EXECUTIVE SUMMARY

This Executive Summary selects the key aspects and status of major items of the monitoring reporting period and does not claim to provide a complete picture of the details given in this Social Safeguard Monitoring Report (SSMR). This SSMR is prepared mainly to report the implementation statusof the RIPP, Livelihood Restoration Plan, Grievances and Community Development Plan. Chapter 1 Introduction This Social Safeguard Monitoring Report (SSMR) includes social safeguards aspects only. It covers the period from July to December 2020.

The focus of the social reporting remains unchanged from previous Monitoring Report, as this SSMR covers construction works of the Package 2 and initial phase of Package 3. Chapter 2 Project Status Package 1 Contract: Following the concurrence of the Technical Bid Evaluation Report (TBER) by the ADB and the subsequent approval by the THL Board, THL opened the price bids of two Bidders, whose technical bids were declared to be substantially responsive to the requirement of the bidding documents. The Bid Evaluation Committee (BEC) supported by the PSC completed the evaluation of price bids and the price Bid Evaluation Report (PBER) has been submitted to the ADB on 11 November 2020 for review and approval. After the further clarification and confirmation to ADB's queries on the PBER, the ADB provided concurrence to the PBER on 14 December 2020. Subsequently, upon approval of the THL Board, THL has issued "Notice of Intention for Award of Contract" to all Bidders on 24 December 2020 with a standstill period of seven days so that any unsuccessful Bidder could challenge the proposed award. As no complaint was received from any Bidder, THL plans to invite the successful Bidder- Song Da Corporation, Vietnam and Kalika Construction (P)

Limited, Nepal JV for the pre-award discussion before issuance of the Letter of Acceptance.

Package 2 Contract:After lifting up the national lockdown by the GoN from the end of July 2020, the Package 2 Contractor resumed the construction activities at the underground powerhouse, MAT, tailrace outlet, surge tank portal and access road on the lower right bank of Seti River following the COVID health and safety protocols. However, works on the warehouse and the tailrace outlet were suspended for three days during the Tihar festival.

Package 3 Contract: The Package 3 Contractor completed the foundation concreting of six DB-Towers, whereas the excavation of tower foundation on other four locations are underway. The raised chimney foundation design of DB Type Tower, the foundation design of DC type tower and raised chimney structural design of DC type tower have been approved by the PSC.The virtual Factory Acceptance Test (FAT) of the DC type tower and remaining quantity of DB type tower have been conducted, whereas the seventy percent of hardware fittings have been delivered to the site and the delivery completion certificate has been issued. The final cadastral survey report has been submitted to the PSC for approval and the tree counting work in Chitawan district was completed. Rural Electrification: The rural electrification component is being implemented by the Project Management Directorate (PMD) of NEA. The Contract was awarded to M/S JV of East India and Waiba Construction on 15 December 2018.The Contractor has erected 93 Nos. of steel telescopic pole (single arm) for 33 kV, 162 Nos. of 11m tubular pole (single arm), 27 Nos. of 11m tubular pole (H-structure) for 11 kV and 231 Nos. of 9m steel tubular pole for LT. The Contractor has completed stringing of 1.5 km 33 kV Line, 12.33 km 11 kV Line with ACSR conductor, 4.375 km LT line with ACSR Conductor and 13 km ABC cable of different sizes for LT Including the complete installation of 24 Nos. of stay set for LT and 137 Nos. of stay set for 11 KV. The construction works of switch yard at both Saranghat and Ghiring are under progress.

Chapter 3 Monitoring & Evaluation The monitoring and evaluation of social safeguard activities continue through impact and performance monitoring with the assistance of ESMSP.

THL has appointed two external monitors, one on social safeguard and one on environmentalsafeguard in August 2020. However, the external mobotors are yet to make inception reporting due to the COVID-19 restriction.

During the reporting period, a virtual monitoring mission was held on 23 November 2020 by the ADB in the presence of THL, POE and ESMSP.

