SUNSET REVIEW OF THE ANTI-DUMPING DUTIES ON PICKS, SHOVELS AND SPADES, RAKES AND FORKS ORIGINATING IN OR IMPORTED FROM THE PEOPLE'S REPUBLIC OF CHINA (PRC): FINAL DETERMINATION

In accordance with the provisions in Artide 11.3 of the World Trade Organisation Agreement on Implementation of Artide VI of the General Agreement on Tariffs and Trade, any definitive anti-dumping duty shall be terminated on a date not laterthan five years from its imposition, unless the authorities determine, in a review initiated before that date, on their own initiative or upon a dUly substantiated request made by or on behalf of the domestic industry within a reasonable period of time prior to that date, that the expiry of the dUty would likely lead to continuation or recurrence of dumping and injury.

On 26 May 2006 the International Trade Administration Commission of South Africa (the Commission) notified the interested parties through Notice No. 673 of 2006 in Government Gazette No. 28847, that unless a substantiated request is made indicating that the expiry of the anti-dumping duties against imports of picks,shovels, spades,rakes and forks (hand tools) originating in or imported from the People's Republic of China (PRC) would likely lead to the continuation orrecurrence of dumping and injury, the anti­ dumping duties on hand tools originating in or imported from the PRC will expire on 8 March 2007.

The investigation was initiated through Notice No. 245 in Government Gazette No. 29688 on 7 March 2007. The investigation was initiated after the Commission STAATSKOERANT, 2 NOVEMBER 2007 No.30413 15 considered that there was prima facie proofthat expiry ofthe duties would likely lead to the continuation or recurrence of dumping of the subject product originating in or imported from the PRC and that there was prima facie proof of the likely continuation and/or recurrence of material injury.

Afterconsidering all parties' comments and representations in respect ofthe "essential facts" letters, the Commission made a final determination that the expiry ofthe duties is likely to lead to the continuation or recurrence of dumping of the subject product originating in or imported from the PRC and that the expiry of the duties is likely to lead to the continuation or recurrence of material injury.

The Commission, therefore, recommended to the Ministerof Trade and Industry that the anti-dumping duties on picks, shovels and spades, rakes, and forks originating in or imported from the PRC, be m~lintained.

The Commission's detailed reasons for its decision are set out in Commission Report NO.251 (Final report).

Proiect title SIM 060602: An Investigation of digital chest radiography the SOUTH AFRICAN MINING INDUSTRY • Phase 1: To test reproducibility of digital chest x-ray against analogue for detection silicosis and pulmonary TB. • Phase 2: To develop Standards

Motivation With the increasing switch from analogue (film-screen) to digital radiography in the occupational health setting, there is a need to establish the reproducibility (reliability) of digital for film radiographs for the common occupational diseases. In the mining industry, these are pneumoconiosis and pulmonary tuberculosis.

Statement: The South African mining industry has over many decades been using conventional analogue chest x­ rays for medical surveillance of occupational lung disease until recently when some of the large mines moved to using digital x-rays. Digital x-rays are considered by many to improve diagnosis and improvement in efficiencies by streamlining workflow for technologists, radiologists and others. Literature review indicate that most experts and end users agree that it is only a matter of time before digital radiography imaging completely replaces films due to the former's perceived advantages of digital image processing, electronic archiving, tele-radiography and the potential for optimisation of image acquisition and display independently 1. Another study concluded that Flat Panel Detector (FPD) showed image quality and agreement as that of Analogue chest Radiography (AR) with regards to small profusion categories assuring SUitability in pneumoconiosis screening, but Storage Phosphor Computed Radiography (SR) had significantly less profusion than FOP or Analogue Chest Radiography and optimal imaging parameters for pneumoconioses screening needed aqreement ." Franzblau et at study (2007, unpublished final report) established the reproducibility of digital radiography in respect of pneumoconiosis. Phrased differently, the study that there were few significant differences in the reliability of image classifications across formats, and these differences were solely among classifications of image quality i.e. the consistency with which readers interpret CR is approximately the same as with which they interpret hard and soft copies, These authors also concluded in their study that Large Opacities: All image formats differed significantly with High resolution computed tomography C>Film Screen Radiology CR>Soft Copy digital fillms. The gap identified in these studies is that the study population does not have the high Pulmonary TB, which in itself may change these findings. The influence of varying the numerical processing algorithm used for digital radiography on reproducibility with respect to any of the above diseases was also not looked at. Primary outputs • PHASE 1: 1. Estimates of the reproducibility of digital versus conventional film radiographs with respect to detection, diagnosis and description of pulmonary tuberculosis in South African miners. 2. Estimates of the reproducibility of digital versus conventional film radiographs with respect to detection and description of silicosis in the South African miners. This would be useful because of the frequent co-occurrence of silicosis and tuberculosis in South Africa 3. Assessment of the influence of varying the numerical processing algorithm for digital radiography on the detection of pulmonary tuberculosis and silicosis in South African miners. 4. A set of digital and conventional radiograph pairs read by expert readers which could serve as a seed pool of standard digital radiographs for a future standardization project. PHASE 1 WILL BE USEDLATER IN SCOPING THE DEVELOPMENT OF SOUTH AFRICAN MNING INDUSTRY DIGITAL STANDARDS

