-street parking is also available to accommodate those persons that may drive to the library and retail uses. As noted in the Traffic Impact Study, there were a limited number (4) of on-street parking spaces available during the afternoon, from 2:00 p.m. to 4:00 p.m. During the evening peak parking period, :6~om 6 p.m. to 7 p.m., there was more than an adequate amount of on-street parking spaces available (79) within reasonable walking distance of the PUD site. Parking is also available in the following public parking garages near the Property:

• Ritz Carlton parking garage, 1150 22"d Street (400 parking spaces)

• Westin Hotel parking garage, 1151 24th Street (100 parking spaces)

• 2430 L Street parking garage I IM-Park (107 spaces)

• 2440 M Street parking garage I Colonial Parking (250 spaces)

• 2400 M Street parking garage

b. Loading. The Applicant requests flexibility to provide a 30-foot loading berth for the apartment building instead of a 55-foot deep loading berth, as required by Section 2201.1 of the Zoning Regulations. Based on development experience in the District, the Applicant does not believe that the residential use proposed for the PUD will

5 #10509742_v3 alleys for loading rather than entering directly from a street. In this case, the studies performed by Symmetra Design indicate that the east-west alley that runs between 23rd and 24th Streets cannot accommodate turning movements from a 55-foot wide tractor trailer. Other than the size of the 55-foot loading berth, the project complies with the loading requirements under the Zoning Regulations.

c. Roof Structures. OP requested additional information as to the project's non-compliance with the setback requirements for roof structures, and also inquired about the function of the unoccupied space within the enclosed areas of the roof structures.

Sheet A-16 of the enclosed drawings highlights those sections of the penthouse that do not meet the required 1:1 setback. That area is limited, primarily, to the rear of the building and is not visible from the public realm. Along 23rd Street, the building is pulled back from the property line, narrowing the roof, and causing a reduced setback of the penthouse from the building wall. Although the penthouse has a setback of 10 feet and 14 feet along the building wall facing 23rd Street, it is setback 18 feet from the property line and, therefore, will not have any adverse aesthetic or visual impact from 23rd Street.

Sheet A-14 of the architectural drawings identifies the enclosed areas of the penthouse that will be used for "Communal Recreation Space." This area may include fitness rooms, media rooms, game rooms, communal rooms, kitchene':tes, and similar spaces/uses.

e. Sheets A-02 and A-03 show the relocation of bicycle spaces to address concerns about accessibility and security. Specifically, for the East Tower of the building, the bicycle spaces have been relocated to the upper level of the parking garage.

f. Sheet A-49 depicts the sightlines down 23rd Street with the redevelopment of the property.

5. Mix of Unit Types. To the extent possible, given the stage ofthe project design, the Applicant will provide information on the mix of unit types no less than 20 days prior to the public hearing on the Application.

9 #10509742_v3 6. Maintenance of Green Roofs. The Applicant will provide an explanation on how the green roofs will be maintained. This information will be provided no less than 20 days prior to the public hearing on the Application.

7. Justification for Amount of Residential Parking. The Applicant will continue to analyze the amount of parking provided for the apartment building, lmd will provide more information on the amount of residential parking proposed for the PUD no less than 20 days prior to the public hearing on the Application.

8. Transportation Study. The Transportation Impact Study for the project, which included traffic, transportation and parking analyses as well as measures for transportation demand management, was attached as Exhibit G of the Applicant's statement filed on June 8, 2011. The study was also submitted separately to DDOT by Symmetra Design on June 6, 2011. The Applicant has been working with DDOT in order to timely address any concerns the agency may have regarding the project. The Applicant's communication with DDOT includes:

• Phase 1: Initial Evaluation Memorandum submitted on March 30, 2011. The memorandum provided Symmetra Design's proposed study area, analysis methodology, and data collection plan.

• June 21, 2011: DDOT Coordination Meeting.

• August 4, 2011: Preliminary Zoning Review Meeting (PZRM).

• August 17, 2011: PZRM follow-up meeting.

