Manbeck Former Brooklyn Borough Historian Several years ago, while re- searching The Brooklyn Eagle files in the Brooklyn Public Li- brary, I met a man in his 70s working on a similar project. We talked about old Brooklyn and nostalgia on places we both knew. He was African-American, and our memories of identical John Manbeck places did not mesh. As a teen- Brooklyn Eagle file photo ager he had lived in what is now the Prospect Heights area, across the invisible racial segregation line of Empire Boulevard. His mother, a clerk in a respected law office, received a call from her boss that he needed papers delivered to a party on Ster- ling Street in Flatbush. Because she was preparing for a fami- ly celebration, she asked her son to do the errand. He boarded the Rogers Avenue trolley, which crossed Empire Boulevard and stopped at Sterling Street. Stepping off the trolley with his package firmly gripped, he walked around a parked green and white police patrol car. The two policemen stepped out of the car. “Hey, boy. What are you doing in this neighborhood?” He understood the unstated, that this was a “white” neighborhood. He explained. They demanded to look at the envelope. Re- turning it to him, they told him to continue to the brownstone address — and they followed him down the street in their car. Nervously, he studied the addresses on the street. When he ar- rived at the address, the policeman in the passenger side got out. “Hold it, boy.” He escorted the messenger, climbing the steps and rang the bell. When a man answered the door, the policeman asked, “Do you know this boy?” “No.” “But I have a package from my mother,” the teenager explained. “Oh, yes. We’ve been waiting for you. Thank you.” The police officer saluted but ig- nored eye contact with the youth as he descended to the street. The police were superior because they had uniforms and weapons. The young man was in an unfamiliar community and looked different. This technique was not an anomaly. Often the police charged a suspect with “mopery,” a spurious incrimina- tion. As a teacher and a historian, I am well aware of racial con- flicts in America. They have existed since slavery, a human con- dition arising out of conflict and a justification for superiority. Although laws after the Civil War pretended to equalize the rac- es and introduce equality, they did not. The ruling white class in the South lost the war but refused to lose its superiority. I see no reason to demand superiority if I am confident of my goals and reasoning. Most of my acquaintances of color have been students, colleagues and workers. I appreciate their selves, not their rivalry. I have found them to be generous, friendly and intelligent. In my youth, I traveled to Washington, D.C., and could not understand the need for segregated water fountains in Union Station. I learned art from a teacher colleague, coopera- tion from a fellow historian and compassion from my students. I am still proud of them. One of my black students appealed to me that he was being falsely accused of a criminal past by the dean of students. When I questioned the administrator, he cited a rap sheet that suppos- edly was confidential. In researching the source, I discovered it never existed, nor did the graffiti of which the student was accused. My childhood guardian was a product of the 19th century, a great-aunt who discriminated against Jews, Italians, Irish and so-called Negroes. One hot summer day when I was 4, a black man passing our home asked for a drink of water. When I went inside to ask my aunt, she grew furious and locked the door in the man’s face, explaining that black men could not be trusted. In spite of some prejudices, my mother trusted me as a pre- teen to be escorted by the black pastor of Brooklyn’s Concord Baptist Church on a long train ride to summer camp in Maine. Years later, her best friends were a black couple, Dr. and Mrs. Slade, who formed a classical concert group in their church. Solving the animosity of prejudice is simple. After living two years in Finland, we discovered similar stereotypical clichés applied to their native sub-culture, the gypsies: untrustworthi-

Tuesday, June 9, 2020 • SECOND DEPARTMENT/Brooklyn/Daily Eagle • 13 YOUTHFUL OFFENDER TREATMENT DENIED IN APPEAL OF RAPE CONVICTION Appellate Division, Second Department In the Appellate Division, Second Department, Gerdzer Edmee appealed from an order by Hon. Suzanne Mondo of Kings County Supreme Court, Criminal Term, which denied, without a hearing, his motion to vacate a judgment of the same court. Edmee’s case involves a carjacking that occurred shortly after midnight on July 30, 2005, perpetrated by him and several accomplices. The two occupants of the carjacked vehicle were robbed and the female occupant was repeatedly sexually assaulted. Edmee pleaded guilty to rape in the first degree, criminal sexual act in the first degree and robbery in the second degree in exchange for a promised sen­ tence of “at most 17­and­a­half years” of imprisonment. Because Edmee was 16 years old at the time of the offenses, Justice Mondo imposed a less than maximum sentence of two concurrent deter­ minate terms of imprisonment of 15 ½ years plus 5 years of post­ release supervision on the rape and criminal sexual act convictions, to run concurrently with 15 years’ imprisonment plus 5 years of post­release supervision on the robbery conviction. In 2017, Edmee moved to vacate the judgment of conviction on the ground that his counsel was ineffective for failing to request youthful of­ fender treatment and to set aside the sentence imposed on the ground that it was disproportionate to the sentences imposed upon two of his co­defendants. Edmee requested that the judg­ ment be vacated so that he could be considered for youthful of­ fender treatment. By order dated May 22, 2018, the Supreme Court denied his motion and, upon Edmee’s appeal, the justices of the Appellate Di­ vision, Second Department affirmed. The justices noted that this was Edmee’s second motion to vacate the judgment of conviction. They explained that, in the order appealed from, the Supreme Court noted that, in his prior motion, Edmee did not raise the same issues. Therefore, the court could deny the motion at its discretion. In this case, the justices agreed with the Supreme Court in exercis­ ing that discretion. Regardless, the justices explained that a youth who has been convicted of rape in the first degree or criminal sex­ ual act in the first degree is not eligible for youthful offender treat­ ment “except as provided in subdivision three,” which requires a judicial finding of mitigating circumstances or a finding that the de­ fendant’s participation was relatively minor. The justices found that Edmee committed a criminal sexual act in the first degree against the female victim, therefore, they concluded that his liability was not solely based upon an acting­in­concert theory. Further, the jus­ tices noted that the fact that Edmee had no prior criminal record was not a mitigating factor that bore directly upon the manner in which the crime was committed. The justices concluded that the failure to request youthful offender treatment did not constitute ineffective assistance of counsel because such a request would have been futile. —People v. At a nonjury trial, Hussain’s attorney described him as a “classic batterer” who “had hit his wife during at least 15 or 16 years.” Trial counsel further conceded that “by hitting his wife a number of times in her head and over her body, Hussain had either recklessly caused her death or had intentionally caused serious physical injury that resulted in her death. Since Hussain’s claim implicated his relationship with his trial attorney and is proved, if at all, by facts outside of the trial record, the justices of the Appellate Division, Second Depart­ ment declined to review it. Similarly, the justices explained that Hussain’s contention that he was deprived of effective counsel is based on matters appearing on the record and matters outside of the record and, as such, could not be reviewed in its entirety so they declined to review the claim on Hussain’s direct appeal. —People v.
