s the controversy heats up surrounding France’s poli- Acy of deporting Roma living in illegal encampments, drawing harsh criticism from the European Union, local experts say that EU funding in Romania is not enough to help Roma find jobs and integrate in their home countries. “I wasn’t interested in going abroad to work as my family is in Romania and I have to feed them,” says Costel Apostol, 43, who is one of the approximately 45 people who found employment last year with the help of an EU-funded pro- gramme for Roma people. But Apostol, who was trained to work as a mason, is now jobless as EU newcomer Romania continues to feel the effects of the global eco- nomic crisis. “I wanted to prove that we, Roma people, can work hard too. But after six months working on a construction site I was told that I had been dismissed as there was no money for wages,” Apostol explains. He now lives in a small apart- ment in an old four-storey building in one of the suburbs of Bucharest, where the neighbour- hood features a few warehouses, a couple of dubious pubs, one small park which looks more grey than green and many stray dogs who scour the heaps of garbage. Costel Apostol’s situation is not unique, some experts say, as most of the programmes aiming to improve the plight of Romania’s Gypsy/Roma people in Romania have ended without clear results. We faced some skepticism of sponsors as well since an earlier concert of Ramazzoti, organised by some private organisers, failed – and it’s difficult to fundraise in the country for cultural events of an alternative kind like comic exhibitions or concerts of trip-hop icons like Morcheeba. During July and August, BIRN monitors attended 246 hearings. Of these, just 48.8 per cent were posted on the court’s notice board in advance, while 51.2 per cent were not post- ed. Of these, 8.8 per cent of the hearings start- ed late because of the absence or the lateness of a judge, 10 per cent because of the absence or the lateness of the public prosecutor. The absence or delay to the parties accounted for 8.8 per cent of late starts and another 8.8 per cent because of the delay or absence of other participants. Just under half, 48.8 per cent, of the moni- tored hearings were held in the courtrooms, while 51.2 per cent were held in judge’s offices. Of the monitored hearings, 98.8 per cent of the trial panels were composed according to the rules set out by the law and procedures, while 1.2 per cent were not. In 58.2 per cent of the hearings, compulso- ry work uniforms were not worn, while in 41.2 per cent the uniforms were worn by the trial panel and in 0.6 per cent they were worn by the prosecutor. Audiovisual recording took place in just 0.6 per cent of hearings. Statements were properly taken from the parties in 97.6 per cent of the cases. In 98 per cent of the hearings, the parties were treated equally, while in 2 per cent they were not. Lay judges were active in 5.3 per cent of the monitored hearings, not active in 13 per cent, while there were no lay judges in 81.7 per cent.
