In pursuance of the provision laid down in the National Food Security Act, 2013 Section 40(3), the Governor of Mizoram is pleased to notify the Guidelines for selection of beneficiaries under the National Food Security Act, 2013 for use in the state of Mizoram with immediate effect.

GUIDELINES FOR IDENTIFICATION OF BENEFICIARIES UNDER THE NATIONAL FOOD SECURITY ACT, 2013 IN THE STATE OF MIZORAM

1. OBJECTIVE: The National Food Security Act, passed by Parliament on the 1st September, 2013, aims to provide food and nutritional security by ensuring adequate quantity of quality food at affordable prices to the people of the country to live with dignity and for matters connected therewith or incidental thereto. In pursuance of this Act of Parliament and its professed objective, the Government of Mizoram has laid down the following guidelines for identification of beneficiaries under the National Food Security Act, 2013 in the State of Mizoram.

2. COVERAGE: The percentage coverage for the State of Mizoram under the Targeted Public Distribution System in Rural and Urban areas as determined by the Central Government is 81.88 % in Rural areas and 48.60% in Urban areas. And, the total number of persons to be covered will be 7.06 Lakhs persons of which are 4.33 Lakhs persons in Rural areas and 2.73 Lakhs persons in Urban areas.

3. SCALE AND ISSUE PRICE: Eligible Households under Priority Households, identified under sub-section (1) of Section 10 will be entitled to receive 5 (five) kilograms of foodgrains per person per month at a subsidised price not exceeding Rupees 3 (Three) per kilogram of rice, Rupees 2 (Two) per Kilogram of wheat and Rupee 1 (One) per Kilogram for coarse grains for a period fixed by the Central Government and thereafter, at such price as may be fixed by the Central Government from time to time. Eligible Households covered under Antyodaya Anna Yojana Scheme will be entitled to thirty-five kilograms of foodgrains per household per month, or as may be specified by the Central Government in the said scheme, at the prices specified above.

4. IDENTIFICATION OF BENEFICIARIES: As provided under Section 9 National Food security Act, the following criteria will be used as the basis of calculation to determine the number of persons eligible for entitlement under the Act: (1) Administrative boundaries of each District, Sub-District (Block) and Village shall be based on boundaries defined by Census – 2011 for the purpose of identification. (2) Population figures of District, Sub-District (Block) and Notified Village shall be based on Census – 2011. However, population of each Local Council and Village Council within a particular Notified Town/City may be based on population figures of the Department of Local Administration Department, Government of Mizoram for the purposed determination of ratio of population eligible for the village. (3) Number and Name of Local Councils and Village Councils within a particular Town/City and Census Village may be as per nomenclature of the Department of Local Administration Department, Government of Mizoram. (4) Classification of Urban and Rural areas will is as notified by Census – 2011 and percentage coverage of persons in Rural and Urban areas shall be maintained in each Village, Block and District. (5) Exact ratio should be maintained between population figures of Census – 2011 and NSSO from State, District, Sub-District and Village Level. (6) The number of eligible persons in Notified Villages and Towns having more than one Village/ Local Council should not affect the total number of persons eligible for that particular Notified Village/Town as the ratio is calculated on the basis of the total population of the Notified Village/Town as a whole as fixed by Census – 2011. - 3 - Ex-295/2015

5. SELECTION OF BENEFICIARIES: Based on the number of eligible persons determined in each Village and Urban Local Body as above, selection of Eligible Households should be undertaken in the manner as prescribed below: (1) Only bonafide citizens of and domiciles of the state of Mizoram shall be eligible for consideration to benefit under the National Food Security Act, 2013. (2) Households having (a) member(s) who is/are Regular Government employees, drawing a Grade Pay of Rs 4800.00 and above, will not be eligible to benefit under the scheme. (3) In this Guideline, a “eligible household” means households covered under the priority households and the Antyodaya Anna Yojana Scheme referred to in sub-section (1) of section 3 of the National Food Security Act, 2013. (4) Formation of Village and Local Council Selection Committee: A Village/ Local Council (for Towns) Selection Committee having the following members shall be formed in all villages and Local Councils:

Chairman : District Civil Supplies Officer of the District. Vice Chairman : President, Village Council/Chairman, Local Council Secretary : to be appointed by the Chairman from among educated persons of the Village Asst. Secretary : Secretary, of the Village/Local Council; or Sub-Village Committee (for the concerned Sub-Village Committee). Members : (1) All members of the Village/ Local Council. (2) All members of the Sub-Village Committee for the concerned Sub-Village. (3) Two prominent citizen to be nominated by the Chairman. Ex-officio Member: Inspector/Sub Inspector/Storekeeper, FCS&CA Dept. of the concerned Village.