9. Community Outreach. The Applicant is scheduled to make a presentation on the Application to ANC 2A on or about September 19th. The Applican1 has participated in over 50 meetings in the community to discuss the project, and will ,:;ontinue to meet with the surrounding property owners and residents who have expressed an interest in the proposed PUD prior to the public hearing on the Application.

In accordance with Sec. 3013.1(g) ofthe Zoning Regulations, the estimated time for the presentation of the Applicant's case is 45 minutes, subject to th~ decision of the presiding officer at the public hearing.

E. Agreements with the District of Columbia

The Applicant has entered into a Certified Business and Utilization and Participation Agreement with the Department of Small and Local Busine:ss Development, which was attached as Exhibit J of the Applicant's Statement filed on June 8, 2011. Also, the Applicant entered into a First Source Agreement with the Department of Employment Services ensuring cooperation with the Department for employee recruitment for jobs created by the PUD, with the objective that 51% percent of the employees hired in connection with the development of the project are District of Columbia residents. A copy of the First Source Employment Agreement was previously

In accordance with Section 3013.10 of the Zoning Regulati~ons, the report prepared, by symmetra design, was attached as Exhibit G of the Applicant's original statement filed on June 8, 2011.

IV. CONCLUSION

In accordance with Section 3013 of the Zoning Regulations, this prehearing statement is submitted on behalf of Eastbanc - W.D.C. Partners, LLC in order to provide additional information in support of its application for the PUD proposed in Square 37, Lots 836, 837 and 855, on the north side of L Street, NW, between 23rd arid 24th Streets. As you know, the District of Columbia Publit Library on the site is to be. demolished along with other structures and replaced by a new West End Liorary located within the new mixed-use bllilding proposed under the PUD~

I am writing to confirm that:

1) OCPL is working with the developer on the West End Library program and desigrt We have currently agreed to a library of approximately 20,000 square feet located primarily on thE! ground floor with staff work space on a mezzanine level. The final square footage might be adjusted depending on DCPl's program and design needs and how funding is allocated to meet these needs. iioweverthe floor area of the library will not be less than approximately 17,00dsquare feet. DCPL musts gn off on the final interior design and layout in order for the developer to proceed with the development.

2) DCPt does not provide free parking for its staff. New DCPllibraries do provide very limited parking for patrons. For the West End Library, we have negotiated an arrangement with the Developer where DCPL will purchase and own six parking spac~saspart of the new library, and the developerwill make up to an additional six spaces available for lease by DCPL or its employees, but these :;paces could be leased to the retail spaces in the event that theyar~ not used by DCPL or its employees.

3} In light of the foregoing, DCPL supports the developer's request for flexibility to provide six library parking spaces where 18 parking spaces are required.

Over the past few years DMPED has worked together with DC Public Library, Metropolitan Police Department, DC Fire and Emergency Serv1ces, and the Office ofPlanning to coordinate the District of Columbia's redevelopment strategies ofcoth Square 37 and another nearby District owned parcel, Square 50.

Through the planning process it was determined that the public facilities at Square 3 7 and Square 50 were at the end oftheir useful lives and needed to be fully renovated or replaced. With The 2006 Comprehensive Plan's Future Land Use Map considering higher density for future: developments in the area north ofWashin&rton Circle, the District of Columbia had the opportunity to leverage the value in its air rights to pay for new facilities. On October 2, 2009 DMPED issued a request fiJr proposals tor Square 37 and Square 50, requesting that developers propose a plan for the Squart: 3 7 and Square 50 sites that would yield the District, at minimum, a new library and fire station.

Although there was initially a good deal of interest in these two public sites, the District received only two offers in response to the solicitation. Only one of these, the offer by EastBanc W.D.C. Partners, proposed building both a new library and a new fire station without requesting any subsidy from the District.