Scope The scope includes amongst other the design of study by epidemiologists and statisticians familiar with the occupational lung diseases, reading methodology and analytic techniques for reproducibility analysis, collection of sufficient digital-conventional film pairs from active and former gold-miners covering the required spectrum of disease for silicosis and pulmonary tuberculosis, as well as a selected range of numerical processing algorithms settings, reading by an international pool of expert readers for pneumoconiosis and tuberculosis recruited by principal investigators, statistical analysis and final write by principal investigators.

Tender requirement: An organisation with proven project management and IT experience track record with teams that include for an example management and coordination of radiograph collection and quality control. Transportation of radiographs amongst readers and storage of radiographs. Putting up a team of special skills team as identified under academic setting below as well as methodology to achieve the primary outputs

Invitation to submit project proposals

SIMRAC, a permanent committee of the Mine Health and Safety Council, was established in terms of the Mine Health and Safety Act (29/1996) to conduct research and surveys regarding, and for the promotion of, health and safety in the South African mining industry. Suitably qualified agencies and/or persons are invited to submit proposals in response to the project specifications in this Notice. In soliciting research projects for the 2008/2009 research programme, the Council has the folloWing goals:

• to indicate the current research needs for research to commence in the 2008/2009 cycle; • to invite research proposals in response to these defined priority areas of research; and • to invite applications for postgraduate fundingO for research which will promote health and safety within the South African mining industry.

A consultative process has resulted in the Council formulating a co-ordinated, long-term health and safety research programme and identifying priority areas for research to commence in the 2008/2009 cycle. Researchers and agencies are invited to submit research proposals for the research projects indicated. Proposed research must be well designed with a detailed methods section, be ethical and must have the potential to add to existing knowledge, practice or technology, involve the end users and implementltransfer outputs. Research teams must have the specified skills.

5. Two copies of each proposal, in a sealed envelope, in a form suitable for photocopying plus a disk or CD with the proposal in MS Word, should be deposited in the repository labeled "Proposals" at the Council's offlces".

6. The Council may at its sole discretion, decide to recommend the acceptance, rejection or amendment of any proposal and tc commission the team to develop the proposal on the basis of which the contract is awarded. The Council shall not furnish any reasons for its decisions regarding proposals.

7. Every proposal accepted by the Council would be subject to a set of Terms and Conditions, which on acceptance of the final detailed proposal will form part of the contract applicable to the project. All prospective proposers should peruse a set of the standard terms and conditions prior to submitting a proposal. 8. Charge-out rates have to be in accordance with the rates specified by the Science Council, ACSA and SACNAPS

9. Preference will be given to proposals that composes of a project team with HOI's.

10. In compiling proposals, prospective proposers should provide details of methods, identifiable outputs and estimated costs as indicated.

11. The Council will endeavour to solicit the services of South African organisations to undertake projects, but will consider proposals from overseas-based organisations if expertise, cost considerations and local capacity building components compare favourably.

