The SEIAA observed that--- (a) The proposal has been deliberated and considered in its meeting of SEAC on 25-01-2019, and 29th & 30th March, 20lg.In the last meeting, the SEAC recommended proposal for grant of Environmental Clearance (EC) with specific conditions proposed by SEAC in its
,annexure of the proceedings dated A5-04-2019.
(b) The SEIAA wanted certain clarification regarding capacity enhancement and its was informed that the same shall be met by increasing number of batches of charge usually
from l0 to 12 in 3 shifts"
The SEIAA resolved to grant Environmental Clearance (EC) for 7 years with additional condition that l. Entry inside the plant premises to all the workers I labours / Supervisor / Manager shall only be given after having all personal protective gears.

34 proposals (applications ) for 34 mine plots are under consideration for grant of ToR; 7 on Barnar river,22 on Kiul, and 5 on Ulai river. As per Notification of Govt" of Bihar, Deptt. of Mines and
Geology, so €o-zl\'q gq (wo)o+713-2214/Yq, qdqT, ft0. 27.08.13, called " New Sand
PQ!iey'';portionofoneriveriscalled..9@'',andallthestretchesofalldifferentriversinone district constitutes one unit for settlement of sand mining in the said district; however Jamui and
Lakhisarai district together is considered one unit for convenience of settlement depending upon various factors detailed by GoB in the said policy. Project Proponent has submitted duly approved mine plan for whole unit. He has also submitted a list of mine plots in the unit identified/approved by
Department of Mines & Geology together with estimated quantity of minable minerals mine plot wise with geo-coordinates etc.
The SEIAA observed the followings:-
1" Letters of Intent for settlement of lease was given vide No; 337 dated. 22.07 .2016 and No; 3 17

2" Mining plan for the unit was approved by the Deptt. Of mines vide their letter No" 7666 dated
29.06.2017.
Page 2 of 11 3. The Project Proponent had applied online for few proposals seeking grant of ECI from SEIAA
in the last days of July 2017 when the SEIAA/SEAC was non-existent in Bihar due to expiry of
its/their tenure.
4" Projeet Proponent was advised by the SELAA in 2nd week of Aug 2017 to make application
before central ministry" Vide circular, dated" 23.10.2017 of MoEF&CC all concemed were
made known that in the absence of duly constituted SEIAA/SEAC the applications for grant of
EC shall be oonsidered at central level. The Project Proponent neither acted as per advice of the
SEIAA nor perused his applications for grant of EC further.
5. The Project Proponent presented some fresh batches of applications in the month of September
and October. 2018 to the SEIAA" Applications were processed, scrutinized , scoping and
appraisal etc. were done in the month of Nov. 2018. The SEAC after due processing
recommended the applications for grant of EC under B2 Category"
6" The Hon'ble NGT vide its order dtd: Il-12-2018 made the notification of MoEF&CC, dtd 15-
01-2016 inoperative on the basis of which the proposals were initially assessed/appraised and
recommended. Accordingly the SEIAA in its sitting of Jan. 2019 resolved not to grant EC in the
light of NGT order. The SEAC subsequently also withdrew its recommendations of grant of EC
to these proposals in the light of NGT order.
7" The project Proponent was informed about the above rejections with reasons.
8. Now the proposals have been received afresh from the Projeet Proponent in Bl category in
place of category 82 applied previously. The SEAC has again done the

the period December 2018 to February 2019 for preparation of EIA report" The SEAC
accepted their proposal for submission of data collected so"
Now again the proposals are before SEIAA for its consideration for issuance of ToR.
The SEIAA discussed the proposals and was not fully convinced as to how all the sand
aggradations which is a natural process in all river courses/stretches of both the districts
everywhere are in areas less than 25 ha; to be more adjact around 23 ha. As the rnine plots are
ultimately approved by the Department of Mines the SEIAA resolved to grant ToR as per
recommendations of SEAC for all the proposals of Jamui & Lakhisarai listed below.

