Ulema buried in the Holy City of Qom 2 (In the Name of Allah, the Beneficent, the Merciful) Foreword The Holy Prophet − said: "There are two groups of my Ummah that when they are pious, my Ummah will be upright, and when they are immoral, my Ummah will be corrupt." The Messenger of Allah − was asked who they were, and he answered: "The religious scholars and rulers."1 It is one of Allah’s countless bounties that there has never been a time that mankind has been without guidance. This guidance has appeared in many forms, including Prophets, Imams, and in their absence, the Ulemas and Marajas. ‘Ulema’ are defined as being Muslim scholars trained in Islam and Islamic law; in this day and age of the Ghayba (occultation) of the 12th Imam, Imam Mahdi Β, they are the main source of external guidance that people turn to for answers to questions, doubts, and simply as overall role- models. The Holy City of Qom, Iran, has been the epicentre of Islamic knowledge due to the presence and blessings of Bibi Ma’sooma ϑ, the sister of the 8th Imam, Imam Radha Β) Ulema of all backgrounds and all levels have been drawn to Bibi and this city, both benefiting from and contributing to the fountain of Islamic knowledge that flows here in the Hawzas (Islamic Seminaries) of Qom. This opposition, obviously, had certain theoretical bases. Though the power and authority of 'ulama' vis-a-vis the existing government began to increase right from the Safavi period, an attempt to make a direct bid for power is certainly a recent phenomenon. Although there are quite a few general works available on the changing roles of the Iranian 'ulama', there is no serious study of the theoretical changes that took place in the thoughts of Shi'i 'ulama' during the reign of Mohammad Reza Shah. This dissertation tries to fulfil this gap. The dissertation is divided into seven chapters. The first chapter deals with the origins of Shi'i theory of imamate. Most of the basic concepts of Ithna 'Ashari Shi'ism (the Twelvers) such as imaroat ghayabat, intezar and taqiyya were crystallised during the Buyid and Mongol periods. According to Ithna 'Ashari Shi'i belief only the Prophet and imams possess legitimate authority -2- to rule over the people. They enjoyed spiritual as well as temporal velayat' over the people. -

Hirschkind Professor Hussein Ali Agrama Fall 2016 Te Practice of Shi‘i Jurisprudence in Contemporary Lebanon Copyright 2016 by Jean-Michel Landry Abstract Te Practice of Shi‘i Jurisprudence in Contemporary Lebanon by Jean-Michel Landry Doctor of Philosophy in Anthropology and the Designated Emphasis in Critical Teory University of California, Berkeley Professor Saba Mahmood, Chair Drawing on ethnographic and archival research conducted in Lebanon and France between 2012 and 2014, this dissertation discusses Shi‘i methods of legal reasoning (ijtihad), and considers their incorporation into state juridical apparatuses. Since its colonial inception in 1926, the Lebanese state has harnessed the shari‘a tradition to regulate the family life of its Shi‘i citizenry. In order to properly grasp the ethical and epistemological transformations underlying the state’s appropriation of Shi‘i legal discourse, I suggest we frst examine the training judges, clerics, and jurists receive in traditional hawza seminaries. Tis dissertation’s frst three chapters show that learning to perform authoritative shari‘a reasoning requires not only developing a mastery of the sacred texts, but also submitting oneself to the discipline of the Shi‘i moral tradition. Te remaining chapters examine what Islamic legal reasoning becomes when it gets entangled with the judicial functions of a modern nation-state. -

Introduction to Islamic Law Lesson 2 Introduction to Islamic Law • The science of Islamic jurisprudence has an uninterrupted history going back over a thousand years. • Masters have trained students and those students in their turn have trained other students, and this has continued down the ages until today. Furthermore, this relationship between master and pupil has never been broken. • One of the preparations for learning about any field of knowledge is to pay attention to the famous personalities of that field, the views and ideas of whom were important, and to their scholarly contributions. Introduction to Islamic Law • We will begin the history of the Shia jurists from the period of the 12th Imam’s minor occultation" (260 AH) and this we will do for two reasons: • 1. The period prior to the "minor occultation" was the period of the presence of the holy imams. Although there were legal experts in the Islamic world, people generally made an effort to ask the imams and only resorted to these scholars if they did not have access to the imams. • 2. In the formal, classified jurisprudence, we are limited to the period of the minor occultation, None of the actual books in jurisprudence from that period has reached us. It seeks to trace the inception and development of one of the most powerful Islamic movements of the modern period: Usuli Shi‘ism. I also hope to contribute to a better understanding of the ideology and practice of the Usuli branch of Shi‘i Islam. My underlying argument suggests that the recent ascendancy of Shi‘i Islam is the culmination of a process incepted by Vahid Bihbihani (1706-1792) and his disciples, who revived a rationalist school of Islamic thought in the eighteenth century, which has become known as Usulism. Largely as a result of the Usuli reformation, the Shi‘i clerical establishment has gained unprecedented social, political, and economic power, especially in Iran, where high-ranking clerics (ayatollahs) have established a theocratic government since 1979. -

My research was complete but the inspiration to write was painfully absent. Producing a 200 page dissertation seemed like a never-ending endeavor, and one that could certainly never be completed in a person’s lifetime. One morning, while sitting in a coffee shop in northwest DC and eavesdropping on the conversation of a couple next to me, I heard them talking about “hitting the wall.” I straightened up immediately and began to listen attentively, hoping to get some good tips on how to overcome my “wall”. To my surprise, they were not talking about their own dissertations; they were talking about running a marathon. After doing some research and reading a few articles on long distance running, I became convinced that I needed to run a marathon in order to overcome my writer’s block. In a marathon, most runners “hit the wall” around mile 20 but they learn to overcome it and finish the race at mile 26.2. -

255 9 Norms of war in Shia Islam Davood Feirahi In Islam, as in many other civilizations, religious texts/principles define and set human behaviour. Religion and religious ideas have great impor- tance in understanding the nature of war and military ethics in the Is- lamic world. If we define Islamic civilization through one of its major features, then we can say that it is a civilization based on religious juris- prudence (fiqh). As such, it is oriented around the Sharia, a comprehen- sive body of law that defines the values, rules and morality of Muslims in all areas of life (from birth to death), including war and military ethics. Jurisprudence in Islamic society is the science that defines the historical life of Muslims in relation to the religious texts, in any time or place. Ju- risprudence aims at creating harmony between religious commands and daily life within a given environment. In Islamic culture, religious text means the holy Qur’an and narrations from the Holy Prophet and the Infallible Imams in Shiism, all of which are closely interrelated. In Islamic terms, these are all referred to as Sunna (tradition). In other words, we may say that the Prophet’s sayings (Hadith) and the narrations of the Infallible Imams of Shiism (Akhbar) are all interpretations of the holy Qur’an. The duty of jurisprudence is to interpret issues related to social life, such as war and peace, on the basis of the Qur’an and tradition, and to derive religious rules and laws from them, whose observance is obliga- tory for all members of the community. -
