It is a corollary of the right to freedom of expression, as guaranteed by European national constitutions, as well as by theConvention for the protection of human rights and fundamental freedoms (art. 10) and by the Charter of fundamental rights of the European Union (art. 11). Ensuring a plural media environment is a precondition for democracy and may be seen as a policy goal. The availability and accessibility of diverse information and views create the conditions for citizens to form and express their opinions and participate in the democratic debate in an informed way. Due to technological developments and the rapid rise of digital platforms intermediating online content, the concept of media pluralism has been reinterpreted at both academic and policy level, taking into account the recent structural changes in the media sector. The Media pluralism monitor is a methodology to assess the risks to media pluralism, based on a set of 20 indicators covering a broad definition of media pluralism and, therefore, having a holistic perspective. -

INTRODUCTION Self-censorship refers to the decision by an individual or group to refrain from speaking and to the decision by a media organization to refrain from publishing information. Whenever an individual or group or the media engages in self-censorship, the values of the First Amendment are compromised, because the public is denied information or ideas.' It should not be sur- prising, therefore, that the principles, doctrines, and precedents of what I refer to as "the law of the First Amendment"' are designed to prevent self-censorship premised on fear of govern- mental sanctions against expression. This fear-induced self-cen- sorship will here be called "self-censorship bad." At the same time, the First Amendment also values and pro- tects a right to silence. -

INSS includes the Center for Strategic Research, Center for Complex Operations, Center for the Study of Chinese Military Affairs, Center for Technology and National Security Policy, Center for Transatlantic Security Studies, and Conflict Records Research Center. The military and civilian analysts and staff who comprise INSS and its subcomponents execute their mission by conducting research and analysis, publishing, and participating in conferences, policy support, and outreach. Taming the Trolls: The Need for an International Legal Framework to Regulate State Use of Disinformation on Social Media * ASHLEY C. NICOLAS INTRODUCTION Consider a hypothetical scenario in which hundreds of agents of the Russian GRU arrive in the United States months prior to a presidential election.1 The Russian agents spend the weeks leading up to the election going door to door in vulnerable communities, spreading false stories intended to manipulate the population into electing a candidate with policies favorable to Russian positions. The agents set up television stations, use radio broadcasts, and usurp the resources of local newspapers to expand their reach and propagate falsehoods. The presence of GRU agents on U.S. soil is an incursion into territorial integrity⎯a clear invasion of sovereignty.2 At every step, Russia would be required to expend tremendous resources, overcome traditional media barriers, and risk exposure, making this hypothetical grossly unrealistic. Compare the hypothetical with the actual actions of the Russians during the 2016 U.S. presidential election. Sitting behind computers in St. Petersburg, without ever setting foot in the United States, Russian agents were able to manipulate the U.S. population in the most sacred of domestic affairs⎯an election. PERSUADE OR PERISH Addressing Gaps in the U.S. Posture to Confront Propaganda and Disinformation Threats Dr. Haroro J. Ingram Program on Extremism Policy Paper February 2020 PERSUADE OR PERISH 1 INGRAM | PROGRAM ON EXTREMISM Abstract: The purpose of this policy paper is to assess the U.S. government’s posture to deal with malicious ‘influence activities’ (i.e. propaganda and disinformation) by state and nonstate actors. It argues that while the U.S. government has provided inconsistent support for its foreign policy and national security information sector for decades, since 2017 an effort has been made to lay the foundations for a rejuvenated U.S. posture to address propaganda and disinformation threats. However, significant gaps remain that will weaken those foundation building efforts if left unaddressed. This paper concludes with four recommendations focusing on (i.) the need to learn lessons from the institutions’ history, (ii.) the value of an overarching paradigm through which to understand a spectrum of threats, (iii.) the important role of overt attributed U.S government messaging, and (iv.) initiatives to strategically cohere interagency activities. The United States and its allies are facing a complex spectrum of propaganda and disinformation threats that are rapidly evolving strategically, operationally, and technologically. 1 The U.S. government’s ability to address these malicious ‘influence activities’ will depend on its adoption of an appropriately balanced, resourced, and legislatively empowered posture that will be as much a product of institutional history as contemporary strategic-policy decisions. This policy paper assesses the U.S. government’s posture to deal with these threats and outlines ways in which strategic-policy gaps, drawn from this analysis, can be tackled. -

Opposition to the policies of the Trump administration, from the travel ban to sanctuary cities and the rollback of environmental protections, has led progressives to explore more fluid and contingent forms of state identity. Conservatives too have sought to shift federalism away from the jurisdictional focus on limited and enumerated powers and have argued for a revival of the political safeguards of federalism, including state-based identities. This Article draws on comparative law to study identity as a political safeguard of federalism and its transformation from constitutional discourse to interpretative processes and, eventually, constitutional doctrine. The experience of the European Union, where identity federalism also benefits from a textual anchor, reveals some of the complexities of this process. -

THE NEW EUROPEAN PARLIAMENT KEY COMMITTEE COMPOSITION 31 JULY 2019 INTRODUCTION After several marathon sessions, the European Council agreed on the line-up for the EU “top jobs” on 2 July 2019. The deal, which notably saw German Defence Minister Ursula von der Leyen (CDU, EPP) surprisingly designated as the next European Commission (EC) President, meant that the European Parliament (EP) could proceed with the election of its own leadership on 3 July. The EPP and Renew Europe (formerly ALDE) groups, in line with the agreement, did not present candidates for the EP President. As such, the vote pitted the S&D’s David-Maria Sassoli (IT) against two former Spitzenkandidaten – Ska Keller (DE) of the Greens and Jan Zahradil (CZ) of the ACRE/ECR, alongside placeholder candidate Sira Rego (ES) of GUE. Sassoli was elected President for the first half of the 2019 – 2024 mandate, while the EPP (presumably EPP Spitzenkandidat Manfred Weber) would take the reins from January 2022. The vote was largely seen as a formality and a demonstration of the three largest Groups’ capacity to govern. However, Zahradil received almost 100 votes (more than the total votes of the ECR group), and Keller received almost twice as many votes as there are Greens/EFA MEPs. This forced a second round in which Sassoli was narrowly elected with just 11 more than the necessary simple majority. Close to 12% of MEPs did not cast a ballot. MEPs also elected 14 Vice-Presidents (VPs): Mairead McGuinness (EPP, IE), Pedro Silva Pereira (S&D, PT), Rainer Wieland (EPP, DE), Katarina Barley (S&D, DE), Othmar Karas (EPP, AT), Ewa Kopacz (EPP, PL), Klara Dobrev (S&D, HU), Dita Charanzová (RE, CZ), Nicola Beer (RE, DE), Lívia Járóka (EPP, HU) and Heidi Hautala (Greens/EFA, FI) were elected in the first ballot, while Marcel Kolaja (Greens/EFA, CZ), Dimitrios Papadimoulis (GUE/NGL, EL) and Fabio Massimo Castaldo (NI, IT) needed the second round.
