Cornell University 2012 Under what conditions does the rule of law, especially with regards to the constraining of executive power, become institutionalized in newly liberalized countries where presidential authority has historically been greatly unchecked? This dissertation explores this puzzle by exploring two inter-related questions: first, why would a longtime ruling party acquiesce to institutional constraints being placed on the executive in the first place, and second, once implemented, why are these institutional rules able to successfully constrain leaders in some sub-Saharan states but not others? To address both questions, my dissertation investigates variation in the adoption of, and later adherence to, executive term limit laws and other constraints on presidential power across Africa. Based on both a medium-n quantitative analysis and extensive qualitative interview and archival data collected during eleven months of fieldwork in Uganda and Zambia, I construct an explanation that challenges previous assumptions about the development of constitutionalism in liberalizing countries. I argue that, due to the rarity of divided governments across sub-Saharan Africa, members of parliament from the ruling party ultimately choose whether or not to restrain executive tenure based on their perceptions of their party’s (and, therefore, their own) electoral competitiveness. -

In October, President Alassane Ouattara— leader of the Rally of the Republicans (RDR) party—won a second and final term in a landslide victory. Although the lead-up to the vote was marred by sporadic arrests of opposition supporters and dispersal of their rallies, the election was ultimately largely peaceful and found to be credible by domestic and international observers. Former president Laurent Gbagbo’s Ivorian Popular Front (FPI) party remains deeply divided, and its hardliners boycotted the election. Longstanding concerns about victor’s justice and reconciliation persist. The Dialogue, Truth and Reconciliation Commission (CDVR), established in 2011, delivered its final report to Ouattara in December 2014, but the report had not yet been made public as of the end of 2015. The Ivorian government refused to transfer Simone Gbagbo, Laurent Gbagbo’s wife, to the International Criminal Court (ICC), where she faces four counts of crimes against humanity. She was instead prosecuted in Côte d’Ivoire for crimes against the state, receiving a 20-year prison sentence in March 2015. Meanwhile, the ICC moved forward with a joint case against Laurent Gbagbo and Charles Blé Goudé, a former youth minister and leader of a pro-Gbagbo militia; that trial is scheduled to begin in early 2016. -

Nicolas Cook Specialist in African Affairs Foreign Affairs, Defense and Trade Division Summary A stalled, fragile peace process in Côte d'Ivoire (“Ivory Coast”), split between north and south since a 2002 rebellion, is unraveling, and the threat of renewed civil war looms in the West African nation. This report provides an overview of the ongoing political/economic crisis in Côte d’Ivoire. It draws on news sources, private sector analyses, and data collections and information, both written and oral, from the U.S. and foreign governments, and from multilateral entities. It will be updated as events warrant. Recent Events. In late September 2004, Côte d'Ivoire’s parliament ended a special session without passing key legal reforms required under a July 2004 peace roadmap (Accra III), which laid out an agenda for implementing a January 2003 political- military accord, the Linas-Marcoussis Agreement (discussed below). In mid-October 2004, the northern rebel side, the New Forces (FN in French, used in some acronyms below) refused to disarm, as planned under Accra III, until the reforms are passed. President Laurent Gbagbo (bag-bo), however, restating a long-held position, said he would reconsider the reforms only if the FN begins to disarm. In late October, political tensions rose. Mobs attacked the opposition press, volatile rhetoric and street protests by anti-FN militants increased, and the FN recalled its ministerial delegation from Côte d'Ivoire’s interim government of national reconciliation. -

Authoritarian Regime Types, Political and Socio-Economic Outcomes, and Democratic Survival Huang-Ting Yan A thesis submitted for the degree of Doctor of Philosophy Department of Government University of Essex Year of Award: 2020 1 Summary This dissertation addresses the question of which factors shape outcomes in autocratic regimes, and, in turn, what influences the survival of democratic regimes in light of their authoritarian legacies. I argue that regimes which are able to curtail the dictator’s powers, compared to uncontested autocracies, are associated with better institutional and socio-economic outcomes during the authoritarian rule as well as a higher survival rate upon transition to democracy. The first two papers of this dissertation provide evidence that regimes where the leader’s power is constrained either by an organised opposition or by a strong regime party are more likely to have an independent judiciary and experience higher levels of health expenditure. A third paper provides evidence that the mechanisms which protect contested autocracies also lay the foundation for an institutional framework in which the subsequent democratic regimes are more likely to survive. This dissertation offers a mixed-methods approach to confirm the three arguments. In conclusion, only with checks and balances in place, those in power can stay humble, take care of people, and promote good governance, compared to the ruler with unlimited power. 2 1. INTRODUCTION This dissertation addresses the question of which factors shape outcomes in autocratic regimes, which, in turn, influence the survival of democratic regimes in light of their authoritarian legacies. To explain the difference in the lifespan of young democracies, scholars have compiled a list of causal factors and their mechanisms that affect these democracies. -

Côte d’Ivoire Post-Gbagbo: Crisis Recovery Nicolas Cook Specialist in African Affairs April 20, 2011 Congressional Research Service 7-5700 www.crs.gov RS21989 CRS Report for Congress Prepared for Members and Committees of Congress Cote d'Ivoire’s Post-Election Crisis Summary Côte d’Ivoire is emerging from a severe political crisis that followed a disputed November 28, 2010, presidential runoff election between former president Laurent Gbagbo and his, former Prime Minister Alassane Ouattara. Both claimed electoral victory and formed opposing governments. Their rivalry spurred a full-scale civil military conflict in early March 2011, after months of growing political violence. The main conflict died down days after Gbagbo’s arrest by pro-Ouattara forces, aided by United Nations (U.N.) and French peacekeepers, but limited residual fighting was continuing to occur as of April 20. The election was designed to cap an often forestalled peace process defined by the 2007 Ouagadougou Political Agreement, the most recent in a series of partially implemented peace accords aimed at reunifying the country, which was divided between a government-controlled southern region and a rebel-controlled northern zone after a brief civil war in 2002. Ouattara based his victory claim on the U.N.-certified runoff results announced by the Ivoirian Independent Electoral Commission (IEC). These indicated that he had won the election with a 54.1% vote share, against 45.9% for Gbagbo. The international community, including the United States, endorsed the IEC-announced poll results as legitimate and demanded that Gbagbo cede the presidency to Ouattara. Gbagbo, rejecting the IEC decision, appealed it to the Ivoirian Constitutional Council, which reviewed and annulled it and proclaimed Gbagbo president, with 51.5% of votes against 48.6% for Ouattara.
