Canada Fulbright Visiting Chair in Arctic Studies MGH 278 This course will address the range of Arctic insecurities from the Cold War security paradigm to environmental and human security (Arctic Council's Search and Rescue Agreement); Aboriginal land claims (Alaska, Canada, Greenland) to Indigenous Internationalism (Inuit Circumpolar Council, the Saami Convention); the Finnish Initiative to the Arctic Council, Permanent Participants and Observers (China, India, etc); seabed resources, the Arctic Five (UN Convention of the Law of the Sea) and the Circumpolar Inuit Declaration on Sovereignty in the Arctic; national and regional resource mega-projects, devolution and local development; the Arctic Treaty idea (EU) versus the reality of an evolving network of interlocking relationships (Arctic Governance Project); and, American and Canadian management of these Arctic issues. This graduate seminar will also examine a series of Arctic policy questions with the ultimate aim of assembling a set of papers into a collection for publication. Tony Penikett, a Vancouver-based mediator, served in politics for 25 years including two years in Ottawa as Chief of Staff to federal New Democratic Party Leader Ed Broadbent MP; five terms in the Yukon Legislative Assembly; and two terms as Premier of Canada's Yukon Territory (1985-92). His government negotiated final agreement for First Nation land claims in the territory and passed pioneering education, health, language legislation, as well as leading a much- admired bottom-up economic planning process. After serving as Premier of the Yukon, Penikett acted as Senior Aboriginal Policy Advisor for the Premier of Saskatchewan (1995-97) and, Deputy Minister for Negotiations, and later Labour, for the Government of British Columbia (1997-2001).

Twenty-Two Years of Aboriginal Teacher Education in the Yukon
Honouring the Past, Touching the Future: Twenty-Two Years of Aboriginal Teacher Education in the Yukon Lori Patterson Eastmure Abstract: Recommendations for a Yukon First Nations focused teacher education program date back to 1972; however, this was not acted on until 1989 with the establishment of the Yukon Native Teacher Education Program (YNTEP). Though a ground-breaking initiative in First Nations’ education in the Yukon, YNTEP is not unique. It is one of many small Aboriginal teacher training programs established in various Canadian locations since the 1960s, as community-based teacher training opportunities reflecting local needs in largely Aboriginal communities. This article provides a detailed history of YNTEP set within the historical context of Aboriginal teacher education in western and northern Canada and in relation to the historical and political context of the Yukon at the time of YNTEP’s founding. This includes a short history of public education as it pertains to Yukon First Nations—from mission schools to public schools to post-secondary training and education. I argue thatYNTEP, as the first degree program in the Yukon specifically for students of First Nations ancestry, is one of the first tangible realizations of early land claims commitments and that the establishment of this program is a credit to two fronts: unwavering Yukon First Nations leadership, and forward-thinking government officials and educators of the time who recognized that the continuing colonization processes in public school education would not change without the influence of Yukon First Nations educators. It is often said that when it comes to initiating a new idea, timing is everything.

An Unfinished Journey: Arctic Indigenous Rights, Lands, and Jurisdiction? Tony Penikett I. INTRODUCTION Yellowknife-Dene political scientist Glen Coulthard sums up the goals of the indigenous rights movement Idle No More1 as a struggle for land and jurisdiction.2 Over the last forty years, American and Canadian governments made much progress on the land question in the Arctic and sub-Arctic; however, from an irrational fear of the unknown, politicians in Washington, D.C. and Ottawa have effectively blocked the pathways to aboriginal jurisdiction or self-government. In Arctic North America, indigenous land issues have largely been settled, but indigenous govern- ments still seek to restore jurisdiction over their lands and citizens. Dur- ing the late-twentieth century in the Yukon, Northwest Territories, and Nunavut, as well as in Nisga’a territory in the northwest corner of British Columbia, First Nations negotiated provincial and local government powers. But, faced with both federal and provincial opposition, conti- nent-wide progress on the question of indigenous jurisdiction has since stalled. First Nations want land and jurisdiction—American and Canadian governments have granted some land but not much jurisdiction. Yukon Legislative Assembly Office Box 2703 (A-9), Whitehorse, Yukon Y1A 2C6 • • • Telephone (867) 667-5498 Fax (867) 393-6280 Email [email protected] The Executive Committee and the Executive Council of Yukon (as of December 31, 2020) On February 3, 1970 Yukon Commissioner James Smith announced the establishment of the Executive Committee of the Yukon – the first Yukon ‘cabinet’ to include elected members of the territorial council. The first Executive Committee was sworn in on November 29, 1970 following the general election of September 8, 1970. Hilda Watson, the Member for Carmacks-Kluane, and Norm Chamberlist, the Member for Whitehorse East, were the first two elected members appointed to the first five-member Executive Committee. Following the Epp Letter of October 9, 1979 – which created responsible government in Yukon – an Executive Council was created on October 22, 1979. All Executive Committee appointments were revoked on that day and all members of the Executive Committee were appointed to the Executive Council. Unlike the Executive Committee, the Executive Council was modeled on cabinets at the federal and provincial levels. The Executive Council would be led by a Government Leader (later, Premier) rather than the Commissioner, and would be responsible to the Legislative Assembly. The Epp Letter stipulated that “There shall be at no time a majority of members of Council [MLAs] appointed to the Cabinet or Executive Council.” This stipulation maintains a principle of responsible government; that in order for cabinet to be responsible to the Legislative Assembly there must always be fewer elected members Government Organisation Act in cabinet than not in cabinet.