Chapter 4: Clearance of Major Construction Works THL has been in a regular follow up with the Division Forest of Tanahu for making a decision on the valuation of the 417ha of forest land, which need to be compensated for the clearance. For the transmission line component, THL has submitted a request to the Department of Forest for the use of 1.97 ha of forest land for the construction of tower pads and felling of 7,923 number of trees located in 65.49 ha of ROW in Tanahudistrict, whereas the THL has been continuing the tree enumerating works in Chitawan District

For the hydropower component, out of 559 AHs (417 male and 132 female), 38 AHs from reservoir area and 9 AHs from Beteni/ Banchare area are yet to be compensated for the loss of their land parcels. In the reservoir Area, 15 AHs forming "Directly Inundation Affected People Collective Rights Protection Committee" have lodged the complaint to the ADB/ EIB, 13 AHs have legal family issues and 10 land owners marked on cadastral map could not be yet identified. In Beteni area, 6 AHs have lodged a complaint to the Court and 3 AHs have legal family issues. During this reporting period, THL has paid a compensation amount of NRs. 1,168,750 to three AHs as the additional payment, which was due from the earlier payment. Hence, the total compensation paid todate is NRs 1,218.976,857,85. For the transmission line component,compensation payment to AP has not yet started. However, there has been a significant progress in the land acquisition process of transmission line component located in Tanahu district during the reporting period. The land acquisition notice for the construction of 56 towers in Tanahu district was published in the national daily newspaper "The Gorkhapatra". The Sub-committee formed under the Compensation Determination Committee (CDC) has beenconducting the field verification of the affected land parcels and also land owners in order to recommend compensation rates of the land to be acquired in Tanahu district. Upon the receipt of the report of the Sub- committee by the end of January 2021, the CDC is expected to determine the values of the land and the structures. Chapter 5 Rehabilitation& Indigenous People Plan Trainings Opportunities: Two vocational training programs of tailoring and beautician particularly in target to affected women, are at the implementation stage. The tailoring training for first batch of 20 female participants shall be conducted in January 2021, whereas the beautician training for equal number of female participants has been planned in March/April 2021depending on the COVID-19 situation. Both training programs will be conducted by Technical Training Center, under Council for Technical Education and Vocational Training (CTEVT).

EmploymentOpportunities: As per the employment record of the Package 2 Contractor as of 30 November 2020,totalof 364 labors have been employed,of which186 are from local communities including 22AP.Similarly THL/PSC/ESMSP have currently 45 employees (36 male and 9 female) from the local communities, out of which 5 employees belong to affected people.

Community Forest Users Groups: During the past monitoring period, ESMSP teamcollected the GIS boundaries of Affected CFUGs Community Forests. The GIS expert is in the process to define digital maps and the livelihood expert will define a dedicated FGD template to identity the use of the forest by the CFUGs and the potential impacts. The CFUGs survey will be undertaken during the next forestry and wild life survey for which the tools to be applied will be presented in the next monitoring report.

Chapter 6 Community Development Plan The target communities of the Community Development Plan are 42 villages indicated in CDS.Though the secondary data on population are available, naming differences between CDS villages and official topographic sources required careful cross checking, which has been implemented in this reporting period. As a result of this checking, a list of 40 villages has been defined along with the community questionnaire and the Focus Group Discussions. The relevant survey started in December 2020 after the lifting of COVID-19 restrictions.

The results of the community survey will allow to define a social profile of target community in the domain of education, occupation, livelihood, demography, WASH, health, use of natural resources, cultural heritage and rural electrification. By the next monitoring period, ESMSP is expected to design a draft CDP framework indicating the priority ranking per each village in each domain of intervention. It will be then possible to start with the micro-planning phase taking also into consideration of the already submitted demands to THL by local communities.

Besides the CDP, THL has been receiving since the beginning of the project a series of spontaneous demands by the communities as channeled by the LCFs. Though a total number of 8demandsrelated to community development (1 for water supply, 2 for road, 1 for irrigation, 1 for community buildings,2 for agriculture center and 1 for skill based training) have been presented to THL, the LCFs have not endorsed any community support program during this reporting period. However, following the approval of THL, two community development works namely Construction of Kitchen Block for Parashar Old Age People Home, Ward No. 5 of and Upgrading of drainage system of the road from Barahi to Bhimsen Chowk (Junction), Ward No. 5 of Vyas are under implementation.

The ESMSP has submitted the proposal of "Scholarship for the students of Shree Shukla Secondary School Rishing Rural Municipality" as the pilot program.Based on the effectiveness of the pilot program, further scholarship programs will be extended to the schools of the affected R/Municipalities.

Chapter 7 GESI Action Plan Majority of the APs are from Janjati communities. Though their participation in the project activities is encouraging, the participation of the women in such activities is limited. Even the women members in the project related local committees are limited, which needs to be improved. The message has been communicated to the relevant bodies to address the GESI action plan of the project. The ESMSP has also submitted proposals of two vocational training programs focusing on women participation.

The ESMSP will deploy a GESI expert from January 2021 for the revision and updating of GESI status along with the implementation plan.