B" District Patna and Bhojpur
I he SEIAA observed the tollowmgs :-
l. The Letter of trntent for settlement of mine in the said district were issued vide letter No" 651
dated 06-tr I-14 &, No. 629 dated. 29-12-14 respectively for the district Patna and Bhojpur"
2. "Medified Mining plan" were approved by the competent department Vide their letter Nol6
dated 02101 l2AI9 and Letter No.4628 dated I9lI2l2018 for Patna and Bhojpur respectively.

month of Feb. 2019 (between 1810212019 to 2l/0212019)
4" The proposals of sand mining are from the bed of river 'jSqae'l& (8 on Sone
& 6 on Ganges, in Patna and 13 on Sone in Bhojpur)" All the proposals are for >5 ha" and less
than 25 ha; maximum proposals are having their area between 20 to <25 ha"
5. The Project Proponent made request before the SEAC to permit them the colleetion of data
simultaneously (when appraisal is going on ) for the period December 2018 to February 2019
which was accepted by the SEAC.
The SEIAA was again not fully convinced regarding sand aggradations naturally in
areas < 25 ha. everywhere, however as considered in the case of Jamui and Lakhisarai the
SEIAA resolved to grant ToR as recommended by SEAC to all the projects listed below.

The SEIAA observed the followinss -
(a) The Project Proponent earlier obtained EC vide No. J-1i011116812009-14"ll(l) dated 02.06.2006" of the then MoEF, Govt of india for production capacity of 60,590 TPA.
(b) The unit was monitored by the authorities of Reg. office, Ranchi, MoEF&CC on i3.12.2017 and
violation was observed. The Project Proponent was producing TMIT/ bar beyond their approved capacity.
(c ) SEIAA, Bihar has no intimation received from MoEF&CC regarding any aetion proposed to be taken against the Project Proponent so far.
(d) The BSPCB has also continued to renew its CTO regularly for the eapacity mentioned in EC letter.
(e) The Project Proponent now has applied for capacity enhancement from 60,590 TPA to 2,50,000 "l'FA accepting the said violation.
(0 Noticing violation, the SEAC made an inspection of the unit on 02.12"2018"
Page 9 of 11 (e) The Project Proponent was directed to reduce the production to approved level and maintain same till case of grant of fresh EC is under consideration" He was also directed to remove
shortcomings found in the inspection specially availability of space.
(h) Now the Project Proponent has submitted a declaration that it has abided by the directions
of SEAC ; thereafter the SEAC has considered the proposal and has reeommended for ToR as
The Project Proponent has expanded its promise form 7.47 acres to 8.03 acres. The
SEAC has considered revisedproposal of proponent in its sitting of 26"02.2019 and found it in order.
As directed by SEIAA the Project Proponent has submitted additional information regarding
level of production, status of compliance of previous EC, together with supporting facts and
figures etc.
On the basis of all the information provided by Project Proponent specially considering onlytheconversionofmetal in TMT bars ( re-rolling) in the unit withought having any
furnace the SEIAA resolved to srant ToR as recommended bv SEAC"

In the sitting of SEIAA dated. 24.01.19 the SEIAA resolved to withdraw ban on dispatch of
already mined material after receipt of a report on actual quantity of materials ready for dispatch by the Project Proponent. Ban on further mining was considered to continue due to unsatisfactory status of compliance"

As the stock Register in the site office was not authenticated by the Deptt. of mines, and Project Proponent has not mentioned any thing if done subsequently for wanting authentication, the SEIAA resolved -
Page 10 of 1L (a) To get stock estimated at the site and allow dispatch after verification within 2-3 weeks. In the mean time the Project Proponent shall get its stock register and balance of mined out material authenticated by Deptt. of Mines and shall intimate the same to SEIAA at its earliest.
(b) Any Fresh Mining shall be considered after site verification of status of compliances submitted
by the Project Proponent vide its leffer dated 07.03.2019. The Project Proponent shall keep
liaison with the SEIAA for such verification"
