Journal of Intellectual Property Rights Vol 20, July 2015, pp 230-249 Transplantation of Foreign Law into Indonesian Copyright Law: The Victory of Capitalism Ideology on Pancasila Ideology O K Saidin† Department of Private Law, Law Faculty, University of North Sumatera, Medan, Indonesia Received: 07 May 2015; accepted: 29 June 2015 The Journey of Indonesian history has 350 years experience under the imperialism of Netherland and Japan until the era of post-independence which was still under the shadow of the developed countries. The Indonesia became more and more dependable on the foreign countries which brought influence to its political choice in regulating the Copyright Law in the following days. Indonesian copyright protection model which economic goal firstly based on the country’s Pancasila philosophy, evidently must subject to the will of the era that move towards liberal-capitalist. This era is no longer taking side to Indonesian independence goal to realize law and economic development based on Pancasila, especially the first, fourth, and fifth sila (Principle). The goal of law and economic development in Indonesia, regulated under the paradigm of democratic economy is to realize prosperous and equitable society based on Indonesian religious culture principle that can no longer be realized. Pancasila as the basis in forming legal norms in Indonesia functioned as the grundnorm which means that all the legal norms must be convenient and not to contradict the principles of the basic state philosophy of Pancasila. But the battle of foreign ideology in legal political choice through transplantation policy, did not manage to give the victory to Pancasila as the country’s ideology, but to give the victory to the foreign capitalistic ideology instead. -

This was the rally, the occasion of merry, pleas ant festivity. And here every speech was greeted with great applause. But this was not an ordinary festivity to which the Javanese were accustomed. For one thing, the rally was distinctly modem. Music and not gamelan sounded. Photographs were taken. People came to the place dressed as they liked—Javanese, European, and 'Turkish" (Arabic). (Takashi Shiraishi on a meeting of early Sarekat Islam; p.65.) The new book by Takashi Shiraishi, An Age in Motion: Popular Radicalism in Java, 1912- 1926} covers a period beginning with the founding of Sarekat Islam, usually labeled the first large-scale modem Indonesian political organization, and ending, fourteen years later, with what by broad and superficial consensus is categorized as the first in a series of uprisings of the Indonesian Communist Party. The geographical focus of the study is on the principality of Surakarta. Yet, the book can hardly be categorized as merely a new and well-researched study of the early Indonesian nationalist movement, nor can it be mistaken for just another regional history of Central Java. -

In order to carry out this assessment it is necessary to have a method to know the environmental condition of the road. In the relation to the roadside environmental problems, the planner should be know the environmental condition of each road section or road side, such as which roadside have bad environmental condition. This is very useful for planning and improving purpose. This paper describes the method of evaluating the environmental condition of road through the comparison of each roadside. To support this evaluating works, the preference analysis method were developed is used to find the designated output. Through this evaluation method, the ranking of roadside in relation to the environmental condition is proposed. The ranking is presented from the roadside with bad environmental condition this micro level presentation is then practicable and enormously useful for further inspire in roadside environmental evaluation. Indonesian Historiography in the New Order (274 pp.) Director of Thesis: William H. Frederick This thesis discusses one central problem: What happened to Indonesian historiography in the New Order (1966-98)? To analyze the problem, the author studies the connections between the major themes in his intellectual autobiography and those in the metahistory of the regime. Proceeding in chronological and thematic manner, the thesis comes in three parts. Part One presents the author’s intellectual autobiography, which illustrates how, as a member of the generation of people who grew up in the New Order, he came into contact with history. Part Two examines the genealogy of and the major issues at stake in the post-New Order controversy over the rectification of history. Part Three ends with several concluding observations. First, the historiographical engineering that the New Order committed was not effective. Second, the regime created the tools for people to criticize itself, which shows that it misunderstood its own society. Third, Indonesian contemporary culture is such that people abhor the idea that there is no single truth. -

Current Ecumenical Movement and Spirit in Indonesia Jan S. Aritonang1 Preliminary Remarks In September 2008 a new and very comprehensive book on Christianity (including churches) in Indonesia was published. A History of Christianity in Indonesia2 covers a period of almost 500 years, and provides a chapter concerning the presence of [Nestorian] Christianity since the 7th century in a small town at the west coast of Sumatra. One of the 21 chapters concerns the ecumenical movement and spirit in this country (written by the writer of this paper). This paper refers mostly to that chapter. The Nestorian Church of the 7th century was discontinued. The existing Christianity or churches started from early 16th century. The first one is the Roman Catholic that came with the Portuguese-Spanish imperialism. This was followed by the Protestant / Calvinist / Reformed Church brought by the Dutch East Indian trading company (VOC) since early 17th century. The quite fast and fertile growth of the churches (with various confessional identities) was in the 19th and 20th centuries. Currently there are around 24 million Christians (10% of the population). They are scattered or divided into more than 350 denominations or church organizations (324 are registered in the Department of Religious Affairs; around 50 are still queuing for registration). In terms of number of members, the biggest is the Roman Catholic Church with ca. 7 million. Among the non-Catholic churches, the biggest is Gereja Pantekosta di Indonesia (GPdI is a Pentecostal church) with around 4.2 million members and 11.000s local congregations; the second is Huria Kristen Batak Protestan (HKBP, Batak Christian Protestant Church) with around 3.75 million members and 4000 local congregations (covering several congregations overseas: Singapore, Los Angeles, Denver, etc.); the third is Gereja Bethel Indonesia (GBI, also a Pentecostal church) with around 2.5 million members and around 6000 local congregations, including overseas. -

It traces the roots of Indonesia’s first two agricultural development Indonesian Rural schemes to late-colonial criticism of state policy. In these criticisms and schemes, reconstruction; “auto-activity” emerged as a key concept. This paper argues that in the writings of Kasimo Plan; planners and politicians, “auto-activity” facilitated the process of decolonization Knowledge; in various ways.