With the Constitution Act of 1982, however, Canada entered a new era. Section 35 of the Constitution recognized Indigenous treaty and land rights, and the Supreme Court of Canada has consistently interpreted this section liberally in favor of Canada's Indigenous Peoples. The Court has upheld the honour of the Crown in emphasizing the national and sub national governments' duty to consult diligently when engaging in development on the traditional territories of First Nations, Metis, and Inuit. The “citizens-plus” model of asserting and protecting Indigenous rights, first coined in the Hawthorn Report of 1966, has proved effective in these court cases, most recently in the Yukon's Peel Watershed case from 2014 to 2017. Yet, engaging with the state to pursue and to invoke treaty rights has forced socio economic and political changes among Yukon First Nations that some scholars have argued are harmful to the spiritual and physical wellbeing of Indigenous communities, mainly through alienation from their homelands.

1 Canada at 150: Federalism and Democratic Renewal Le Canada à 150 ans: Fédéralisme et renouveau démocratique 2017 State of the Federation Conference Donald Gordon Conference Centre June 16-17, 2017 Institute of Intergovernmental Relations, Queen’s University Conference Chairs: Elizabeth Goodyear-Grant, Kyle Hanniman Now in its third decade, the State of the Federation conference series presented by the Queen's Institute of Intergovernmental Relations (IIGR) examines contemporary challenges facing Canada. This year, Canada’s 150th provides an occasion to celebrate, take stock of, and critically reflect on the country’s political institutions and practices. Democratic renewal has occupied a prominent role on the current government’s agenda. The Trudeau Liberals promised several measures to revamp the country’s democratic and federal institutions. The centerpiece of their agenda was electoral reform. In addition, they promised to revitalize relations with the provinces; bring indigenous peoples into the intergovernmental fold; and change the ways in which Senators and Supreme Court Justices are appointed. More recently, the Quebec government has indicated a desire to re-engage in debate about its recognition as a distinct society in the Constitution, potentially leading to its approval for the 1982 Constitution Act. Some indigenous groups have echoed this call. We consider these and further developments to assess the current state of Canada’s democratic institutions and practices a century-and-a-half after Confederation. We are grateful for the support of our conference partners, the Social Sciences and Humanities Research Council’s (SSHRC) Canada at 150 Connection Grant program and the Queen’s School of Policy Studies.

M E N U Paper Promises By avoiding treaty obligations, Canada undermines its own legal basis. T E R R Y FA ENTNDOG NE Y P E N I K E T T he Government of Canada is not keeping all of the promises it made to aboriginal peoples in 24 “modern” treaties, mostly in the North, negotiated over the last 40 years, ratified by aboriginal peoples and Parliament, T and guaranteed by the Constitution of Canada. The Supreme Court of Canada says treaties should “reconcile” aboriginal and non-aboriginal interests, and that the “honour of the Crown” depends upon treaty promises being kept. Certainly the social and economic future of aboriginal signatories rests in large measure on these agreements. Illustration by Gabriel Baribeau Some modern treaties contain more words than the New Testament. Breathing life and meaning into them requires government transfusions of intellectual and financial resources, and commitments of political capital. Without the needed resources, these modern treaties will never be fully implemented. As years pass and memories of treaty promises fade, these agreements may moulder in the dusty crypts of the Department of Aboriginal Affairs and Northern Development. This is an old as well as a new story, for treaty making endures in the bones of our constitution, of Canada’s DNA. Soon after they arrived in North America, the English, French and Dutch made peace and friendship treaties with aboriginal peoples, largely to promote the fur trade. As the British and French competed for the continent, both sought alliances with militarily powerful Iroquois, Hurons, Algonquins, Mi’kmaq and others.
