Manitoba’s Police Services Act (PSA) was enacted on October 8, 2009 replacing the Provincial Police Act. Section 26(1) of the PSA requires every municipality that operates a police service to establish and maintain a police board. Section 7 (d) mandates the Manitoba Police Commission (MPC) to arrange for the training of police board members. This Manitoba Police Boards: Policy and Procedure Manual will assist boards and individual board members in their work on municipal police oversight. This manual provides policy and procedural direction on a police board’s legislated obligations under The PSA, as well as policy direction on good governance best practices. This manual is divided into seven main sections: Chapter 2.0: Roles and Responsibilities of Policing Officials and Agencies: This chapter provides a synopsis of the roles of agencies and officials involved in policing oversight and administration in Manitoba according to the PSA. Chapter 3.0: Police Board Governance: An Overview This chapter covers policies and procedures concerning confidentiality, code of ethical conduct, for board members, and other requirements necessary to ensure effective operation of the police board. Chapter 4.0: Board Meetings and Procedural Rules This chapter covers the legal requirements for notice and frequency of meetings as well as an overview of the roles of the members of the police board. Chapter 5.0: Administration/ Management of the Police Service This chapter covers policies and procedure relating to strategic planning and the development of practices and procedures by the police board. Chapter 6.0: Human Resources This chapter highlights the important function of hiring a police chief and police officers and using the MPC created Police Chief Selection Application. The topics of creating of a job description and dealing with conduct complaints are also covered. Chapter 7.0: Financial This chapter provides policies and procedures for creating a budget for the police service, presenting it to council and keeping the police service accountable for its spending. This manual is available online at www.mbpolicecom.ca. The MPC is legally mandated to produce this manual. It is the intent of the commission to update the manual as required in consultation with Manitoba’s police boards, municipal

Anne Mandate: The Police Boards’ mandate, as outlined in the Police Services Act is to provide civilian governance respecting the enforcement of law, the maintenance of the public peace and the prevention of crime in the (insert Town name here), and to provide the administrative direction and organization required to provide an adequate and effective police service in the town or city. Authority: Police Services Act Responsibilities: As outlined in section 27 of the Police Services Act, the Police Boards’ responsibilities include consulting with the police chief to establish priorities and objectives for the police service; establishing policies for the effective management of the police service; directing the police chief and monitoring his/her performance; and performing any other prescribed duties. More specifically, the Police Board fulfills a community purpose. It ensures that community needs and values are reflected in policing priorities, objectives, programs and strategies. It acts as a liaison between the community and the respective town/city Police Service to ensure that services are delivered in a manner consistent with community needs, values, and expectations. The board also ensures that the police chief establishes programs and strategies to implement the priorities and objectives established by the board. Membership: Altona: Five members, with four appointed by the Town of Altona and one appointed through provincial order in council. SUMMARY: In September of 2018, as part of its governance and oversight responsibilities, the VPB committed to auditing street checks and annually releasing street check data that is broken down by gender and ethnicity. On January 15, 2020, British Columbia (BC) Provincial Policing Standard (BCPPS) 6.2.1 Police Stops (‘Standard’) came into effect. The Standard also requires police departments in BC to conduct an annual audit of street checks. The data in this report will address these commitments. This report will also provide the results of the audit and clarify the law surrounding the practice of street checks, comment on the efficacy of street checks, and comment on calls to ban the practice of street checks. The following is a high-level listing of the audit’s findings. Important background, information, and context is in the main body of the report, and must be read to avoid any misinterpretations: The Law Surrounding Street Checks (pages 6-8) In addition to BC, the following provincial governments have either regulated or provided guidance on the practice of street checks: Ontario; Saskatchewan; Nova Scotia; Quebec, and; Alberta (they are listed in chronological order of when each government provided direction). Police cannot conduct a street check that is random, arbitrary, biased, or based on identity factors such as (but not limited to) race or ethnicity.

    Manitoba’s Policing and May 2019 Public Safety Strategy Keeping Manitobans safe through collaboration, criminal intelligence and provincial leadership. Manitoba’s Policing and Public Safety Strategy Minister’s Message On March 9, 2018, the Manitoba government announced the Criminal Justice System Modernization Strategy (CJSM), following an internal review of Manitoba’s criminal justice system. The CJSM is a four-point strategy. It emphasizes crime prevention. It targets resources for serious criminal cases. It more effectively uses restorative justice. And it supports the responsible reintegration of offenders. The goal of the CJSM is to transform the way we deal with complex issues related to the administration of justice in our province. It is designed to help create safe communities and ensure timely access to justice for all Manitobans. We have made significant progress since the launch of the CJSM. Criminal cases are moving more quickly, fewer people are in custody, and where appropriate, more matters are being referred to restorative justice to enhance accountability and reduce reliance on incarceration before trial. Manitoba is also taking action to improve road safety and reduce the number of fatal collisions on our roads. New legislation will create tougher sanctions for impaired drivers, utilizing a more efficient administrative system that allows police to remain on the road to apprehend more impaired drivers and dedicate more of their resources to arresting violent offenders. Manitoba Justice has already taken concrete actions to address many of the challenges in our criminal justice system. However, while early results show promise, challenges remain and there is much more to do.
