145/19 APPROVAL OF THE MINUTES OF THE MEETING HELD ON THE ON THE 26TH SEPTEMBER 2019 The minutes of the meeting held on the 26th September 2019 were approved by the Council and signed as a correct record by the Chairman.

146/19 UPDATE FROM CDC REPRESENTATIVE CDC Representative Counc. A Brown informed the Parish Council that he had £1000.00 from the CDC Ward Member Grant to share between Parish Councils and that NYCC & CDC Counc. P Mulligan had the same plus £4,000 from NYCC to be split between 12 Parishes. He said that CDC is now trying to enforce lane end collections for the bins which will mainly affect agricultural lanes or back lanes. The residents of these properties will need to take the bins to the end of the lane, but help will be available for the elderly or disabled. CDC is holding an extraordinary meeting of the council on November 12th to endorse the Local Plan. Counc A Brown thinks there are still some issues with it but it needs to go through. CDC is working on climate change issues and the Scrutiny Committee has been asked to consider what can be done to help with climate change. They are also working with other groups to address climate change.

147/19 HIGHWAYS Speeding Concerns Main Street & Community Speedwatch. Clerk to contact Police Community Speed Watch to ask them how far they have got and ask for any progress. Shelley Well The Highways Engineer from NYCC has advised it is more likely thatnthe spring is blocked on private land and that the County Council has not carried out any work that would affect the flow of water to the trough. Counc. M Scarffe to ask the landowner if we can dig up on the roadside to investigate regarding the well. Road Subsidence in Mary Street & Newby Road. Clerk to ask for a response from NYCC regarding the drains and inform them that pedestrians are getting wet walking under the culvert from water which is spouting out from the wall and could be connected with the collapsed drains. Footpath at the side of the Play Area Clerk has been in touch with Land Registry and they say the cobbled path up the side of the Play Area is not registered to anybody. As the path continues in front of the houses this part of the path is owned by the houses and as the path continues up to Bright Street this part is again not registered to anyone. Clerk to contact CDC and say that we believe the cobbled path is owned by them and that it is creating a slip hazard. Definitive Map Modification Order (Application to add a public footpath FP18 to Hanover Street , Farnhill) NYCC has on file an application to record a public footpath commencing at the existing footpath no 18 and running to Hanover Street, Farnhill which dates back to 1996 and has yet to be resolved. The Authority has to be satisfied that it is reasonably alleged that the path subsists before it can make a legal order and the evidence provided does not meet the required standard to enable the County Council to make such a Modification Order and therefore the application is rejected. We are entitled to appeal to the Secretary of State if we disagree with the decision taken and the appeal must be made within 28days of the letter. Clerk to write to them and say that we do wish to appeal.

Page 342 Obstruction of Pavement at Mary Street Clerk has written to the residents regarding obstruction of the pavement at Mary Street and the situation has now improved. The Parish Council will monitor the progress. Footpath Sign for the Arbour Clerk is still awaiting response for a quote for a footpath sign for the Arbour. Electric Charging Points The Parish Council have had an enquiry to see if there are any plans to make charging points available for residents in Farnhill who have no off street parking and how soon charging points could be available. Clerk to respond by saying that we understand the request in principle and may consider charging points in the future, but will wait to be guided by CDC.

148/19 PLANNING Decision Notice a. Application No: 2019/20789/MMA Proposal: Minor material amendment to original planning consent referenced 2018/19003/FUL for formation of decking area and boundary screen fencing to North West elevation. Location: Methodist Church, Main Street, Farnhill, Keighley, BD20 9BJ CDC Grants Planning Permission for the development described above

c. Craven District Council’s Policy for Trees The Parish Council to ask CDC if they have a policy for tree work but decided to defer till later till other planning issues have been dealt with.

d. Planning Issues at CDC Kildwick Parish Meeting and Farnhill Parish Council have received a response from CDC on behalf of Mr Shevlin regarding a lack of confidence in the Local Planning Authority and concerns about inconsistency and a lack of clarity concerning delegated authority. A meeting was held between Mr Midgley, Counc’s D Atkinson & M Scarffe to further discuss the matter and to prepare a draft response to their letter. The draft letter was presented to the Council which was then approved and it was agreed that the Council should send it.

149/19 HEALTH & SAFETY & RISK ASSESSMENT (Land Ownership) Clerk to get any documents from the last 2 years together to take to the meeting next month.

150/19 FINANCE & ACCOUNTS The following accounts were approved for payment by the Council. R Bramley (Petrol for Lawnmower) £ 7.70 ROSPA Play Safety (Annual Inspection) £86.40

151/19 CLERKS SALARY Held over till the next meeting. Clerk to provide the recommended pay scales for the next meeting and provide the hours worked.

152/19 GRAFFITI AT THE PINNACLE. The Parish Council agreed that to get rid of the graffiti the pinnacle will have to be re-rendered. Counc D Akrigg will have a word with a Contractor from Cononley to ask them for a quote and the Parish Council will then consider applying for some funding through the Ward Member Grants.

153/19 LIGHT POLLUTION FROM FARNHILL HALL Counc S Wood dropped off a note with his contact details to the residents of Farnhill Hall regarding the light pollution but has to date not had any response.

154/19 SEAT AT MILKING HILL BRIDGE Counc S Wood has fitted the brackets to secure the seat to the ground at Milking Hill Bridge.

155/19 ONGOING DEVELOPMENT OF THE ARBOUR. Clerk to ask the residents of Craglands to go ahead and make the repairs to the track which was damaged by contractors carrying out works at their property. The Parish Council agreed to fill in the sides of the track and the Parish Council to provide up to £200.00 for the cost of materials and the residents to carry out the work.

156/19 PARISH COUNCIL WEBSITE & ACCESSIBILITY STATEMENT Minutes and agendas have been added to the website. Clerk to look into information about Accessibility Statements. Page 343 157/19 PLAY AREA The Annual Inspection has been carried out by ROSPA and the overall risk was low, but the Parish Council are not happy with how the inspection has been carried out. There was no mention of the risk associated with the grounds. Counc. S Wood to take a look at the report and see if he identifies any areas of concern. Clerk to write to CDC stating that there has been no response from Planning regarding our construction concerns about the works at 13 South View. All construction work carries risks and the level of risk will be appreciably higher when dealing with the potential hazards surrounding this site. The boundary wall abutting the car park and play area will come under the Party W all Act and you should have been advised of the proposed work and associated risks. Clerk to attach photograph which was sent to the Parish Council and to Planning by a local resident which illustrates the concern over unprotected work above the Play Area. Also to inform CDC that due to the concerns over safety the Parish Council will be closing the Play Area till further notice. Clerk to write to the Health & Safety Executive regarding the concerns of work being carried out above the playground with no provision for safety.
