    THE MAJORITARIAN DIFFICULTY AND THEORIES OF CONSTITUTIONAL DECISION MAKING Michael C. Dorf* Recent scholarship in political science and law challenges the view that judicial review in the United States poses what Alexander Bickel famously called the “counter-majoritarian difficulty.” Although courts do regularly invalidate state and federal action on constitutional grounds, they rarely depart substantially from the median of public opinion. When they do so depart, if public opinion does not eventually come in line with the judicial view, constitutional amendment, changes in judicial personnel, and/or changes in judicial doctrine typically bring judicial understandings closer to public opinion. But if the modesty of courts dissolves Bickel’s worry, it raises a distinct one: Are courts that roughly follow public opinion capable of protecting minority rights against majoritarian excesses? Do American courts, in other words, have a “majoritarian difficulty?” This Article examines that question from an interpretive perspective. It asks whether there is a normatively attractive account of the practice of judicial review that takes account of the Court’s inability to act in a strongly counter-majoritarian fashion. After highlighting difficulties with three of the leading approaches to constitutional interpretation— representation-reinforcement, originalism, and living constitutionalism—the Essay concludes that accounts of the Court as a kind of third legislative chamber fit best with its majoritarian bias. However, such third-legislative-chamber accounts rest on libertarian premises that lack universal appeal. They also lack prescriptive force, although this may be a strength: Subordinating an interpretive theory—such as representation-reinforcement, originalism, or living constitutionalism—to a view of judicial review as a form of third-legislative-chamber veto can ease the otherwise unrealistic demands for counter-majoritarianism that interpretive theories face.

Kronmant INTRODUCTION Six years after Alexander Bickel's death, John Hart Ely described his former teacher and colleague as "probably the most creative constitutional theorist of the past twenty years."" Many today would concur in Ely's judgment.' Indeed, among his academic peers, Bickel is widely -regarded with a measure of respect that borders on reverence. There is, however, something puzzling about Bickel's reputation, for despite the high regard in which his work is held, Bickel has few contemporary followers.' There is, today, no Bickelian school of constitutional theory, no group of scholars working to elaborate Bickel's main ideas or even to defend them, no con- tinuing and connected body of legal writing in the intellectual tradition to which Bickel claimed allegiance. In fact, just the opposite is true. Yani Allah Resulü (s.a.v.) ve sahabeden intikal eden manaya bağlı kalmak Büyük Doğu’nun esasını teşkil eder. İlkeleri Büyük Doğu’nun mazrufunda pazarlıksız iman, tefekkür, amel ve dava şuuru vardır. Orada “iman” her şeyden öndedir. Mümin, tefekkürden önce “Ne getirdin, götürdün bildirdinse amenna” deme bahtiyarlığına erer. Tefekkür, iman ettikten sonra başlar ve Allah’ın zatı dışında her şeyi kapsamı içerisine alır. Amel imandan sonra gelir ve “salih” olabilmesi için de İslam’ın belirlediği esaslar çerçevesinde kıymetlendirilir. Bütün bunların neticesinde müminde gözünü kırpmadan her şeyini feda edebilecek bir dava ruhu tezahür eder. Sahabe imanla başlayıp dava şuuru ile kemale eren meratibi en güzel şekilde ortaya koyan insanlık tarihinin en muazzez kuşağıdır.

Allah Azze ve Celle buyuruyor ki; “Siz Rabbiniz tarafından vahyedilene uyun, O’ndan başka dostlar aramayın.”(A’raf 3) “Bir şeyde ihtilafa düşerseniz, eğer Allah’a ve ahiret gününe iman ediyorsanız onu Allah’a (Kitabına) ve Rasulüne (sünnetine) döndürün”(Nisa 59) Maalesef Rasulullah sallallahu aleyhi ve sellem’in en çok sakındırdığı şeylerden olan bidatler hayat tarzı haline gelmiştir.

    The Migration of Literary Ideas: The Problem of Romanian Symbolism Cosmina Andreea Roșu ABSTRACT: The migration of symbolists’ ideas in Romanian literary field during the 1900’s occurs mostly due to poets. One of the symbolist poets influenced by the French literature (the core of the Symbolism) and its representatives is Dimitrie Anghel. He manages symbols throughout his entire writings, both in poetry and in prose, as a masterpiece. His vivid imagination and fantasy reinterpret symbols from a specific Romanian point of view. His approach of symbolist ideas emerges from his translations from the French authors but also from his original writings, since he creates a new attempt to penetrate another sequence of the consciousness. Dimitrie Anghel learns the new poetics during his years long staying in France. KEY WORDS: writing, ideas, prose poem, symbol, fantasy. A t the beginning of the twentieth century the Romanian literature was dominated by Eminescu and his epigones, and there were visible effects of Al. Macedonski’s efforts to impose a new poetry when Dimitrie Anghel left to Paris. Nicolae Iorga was trying to initiate a new nationalist movement, and D.