The Committee shall be responsible for selection of Eligible Households.

6. Identification of Beneficiaries in Priority Category: All such persons who do not fulfil the parameters for the exclusion criteria prescribed below shall be eligible for consideration to be included in the Priority Category. All households belonging to the following categories shall be designated as excluded households. (a) All such families/households residing in Urban Areas who fulfill any of the following criteria shall not be included in the Priority Category: * If the number of dwelling rooms exclusively in possession of the household is 4 and above (Dwelling room with wall of concrete or burnt bricks or stone packed with mortar; roof of concrete or burnt bricks or machine made tiles). * Households possessing any one of the following: · 4 wheeler motorised vehicle. · Air Conditioner. * All such households in which any member of the household is an Income Tax payee * Households with any member as Government Employee gazette and non-gazetted employees of Central Government, State Government, Autonomous District Councils, Public Sector Undertakings, Government-aided autonomous bodies and local bodies, drawing a Grade Pay of Rs. 4800 and above. This will exclude incentive and other honorarium based workers; * Households with enterprises (other than micro-enterprises) registered with the Government for manufacturing and services.

(b) All such families/households residing in Rural Areas who fulfill any of the following criteria shall not be included in the Priority Category: Ex-295/2015 - 4 -

* All such households if any member of the household is an Income Tax payee * Households owning Motorised Four Wheelers/Mechanised Fishing boats (which require registration) except motorised vehicles adapted for use by disabled persons. * Households having domestic electric connection with a load of 2 KW or more and/or consuming and average of 300 units of energy (KWH) per month. (average over one year) * Households with any member as Government Employee gazette and non-gazetted employees of Central Government, State Government, Autonomous District Councils, Public Sector Undertakings, Government-aided autonomous bodies and local bodies, drawing a Grade Pay of Rs. 4800 and above. This will exclude incentive and other honorarium based workers; * Households with Enterprises (other than micro-enterprises) registered with the Government for manufacturing and services. * Households having Kisan Credit Card or having availed of credit of Rs. 1,00,000 and above from any bank under any scheme in the past three years. * Households owning 7.5 acres or more of land with at least one irrigation equipment such as diesel/electric operated borewell/tubewell.

7. Identification of households under Antyodaya Category: (a) All such families/households residing in Urban Areas who fulfill any of the following criteria shall be eligible for inclusion under the Antyodaya Anna Yojana: * Homeless/households persons or persons residing in temporary establishments, buildings, huts, etc. * Households with no source of income or any of members of which is engaged in a vulnerable occupation like beggar/rag, picker, domestic worker and sweeper/sanitation worker/mali or persons employed in irregular work. * Households which do not have a male able-bodied person aged between 18 and 60 years or if all earning adult members in the household are either disabled, chronically ill or aged more than 65 years.

(b) All such families/households residing in Rural Areas who fulfil any of the following criteria shall be eligible for inclusion under the Antyodaya Anna Yojana: * Designated ‘Particularly Vulnerable Tribal Groups’ * Communities with less than 10% female literacy * All households headed by minor * Destitute households which are dependent predominantly on alms for survival * Homeless households * Any member of the household is a bonded labourer all households headed by a widow or a single woman; * All households headed by a terminally ill person; * All households headed by a person with disability; * All households headed by a person released from bonded labour; * All households with no adult member between age 16 and 59, including all households headed by a person of sixty years of age or more with no assured means of subsistence or social support; * Households with no literate adult above 25 years; * Landless households deriving a major part of their income from manual casual labour.

8. Procedure for Selection of beneficiaries: The Selection Committee will follow the following procedure in the selection of beneficiaries: - 5 - Ex-295/2015

Step 1: Identify the households to be covered under the Antyodaya Anna Yojana (AAY) Scheme in accordance with the guidelines applicable to the said Scheme and as per Section 7 of this Guideline, within the number of households allocated for the Village/ Local Council Area. The Committee may review existing beneficiaries under the Scheme and may make recommendations for addition of new households or deletion of existing households within the number of households allotted for the village. The total number of Households selected under AAY Scheme should not exceed the number of Households allotted to the concerned District on the whole. The Households so selected, shall be compiled in a separate list marked “LIST A”.

Step 2: For selection of Eligible Households under Priority Households, list of all existing Ration Card holders under BPL and APL categories shall be laid before the Committee. The committee shall scrutinize each Ration Card holder as per exclusion criteria laid down under Section 6 of this Guideline. All such eligible persons will be compiled, household-wise, in a list marked “LIST B”. The number of persons/Households so selected should not exceed the number of eligible beneficiaries allotted for the village.