Chapter 8 Establishment & Implementation of GRM THL has established four local consultative forums (LCF’s) as part of the Grievances Redress Mechanism to address the related issues from locals levels in four project affected Rural/Municipalities, namely Vyas Municipality, Bhimad Municipality, Rising Rural

Municipality and Myagde Rural Municipality. In addition, one Public Information Center (PIC) hasbeen established at Bhimad for dissemination of the relevant information of THL.

Regarding the hydropower component, a record has been maintained since the beginning of 2016 by Project Site Office.During the reporting period, THL collected three grievances, including one collective grievance from a large group of the people (51 numbers) representing 2 Community Forest User Groups, 2 Mothers Groups and 1 Youth Club along with the recommendation from the Rishing Rural Municipality.

Regarding thetransmission line component, THL has not yet started collecting of grievances from AP. However, consultations are being carried out to assure the adequate compensation to the AP. THL, the Package 3Contractor along with the Land/house owners jointly went to Land SurveyDepartment to sort out the issues of differences in names of land/house owner noted in the detail survey along the alignment.

Chapter 9 Status of Complaint to OSPF-ADB & CM-EIB Meetings & Disclosure

In order to initiate the problem solving process to resolve the complaint lodged to the OSPF- ADB and CM-EIB, ADB has appointed individual consultants to conduct two independent studies namely(i) Indigenous people socio-cultural-economic study and (ii) Land valuation study. It is expected that the consultants will be mobilized to the field in January 2021 to initiate the studies as proposed.

Chapter 10 Public Consultation, Awareness, Meetings& Disclosure During the reporting period, no mass public consultation meetings with the local communities and stakeholderswas carried out due to the restriction imposed by the GoN to contain the spread of COVID-19. However,two LCF meetings of Vyas Municipality was conducted to decide on the compensation to the non-titled land holders and one LCF meeting of Rishing Rural Municipality was carried for early implementation of the earlier decisions. In addition, five consultative meetings were held with the communities to address the local issues.

Similarly two CDC meetings of and two subcommittee meetings were conducted to facilitate the land acquisition process required for the construction of transmission towers. Another five consultative meetings with local people were held to allow the construction of towers with assurance that affected land will be compensated as per the decision of CDC.

Chapter 11 Other Activities The Asian Development Bank (ADB) undertook a virtual review mission on Loan 2990/Loan 2991–NEP: Tanahu Hydropower Project from 17-27 November, 2020. The mission reviewed the overall implementation status, the environment and social safeguard compliances and the progress on actions agreed during the last review mission.

Chapter 12 Conclusion After lifting of the national lockdown by the GoN, both Package 2 and Package 3 Contractors resumed the construction activities at the site following the operational health and safety protocols. However, the subsequent restriction in movement in and out from the project site due to surges in COVID cases has affected the field activities such as community survey, training etc. which required gathering of the people. Only two community support programs and one scholarship scheme approved in last reporting period are being implemented. However, the substantial progress has been made in the data scrutinizing, finalizing GIS database framework, preparation of the GIS maps and database in different layers. Community survey in 22 settlements was completed in the month of December.

Except for the compensation payment of NRs. 1,168,750 to three AHs, there was no significant progress in the compensation payment. However, there has been a significant progress in the land acquisition process of transmission line component located in Tanahu district. The land acquisition notice for the construction of 56 towers in Tanahu district was published in the national daily newspaper "The Gorkhapatra".

The ESMU/ESMSP continued to conduct consultations and regular follow up meetings with all stakeholders including APs, Mother Groups, Ward Chairperson of affected Wards and affected R/Municipality, district line agencies, and concerned committees. ThreeLCFsmeetings, four consultative meetings and two meetings of CDC and Sub- committee were held during the reporting period.

1 INTRODUCTION

This Social Safeguard Monitoring Report (SSMR) covers the period from July toDecember 2020.The focus of the social reporting remains unchanged from previous Monitoring Report (January-June 2020), this SSMR covers construction works underthe Package 2and Package 3 Contracts.

2 PROJECT STATUS

2.1 PROJECTIMPLEMENTATIONPHASES

Anupdatedoverall schedule of projectis presented in Annex 1. Although this schedule is self- explanatory, the status of the three project phases can be summarized as follows:

Phase 1:Pre-Construction All pre-construction activities of the project including camp facilities and access road have been completed. The compensation payment to the AP and the forest clearance process are underway. Phase 2: Construction Package 1 Contract:Following the concurrence of the Technical Bid Evaluation Report (TBER) by the ADB and the subsequent approval by the THL Board, THL opened the price bids of two Bidders, whose technical bids were declared to be substantially responsive to the requirement of the bidding documents. Rural Electrification:The rural electrification component is being implemented by the Project Management Directorate (PMD) of NEA. The Contractor has completed stringing of 1.5 km 33 kV Line, 12.33 km 11 kV Line with ACSR conductor, 4.375 km LT line with ACSR Conductor and 13 km ABC cable of different sizes for LT Including the complete installation of 24 Nos. of stay set for LT and 137 Nos. of stay set for 11 KV. The construction works of switch yard at both Saranghat and Ghiring are under progress. Phase 3: Operation It will coverthe operation of Tanahu Hydropower Plant and related project facilities including the training of THL operating engineers. This will include environmental and social M&E and implementation of corrective measures as required. The Phase 3 is scheduled for five (5) years including some overlaps with the Phase 2.

