Access to LexisLibrary and Westlaw

All exam questions can be answered using either LexisLibrary or Westlaw UK, however each service has particular strengths, and you will save yourself invaluable time on the assessment if you are able to identify which service to use for a particular strand of research. Hence, candidates should be perfectly proficient with both databases. By way of example, some helpful content may be found only on LexisLibrary, such as Halsbury’s Laws of England, whereas other sources, e.g., Chitty on Contracts, are only available on Westlaw UK.

Please keep in mind that you are given 60 minutes to conduct the entire legal research assessment from which you are advised to devote only 45 minutes for the actual online search, where the remaining time should be used to read the question, plan your research, write your legal advice to the client, and provide the legal reasoning mentioning any key sources or authorities.

On the technical side, some candidates have found in the past that during the assessment one of the databases was suffering from technical difficulties, so being proficient on the other could be the difference between passing and failing.

Kaplan officially states that in the event of technical difficulties with one of the databases during the exam period candidates are expected to do the legal research on the other database.

Terms and Conditions for Westlaw (should not be signed if you apply for LexisLibrary access only) 1. Access is provided for Westlaw UK Academic (“Westlaw”) by Thomson (Professional) UK Limited (“”) for the purpose of preparation for the OSCE assessments only and shall not be used for any commercial use whatsoever. 2. Fees must be paid in full upon enrolment and are non-refundable. Your booking shall not be processed until payment is received. In relation to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you agree that the supply of the service shall begin when we make the service available to you for the first time by enabling the access to Westlaw through our QLTS Online Training System. You acknowledge that you will not have the right to cancel your order once the supply of the service has begun. 3. QLTS School is not responsible for any technical issues or interference with accessing or using Westlaw at any time, nor it is responsible for any compatibility issues with Apple and Android Devices. Access to Westlaw is for a period of 6 months from the date of your notification request to activate access to Westlaw (and not from the date you request activation or first access Westlaw), or until you have passed the OSCE, whichever happens first. Once the service has begun, the duration of your access period cannot be frozen or extended for any reason. 9. You shall not be entitled to a refund for fees paid for accessing Westlaw for any reason whatsoever, including (but not limited to) any failure to access or make use of Westlaw, or failure to send notification to QLTS School requesting the activation of your Westlaw access. 10. The copyright of all material on Westlaw belongs to Thomson Reuters, or such other parties as may be identified by Thomson Reuters as holding the copyright to such material. You shall abide by any restrictions on copying, printing or any other uses of the material as are set out in the terms and conditions of use for Westlaw (a copy of which may be found here: http://legalsolutions.thomsonreuters.co.uk/customer-portal). 11. You shall read and abide by Thomson Reuters’s terms and conditions of use as may be in force from time to time before using Westlaw. You acknowledge that in the event that you breach such terms and conditions, or are suspected of having breached them, Thomson Reuters and any third parties who own intellectual property rights in the Materials, shall be empowered to take action directly against you and you hereby authorise QLTS School to deliver a copy of this contract to Thomson Reuters or the third parties concerned in such circumstances or if requested by Thomson Reuters or the third parties for any reason whatsoever. You further acknowledge that your individual usage of Westlaw is monitored by Thomson Reuters. 12. If either QLTS School or Thomson Reuters should determine that you have violated the policies set forth here or any applicable laws or regulations, each of QLTS School and Thomson Reuters reserves the right, severally, in its sole discretion, to deny further access to Westlaw, without limiting any other rights or remedies each may have. 13. In the event that you breach, or permit another person to breach the policies set forth here, the policies contained within the terms and conditions for accessing Westlaw, or any applicable laws or regulations, QLTS School shall not be held responsible for such breach, or any consequences of such breach, whatsoever. You agree to indemnify QLTS School in full for any losses or expenses incurred by QLTS School due to any such breach. 14. Your continued access to Westlaw is made subject to the duration of the agreement between QLTS School and Thomson Reuters (“the Agreement”). In the event that the Agreement is cancelled for any reason and at any point during the ordinary duration of your access, QLTS School reserves the right to cancel your access by written notice with immediate effect. In such an event, QLTS School shall issue a pro rata refund of any fees you have paid in advance for access to Westlaw, within 30 days of the date of cancellation. Subject to the refund, you shall have no other claims against QLTS School. 15. This agreement is subject to the terms and conditions of QLTS School's OSCE course ("OSCE agreement"). A breach of this agreement will be deemed a breach a breach of the OSCE agreement. In the event of a conflict between the terms of this agreement and the OSCE agreement, the terms of the OSCE agreement shall prevail. 16. You acknowledge that access to Westlaw may be unavailable in certain countries or geographical regions which are subject to export control or economic sanctions laws and regulations. Such access will also be unavailable from computers or other devices identified as being used in such countries or geographical regions through their IP address. Thomson Reuters reserves the right, in its sole discretion, to update the list of countries and regions in which access to Westlaw is unavailable, and QLTS School shall not be responsible for any lack of access to Westlaw in the event that Thomson Reuters shall exercise such a right. 17. Any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the London Court of International Arbitration (LCIA) Rules, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be London, UK. The language to be used in the arbitral proceedings shall be English. The governing law of the agreement shall be the substantive law of England and Wales. This arbitration clause shall not apply if shall be a party to the dispute or proceedings. QLTS School's liability under this agreement shall not exceed the amount of the course fees (in British Pound) paid by the candidate to QLTS School. I agree to the terms and conditions above:

This agreement is subject to the terms and conditions of QLTS School's OSCE course ("OSCE agreement"). A breach of this agreement will be deemed a breach a breach of the OSCE agreement. In the event of a conflict between the terms of this agreement and the OSCE agreement, the terms of the OSCE agreement shall prevail. 17. Any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the London Court of International Arbitration (LCIA) Rules, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be London, UK. The language to be used in the arbitral proceedings shall be English. The governing law of the agreement shall be the substantive law of England and Wales. This arbitration clause shall not apply if shall be a party to the dispute or proceedings.