The District of Columbia, as owner, operating through DMPED has worked with the Applicant since the project was awarded in March 2010 to structure a disposition agreement for both sites. The resulting agreement, approved by Council last summer anticipates that the Applic1mt pursue a PlJD on Square 37 and leverages the value associated with the rezoned project site to fund the development of a new library on Square 37 and new tire station on Square 50. This is why the District adopted the Applicant's proposal to construct an entirely market-rate residential building on the Square 37 site. In order to realize the other extraordinary public benefits without any subsidy from the Distric·;, it is necessary to provide the Applicant with relief from any affordable housing requirements on Square 37.

Notwithstanding this, the District remains committed to the development of affordable housing on Square 50 per the overall development plan. Since the District has always anticipated there would be insufficient funds from the land value to pay for the affordable housing (after paying for the library and fire station) we have agreed to try and fmd a way to fund the gap associated with ddivering approximately fifty-two units of affordable housing on Square 50. Whil~ it is the District's desire and intention to provide affordable housing funding as part of this project, we are keenly sensitive to the importance of replacing the library and fire station and we do not wish these proje,:ts to be delayed in the eventthat the affordable housing funding is delayed. Therefore, we respectfully request that the Zoning Commission recognize the unique natute of this redevelopment and relieve the Applicant from any additional affordable housing requirements. Any requirement of affordable housing on Square 37 would reduce the land value to the point where it would be impossible for the Applicant to deliver the fire station and library without direct subsidy from the District.

I urge the Zoning Commission to consider the important aspects of this case and to approve the West End Square 37 Consolidated PUD.

Sher, Director of Zoning and Land Use Services, has more than 30 years' experience as the leading consultant in the Zoning Regulations and development processes in the District of Columbia. For more than 18 years, he has advised developers and property owners on the interpretation and application of development regulations and approval processes in the city. He has appeared as an expert witness in zoning and planning before the District of Columbia Zoning Commission, Board of Zoning Adjustment, Historic Preservation Review Board and the Mayor's Agent for the historic preservation act, before the Zoning Hearing Examiner and the Planning Board in Montgomery County, Maryland, and in local and federal courts. Recent major cases in which he has played a leadin_g role include the MCI Center, the new Washington Convention Center, the residential/retail/hotel complex at 2200 M Street for the Ritz Carlton, and the planned redevelopment of the old Hecht's block at 7th and F Streets, the Station Place office development adjacent to Union Station, to be the new headquarters for the SEC, the International Monetary Fund's Headquarters II office builcltng at 1900 Pennsylvania Avenue, the new headquarters for the U.S. Department of Transportation at the Southeast Federal Center and the redevelopment of the Capper/Carrollsburg public housing projects in Southeast using a HOPE VI grant. For more than 14 years, Mr. Sher was employed in the various zoning and planrung offices of the District of Columbia. As one of the chief technical staff persons for the Zoning Commission, he played a significant role in drafting major portions of the present Zorung Regulations, mcluding the waterfront and mi..xed use (CR) districts, the regulations concerning community based residential facilities, the planned unit development regulations and the regulations governing parking and loading. P'o.r eight years, Mr. Sher served as the Executive Director of the Zoning Secretariat. As such, he was the chief executive/operating/ administrative officer for the Zoning Commission and the Board of Zoning Adjustment of the District of Columbia. Mr. Sher supervised the handling of over 1,600 cases before the Board of Zoning Adjustment and numerous rezoning, planned unit development and text amendment cases before the Zoning Commission. Matters whkh he assisted the Zoning Commission in resolving mcluded the rezoning of the Dupont Circle area, the Hotel­ Residential Incentive District, implementation of the Foreign Missions Act and major development cases such as McLean Gardens, Techworld, Lafayette Center and the Sumner-Magruder schools redevelopment. Mr. Sher represented the Zoning Commission and d1e BZA before Congress, the Council of the District of Columbia, the Mayor and other public agencies. Mr. Sher is a member of Lambda Alpha, the honorary land economics society, and the American Planning Association. He also served on the Mayor's Commission on Downtown Housing, various task forces of the Greater Washington Board of Trade and the D.C. Building Industry Association and the Metropolitan Washington Council of Govemmem Metropolitan Development Community Advisory Committee. He has also served as guest lecturer at various universities on planning and zoning issues.