Step 3: From among the remaining Ration cards/Households, the Committee will further identify any ineligible persons – those expired, doubly entered and non-existing persons and will cancel such Ration Cards, households and persons and indicate in a separate list marked “LIST D”, mentioning the reason for cancellation.

Step 4: All other remaining Ration Cards/Households/Persons not listed in any of the lists above, i.e. List A, B or D, should be listed in a separate list marked “LIST C”. Names and particulars of all members including Electors Photo Identity Card number (EPIC No.) of each household should be stated.

(1) The State Government will use the list of persons as compiled during Census of India by the Registrar General & Census Commissioner, India or voters list notified by Election Commission of India or Socio Economic Caste Census data or any other authentic source of data to cross- check and verify the list of eligible household and their members. (2) The Lists (List A, B, C and D) so drawn up should be displayed in the Office of the Village Council/ Local Council and should be read out in a public meeting convened for the purpose and claims for inclusions and objections for inclusions should be invited. (3) The Selection Committee will draw up the final list of eligible and priority households, Fair Price Shop-wise, after disposal of claims and objections, within their respective jurisdiction. (4) The Selection Committee shall, after verification, certify and submit the final lists drawn up as per Section 8 (3) above, submit the list to the Appropriate Authority for formal approval. (5) The final list of the eligible households should be displayed in the public domain including office of the local authority and on the State web portal, showing the category-wise names of eligible households and their members. (6) The Ration Card issued under the National Food Security Act, 2013 will not be transferable. (7) The State Government will review the list of eligible households regularly for the purpose of deletion of ineligible households and inclusion of eligible households. During the review, the State Governments will take into account the increase in the number of eligible households or their members due to migration to the State, birth, marriage, change in social and economic status, etc. and the decrease in the number of eligible households or their members due to migration outside the State, death, marriage, change in social or economic status, etc. However, the total number of eligible households after the review shall not exceed the prescribed ceilings. 9. Issue of Ration Cards: (1) After identification of eligible households, Ration Cards should be issued to all selected households by the designated authority. The Ration Card should have all necessary details about the household, scale of ration and information required under End to End Computerisation of TPDS scheme. (2) The eldest woman who is not less than eighteen years of age, in every eligible household, shall be head of the household for the purpose of issue of ration cards. (3) Where a household at any time does not have a woman or a woman of eighteen years of age or above, but has a female member below the age of eighteen years, then, the eldest male member of the household shall be the head of the household for the purpose of issue of ration card and the female member, on attaining the age of eighteen years, shall become the head of the household for such ration cards in place of such male member. (4) The State Government will issue a ration card only to a citizen of India who is resident of that State and fulfills the conditions for getting a ration card as may be prescribed by the State Government. Provided that the State Government may also issue a ration card to a household or a person residing in that State by virtue of the household or person being granted the status of a refugee and is allowed the entitlement of benefits on humanitarian grounds by the Central Government. (5) The State Government should issue separate and distinct ration cards to the Antyodaya households and the priority households. (6) Ration card should not be used as a document of identity or proof of residence. (7) The State Government will prescribe a suitable form of application for new ration card and modification in the existing ration card. The modification may be on account of shifting of residence, birth of child, change in category of beneficiary, corrections in the details mentioned in the card, etc. The form may include requisite details including Aadhaar number, bank account details, and mobile telephone number. For this purpose, the State Government shall capture the information in the software prepared by National Informatics Centre or as per the fields and standards prescribed by the Central Government. (8) The State Government should maintain the ration card data in the digitized database and ensure that issue of a new ration card and modification in the existing ration card is undertaken through the software programme so that the database is automatically updated. (9) District Civil Supplies Officers of each district will be the designated authority for receiving, registering, acknowledging and processing of application for issuance of ration card or modification in the ration card. He or she should not delegate this function to any staff or officer functioning under him or her unless permission is granted on exigencies by the Government in writing. The State Government may also prescribe the procedure for receiving the application through online mechanism including use of e-service centres, kiosks, etc.

NUTRITIONAL STANDARDS

Nutritional standards: The nutritional standards for children in the age group of 6 months to 3 years, age group of 3 to 6 years and pregnant women and lactating mothers required to be met by providing “Take Home Rations” or nutritious hot cooked meal in accordance with the Integrated Child Development Services Scheme and nutritional standards for children in lower and upper primary classes under the Mid Day Meal Scheme are as follows:
