33 TERMS AND CONDITIONS

Alcohol Consumption We reserve the right to make decisions on continued service of beverages based on guest behavior & consumption. The safety of your guests is our priority. No shots are served with open bar packages. We ID guests who look younger than 40 and will not serve anyone without proper ID. Additional Wine and Beer Options Additional and upgraded packages need to be ordered in advance. There are no returns or refunds on ordered cases. Cancellation A non-refundable deposit is required at contract signing. If event is canceled, your party is subject to forfeit all payments prior to cancellation. Rescheduling of an event is dependent upon available dates and will be honored with no additional expense. Windham Mountain Resort reserves the right to reschedule or move an outdoor event due to weather. Decorations No decorations are to be affixed to any walls or structures without prior approval. Fog machines, taper candles, glitter, wall or ceiling hangings, and are not permitted. All candles must be in a holder. Decorating must be completed by event organizers. Venue will not decorate facilities (including lighting candles) or remove decorations after an event. All décor must be removed within 30 minutes of event end time. Destination Location This is a multi-venue facility that may host multiple events on premise any given day. Operational hours are subject to change for seasonal events and mountain activities. Desserts All outside desserts need to be pre-approved. Set-up and breakdown needs to be provided by the Bakery providing the desserts. Any assistance required – plating, plates, utensils, attendants, servers etc. – will incur additional costs (outside of cakes). Extended Hours You may opt to add additional time onto your event – please consult your event planner for details. Additional costs will apply. Floor plans Floor plans/layouts will be created 2 weeks prior to your event. Any changes to the floor plan after it has been set up by our team will incur additional costs. Gratuities / Administrative Fee and Taxes A 20% Administrative Fee is added to all food & beverage served – this is not a gratuity. Gratuities are not required however you may leave a gratuity if you feel that the staff has exceeded your expectations. New York State sales tax is 8% and will be added to the final bill. Guarantee Number During the initial planning of your event, we request an estimated number of guests. A final guarantee is required two weeks prior to the function. This count is not subject to reduction within 2 weeks of your event. You will be financially responsible for 100% of your guarantee number or the actual number of guests served, whichever is greater. If a guarantee is not provided two weeks in advance, your last estimate will be used as the guarantee. Tabbed/Hosted Bar Set-up fee of 150.00. Open bar priced on a per drink consumption basis. Sight fees are additional, please inquire for pricing. Timeline We ask that your guests do not arrive prior to your designated start time. Our team will ensure that the venue is ready 15 minutes prior to the scheduled start of your event. Venues are closed prior to that to ensure our staff can properly set up for your event in the correct time frame. Venues are open for 2 hours during your event and 30 minutes for clean-up after the event is over. For food safety, all meals are served at the specified time and will be left out for no more than one hour. Food prepared is to be consumed at the function and may not be removed from the event. Outside Catering No food, beverages, or alcoholic beverages, may be brought on premise by the patron or any of the guests. Payment The room usage fee is required along with the signed contract. A second payment of 50% of the guaranteed minimum expenditure will be due four months prior to the event. Final payment will be due 7 days prior to your event in the form of cash, check, or money order. Late payments will accrue at 1% a month or any part thereof. Rain Plans In the event of rain or inclement weather, outdoor events will be moved inside. Weather related decisions take place the day before by our team and will be communicated to you at that time. We take very seriously the safety of our guests and will not permit on-hill activities if inclement weather is in the forecast. Rock’n Mexicana After Party After parties are available during normal operating days (Wednesday- Saturday) at Rock’n Mexicana between the hours of 10pm - 12am. Price is 400.00 for 2 hours & includes the following: Chips and salsa, fire pit, bartender & restaurant space. Cash bar. Site fees may apply outside operating days. Responsibilities The host assumes full responsibility for the conduct of all guest in attendance and for damage to any part of the premise or for theft of property. Venue is not responsible for lost, stolen, or left-over items. All decorations must be removed directly after an event. Specialty Menus Our culinary team can create a menu that is tailored to your taste and your budget as well as help plan for allergies or specialized dietary needs. Substitutions We reserve the right to substitute products of equal or greater value without notice. Vendor Meals Band, Photographers, etc., are charged the same rate as your guest minus alcoholic drinks. Facility Rental Fees Are based on a 2-hour timeline for most events.
