19 November 2018 Zondo Commission: Gordhan describes government’s push to secure nuclear deal Public enterprise minister Pravin Gordhan urged South Africans to connect the dots and learn for themselves how state capture happened – keeping the failed Russia nuclear deal, the bombed out Denel Asia venture and the appointment of former Sars commissioner Tom Moyane in mind. He was testifying before the commission of inquiry into state capture on Monday. The concept of state capture, he said, is understood to be the manifestation of a network of systems that usually have a sole or few ultimate beneficiaries, with players who can be categorised to suit the needs at different levels of the project. Gordhan spent most of the morning explaining the dynamics within which he led the national treasury – during two tenures that were interrupted by a stint in the co-operative governance department (Cogta) – and the level at which its systems were compromised. He was first appointed minister of finance shortly after the 2009 national elections, and redeployed to Cogta in 2014, before returning to the finance portfolio. Gordhan then elaborated on three major processes that happened during his first term and beyond, which raised eyebrows for him and his colleagues at Treasury. First up was the infamous nuclear deal with Russia, to which Treasury was opposed in principle, right from the start. In a late 2013 meeting between Gordhan, his then director-general Lungile Fuzile, Senti Thobejane - advisor to then minister of energy Ben Martins - and Zuma, a compromise was struck between the two departments. Fuzile and Thobejane, it was decided, would work on the framework that would structure a procurement process for the consumption of nuclear power for South Africa, no different from any other tender process entered into by government. -

Almal (behalwe die Zuptas en die EFF) wil hê dat hy slaag en glo dat hy wil slaag. Maar twyfel vreet aan hierdie vertroue elke keer as daar iets negatief in die land gebeur: vanaf nòg ‘n staatsonderneming wat ‘n reddingsboei wil hê, tot ‘n geval van die verkragting van en moord op ‘n student deur ‘n staatsdienswerker. En die terugkerende refrein is dat as Cyril nie gou slaag nie, sal daar nie ‘n ekonomie en ‘n land oor wees nie. William Saunderson-Meyer het onlangs selfs in ‘n artikel die vraag gevra of Cyril die Tier genoem gaan word of bloot die Gestewelde Kat(jie)? Hoe lyk ons President se prestasietelkaart vyf maande nadat hy die ANC tot ‘n oorwinning by die stembus aangevoer het en daarna vir vyf jaar as President van die land aangewys is? Aan die positiewe kant is daar verskeie sake, waarvan baie in die geraas van ander negatiewe gebeure vergete geraak het. Die aanstelling van ‘n Ekonomiese Adviesraad met verskeie internasionale ekonome en kundiges aan boord, is ‘n positiewe teken. Die afstand wat sommige van hulle van Suid-Afrika en die heersende ideologieë het, kan beteken dat hulle met vars en oorspronklike planne na vore kan kom. Die gedeeltelike aanvaarding van Tito Mboweni se ekonomiese regrukplan deur die ANC se NUK is ‘n tweede positiewe ekonomiese teken. -

It is also a country run by a government which has itself become increasingly lawless. This is so despite all the commitments to legality set out in the Constitution. Not only is the post–apartheid South Africa founded upon the principle of legality, but courts whose independence is guaranteed are vested with the power to ensure that these principles are upheld. Prosecuting authorities are enjoined to exercise their functions “without fear, favour, or prejudice”. The same duty is laid upon other institutions established by the Constitution, among them the public protector and the auditor general. Everyone is endowed with the right to “equal protection and benefit of the law”. We are all also entitled to “administrative action that is lawful, reasonable, and procedurally fair”. Unlike the old South Africa – no doubt because of it – the new Rechtsstaat was one where the rule of law would be supreme, power would be limited, and the courts would have the final say. This edifice, and these ideals, are under threat. Lawlessness on the part of the state and those who run it is on the increase. The culprits run from the president down to clerks of the court, from directors general to immigration officials, from municipal managers to prison warders, from police generals to police constables, from cabinet ministers to petty bureaucrats.