2.2 NATIONAL LOCKDOWN IN CONNECTION WITH COVID-19

After the lifting of the national lockdown by the GoN on15 July 2020, the Package 2 Contractor started remobilization of local workers to resume the construction activities at the site. All workers were kept in quarantine for a week after conducting the PCR tests at the site. However, with the nationwide increase in COVID positive cases, particularly in Kathmandu valley, the GoN again imposed the restriction on the mobility of people from 21 August 2020 for three weeks. Though the nationwide restriction again affected the remobilization of the required numbers of workers, the Package 2 Contractor resumed the major undergroundworks under the Contract with the limited available workers. Following the lifting of the nationwide restriction of mobility of people on 15 September 2020, both Package 2 and Package 3 Contractors mobilized the required numbers of workers to the sites. The random PCR tests of 485 employees/workers of THL, PSC, ESMSP and the Package 2 and 3 Contractors were conducted from September to December 2020, of which 18 cases at the site and 5 cases at THL's Kathmandu Office were found to be nCOVID-19 positive at the site. The employees and workers with positive PCR results were kept either at

The employees/workers, with negative test results, have been engaged in the construction activities by both Package 2 and Package 3 Contractors following the Operational Health and Safety Plan as developed by the respective Contractors.

2.3 INSTITUTIONAL ARRANGEMENT FOR SAFEGUARDS IMPLEMENTATION

Tanahu Hydropower Limited (THL) is the executing agency (EA) of the Project. THL has established the Environmental and Social Safeguard Management Unit (ESMU) to address environmental and social safeguard issues. The unit is composed of one evironemntal engineer, one social expert and one communication officer.

The ESMSP has been working directly under ESMU, as the role of the ESMSP has not been formally recognized under the construction contracts with the Contractors. In this reporting period, THL followed up this issue with PSC in order to include the role of ESMSP inthe contractual framework of Package 1.

THL has appointed two external monitors, one on social safeguard and one on environmentalsafeguard inAugust 2020.However, the external mobotors are yet to make inception reporting due to the COVID-19 restriction.

2.4 ENVIRONMENTAL AND SOCIAL MANAGEMENT SERVICE PROVIDER ACTIVITIES (ESMSP)

The international experts of the Consultant, ELC Electroconsult, Italy, could not make any mission due to the international travel restriction.However, the international experts have been supporting from home office in carrying out the planned activities, where possible, in conformity with the restriction imposed by the GON starting from 24 March, 2020.

During this reporting period, the ESMSP carried out the following activities in respect of social safeguard at the site:

- Weekly coordination with International team; - Periodic coordination with THL and Lenders (ADB and EIB); - Audit on Labor standards for the Package 2 Contractor; - Community Surveys for the Community Development Plan in December 2020; - Scholarship Proposal for the students of Shree Shukla Secondary School Rishing Rural Municipality; - Finalization of cadastral map associating AHs profile and land parcels; - Preparation of GIS database maps for different parameters (CFUGs, Survey stations, affected villages, inundated areas); - Assistance to ESMU in grievances recording and follow up both for hydropower and TL components; - Assistance to ESMU in conducting consultations; - Préparation of Pre-Construction Social Audit Matrixfor Package 1;

3 MONITORING AND EVALUATION

The monitoring and evaluation (M&E) of social safeguard activities continue through internal and external monitoring.

3.1 MONITORING

Impact Monitoring shall include the monitoring of baseline conditions and of environmental and social changes that occur in the project affected areas. In this regard,the ESMSP has prepared fresh set of household survey questionnaire (as presented in Annex 2), which will be used for the monitoring purposeas well as for the livelihood restoration planning.