12. The Council requires full disclosure regarding all subcontracts included in the proposal.

13. The proposer and any of its affiliates shall be disqualified from providing other goods', works, or services under the project if, in the Council's judgment, such activities constitute a conflict of interest with the services provided under the assignmenUproject. . , 14. Where an output includes a device, mechanism, procedure, or system capable of being applied in the mining environment, a prospective proposer shall include in the proposal an output which suggests how the outputs in question might best be applied in practice. In drafting proposals, all prospective proposers should bear in mind the potential for technology transfer and phasing the project as indicated.

15. The period for which the proposals should be held valid is 150 days.

16. During this period the proposal must undertake to maintain, without change, the proposed key staff, and must hold to both the rates and total price proposed; in case of extension of the proposal validity period, it is the right of the proposer not to maintain their proposal

17. The anticipated commencement date of the projects is 1 April 2008.

Each successful proposer may, during the contract period or shortly after its completion, be required to provide: o A competent spokesperson with appropriate materials to make not more than two separate presentations, on an annual basisfor the duration of the project, and . 0 A technical paper on the project for publication and/or a poster presentation, without additional remuneration or reimbursement of costs. These activities must be detailed and costed within the project.

14. Where relevant, proposers may obtain copies of earlier project reports and other information from the website address or from contacts listed (See paragraph 1 and 2).

15. Proposers are advised that ali Council projects should be submitted to language editing and may be subjected to technical and financial audits. Funding for editing and audits should be included in the proposal budget.

16. Proposers should substantiate and cost separately, all proposed travel outside the borders of South Africa in connection with the project, and provide details of all expenses such as travelling and subsistence.

17. All proposed project costs must be expressed in South African Rands and the total price must be VAT inclusive. Fluctuations in the exchange rate and purchase of forward cover should be considered when costing the proposal.

18. The Council will take all reasonable steps to ensure that confidentiality of proposals is maintained during the adjudication process. If a proposal is not accepted within the programme, the Council may invite additional proposals on the topic.

19. No unsolicited proposals will be included in the programme for 2008/9.

The criteria by which proposals will be evaluated include: • Added value and impact - the Council supports research which can contribute significantly to the improvement in the health and safety of South African miners; • Value for money - the Council supports cost-effective research; • Innovation - the Council welcomes new approaches or new areas of focus for research leading to technologies or best practices to improve health and safety; • Excellence - the Council demands excellence, particularly in the methods employed to conduct research, be it quantitative or qualitative, and hence will consider the track record of the proposerls for expertise and delivery (quality, time and to budget); • Use and development of research skills - the Council requires research teams to possess the skills relevant to the success of the project and also favours projects which assist in developing research capacity, particularly in previously disadvantaged groups; • Collaboration - the Council places a high priority on collaboration between researchers and the "teams of excellence" approach. ThUS, the means of soliciting research proposals is intended to stimulate collaboration between centres of excellence and individual experts in order to optimise the use of the Council funding and the research outcomes. • Development of key indicators - the Council recognises the challenge in assessing performance and improvement in health, as opposed to safety, in the mining industry. There is a lack of suitable occupational health (OH) indicators and baseline data. Thus innovative and robust research to develop relevant OH indicators and baseline values will be favourably considered.

The Council's research and implementation programme consists of occupational health and safety, addresses occupational medicine and hygiene, rock engineering, engineering and machinery, behavioural issues and technology transfer processes.

Notice is hereby given in terms of section 11(1) of the Restitution of Land Rights Act, 1994(Act No. 22 of 1994) as amended, that a claim for restitution of land rights has been lodged on part of Locatie Van Knopneuzen 230 LT on the un-surveyed land (Makhasa village, Hanani village and Davhant (Malonga village and Mabidi village) situated within the Thulamela Local MUnicipality, Vhembe District Limpopo.

Note that the claimed land is a Communal area and the occupants enjoy the followmg rights in the land: residential, burial, grazing and exercise ritual rights. Therefore, the land under claim is not feasible to be restored to the claimants. On the Southern side it is bounded by Xavangoni Mountain. On the Western side it is bounded by Hlaneki village. On the Eastern side it is bounded by Mudavula village. .
