Public & Private Partnerships in Greece SPECIAL SECRETARIAT FOR PUBLIC-PRIVATE PARTNERSHIPS Greek PPP Practice Early stage concession projects PPPs in Greece since 1993 First generation PPP projects Three pioneering projects paved the way for a wider use of PPPs in delivering public infrastructure: . Rion Antirion Bridge . Athens Ring Road/ Attiki Odos . Athens International Airport Today all these three concession projects are in successful operation. EIB supported all three projects, underlining its catalytic role in helping to co- finance major infrastructure projects together with the Hellenic public and private sector (PPPs). Cosco Pacific concession of Piers 2 and 3 at the Port of Piraeus for 35 years 2 Greek PPP Practice Framework First and Second generation concession projects had the main characteristics: • All were ratified in Parliament as distinct laws • Motorways and airport projects were co-financed by EU funds Need for a legal framework that… • Enables the wider implementation of PPPs • Overcomes obstacles that delayed the implementation of projects • Bridges the legal gap that led each co-financed project to the Parliament for ratification Establishment of a PPP Law (L. 3389) - 2005 • Result of extensive consultation • “Umbrella” framework • Incentives to private sector • Clear approval and tendering procedures for PPP projects 3 Greek PPP Practice Framework-Law 3389/2005 Keys to Successful PPPs Key Characteristics Clear Legal Framework • Clear approval process – centralized control by the Interministerial Strong Political Will Committee for PPPs (ICPPP). Affordability Funding • Award procedures clearly drafted in line with European Directives. • Specified contractual framework - minimum content of a PPP contract. • Fast track provisions for the grants of authorizations and permits. • Provisions include implementation of projects featuring both availability payments and users fees. • Private sector responsible for DBFO. Financing could be covered partially by the State. • Provisions for dispute resolution by arbitration. • Continuous follow-up by the Special Secretariat for PPPs which facilitates and administers projects. • A series of decisions by the Supreme Court in favor of the State, after appeals from bidders, highlights the legal certainty offered by the Hellenic framework. 4 Greek PPP Practice Affordability for availability-based projects Keys to Successful PPPs Clear Legal Framework Strong Political Will As the public sector pays for PPPs over the operational period of availability- Affordability based projects, we need to have a clear view on affordability. Funding Payments by the State Construction phase Private Investment -Loan repayment Operational phase -Operational, maintenance etc costs -Dividends • All projects receive a Inter-Ministerial Approval with specific budget, based on the NPV of future payments by the state. • Future payments are part of the Public Investment Program. • We have introduced a principle: future payments do not exceed 10% of total annual Public Investment Program. 5 Greek PPP Practice Project funding Keys to Successful PPPs • In practice, the financial institutions fund 70%-80% of project funding needs, Clear Legal Framework the rest 30%-20% is covered by private capitals. Strong Political Will • Financial crisis has caused a deterioration of funding terms and spreads for infrastructure projects. Project cost : €32,7million “Precision medicine PPP infrastructure project” Project cost: €58,5million The signing ceremony of the cooperation agreement between the European Bank for Reconstruction and Development (EBRD) and the Biomedical Research Foundation of the Academy of Athens for the support of the new Precision Medicine Infrastructure Project took place on April 25, 2018. First Public – Private partnership in Greece for EBRD. It is the first project in Greece whose preparation is supported by the EBRD’s Infrastructure Project Preparation Facility (IPPF). The new facilities will house high tech laboratory infrastructure of total area 20.000 m². 15 Northern Road Axis of Crete The purpose of the project is to improve the safety of road infrastructure in Crete and in particular on the main road axis of the island from Heraklion to St Nicholas. It is the first availability-based motorway project in Greece of appr. EUR 290m budget.