Performance Monitoring shall include the monitoring of the performance on implementation of environmental protection and social mitigation measures. In this regard, the ESMSP has been continuously monitoring the social safeguard related issues including those to be complied by the Contractorin particular to the employment opportunities to the localand affected people in the project activitiesand grievances of the local people within the project area. The ESMU with the assistance of the ESMSP has also continued compliance monitoring on valuation of the land and distribution of the compensation to the AP. External Monitoring: THL has recruited an environmental specialist and social safeguard specialist for the external monitoring of environmental safeguard and social safeguard activities of the Project. Both the specialistsare expected to commence their services in January 2021. On the other hand ADB has also recruited and environmental specialist for the environmental audit.

3.2 DATABASE PREPARATION

In the monitoring framework, the data management is a key component of both impact and compliance monitoring. GIS data base structure is in process.Following database maps(as presented in Annex 3) have been prepared: • GIS database, map development and compilation; • Transfer of AutoCAD files in GIS system; • Incorporation of Social information into cadastral map • Project area layouts (location map); • Land use map of reservoir area; • Affected area geographical coverage map; • Project affected public structure mapping; • Noise, air and water quality sampling site mapping; • Fish survey sampling location map; • Geo referencing and coding of affected HHs information into cadastral database; • Affected area settlement mapping; • Mapping of target villages for community survey; • Project inundation area mapping; • Preparation of hydrology map for A3 booklets; • Spring Survey location map; and • CFUGs map (ongoing).

4 CLEARANCE OF MAJOR CONSTRUCTION WORKS

THL has been following-up with the concerned agencies to get clearance for major construction Works. During the current reporting period, the activities described in the following paragraphs have been carried out.

4.1 FOREST AREACLEARANCE/ USE OF FOREST AREA:

Hydropower Component:THL is required to replace 417 ha of forest land that will be used by the Project.As it is difficult to find such a large area forthe replacement,as per the new directives of GoN, "Procedure with Standard for the Use of National Forests for National Priority Project,2019, THL has requested to theMinistry of Forest and Environment forthe cash compensation.As reported by the Forest Division of Tanahu district, necessary field surveys have been completed and the report is being prepared to determine the compensation of the forest land to be cleared by the project. Upon submission of the report,the Compensation Determination Committee (CDC) chaired by the Chief District Officer shall determine the compensation amount to be paid by the project for the use forest land.

Transmission Line Component:THL has submitted the request to the Department of Forest for the approval of use of 1.97 ha of forest land for the construction of tower pads and felling of 7,923 trees located in 65.49 ha ROW in Tanahu district. THL is also in the process of enumerating the number of trees and determining the required forest area in Chitawan district.

4.2 REPLACEMENT OF STRUCTURES

Hydropower Component:This activity requires extensive consultation with local communities. However, due to the national lockdown and the subsequent restriction of the movement in connection with the COVID-19, the community consultationswas not possible during the reporting period. Transmission Line Component: No public structures will be affected by the TL construction.

4.3 LAND ACQUISITIONAND COMPENSATION STATUS

Hydropower Component:Out of total 559 AHs (417 male and 132 female) of the project, 38 AHs from reservoir area and 9 AHs from Beteni/ Banchare area are yet to be compensated for the loss of their land parcels. In the Reservoir Area, 15 AHshave complained to the ADB/ EIB, 13 AHs have legal family issues and 10 AHs marked on cadastral map cannot be identified. In Beteni area, 6 AHs have lodged complaints to the Court and 3 AHs have legal family issues.

In the reporting period, THL has paid an amount of NRs. 1,168,750.00 to 3 AHs as the additional payment which was due from the earlier payment. Hence, the total compensation paid todate is NRs 1,218.976,857,85. Apart from this, there is nosignificantchange in the status of land compensation of the hydropower component. The status of compensation status in relation to the total affected HHs is shown in Table 4-1, whereas the summary of the compensated amount to the affected HHs are presented in Table 4-2.

Transmission Line Component: The total length of the 220 kV transmission line from Damauli to Bharatpur is 33.612 km, which includesaltogether 94 towers of angle type. The Right-of-Way (RoW) is 30m wide, 15m per side from the centerline of alignment. The TL alignment passes through 16 settlements and 7 Wards of Bandipur, Aanbookhaireni and Devghat Rural Municipalities, Vyas Municipality of Tanahu district and Bharatpur Metropolitan City of Chitwan district. According to the updated RIPP, among the surveyed HHs, 43.1% belongs to Vyas Municipality, 22.1% to Bandipur RM, 5.1% to Aanbookhaireni RM, 4.0 % to Devghat RM and 3.6% to Bharatpur Metropolitan City. In accordance with the updated TL RIPP, the proposed TL will require 1.2 ha of privateland in Tanahu district and 0.29 ha of private land in Chitawan district for tower location.The TL construction will affect253 HHs in total, of which 67 HHs will be affected by permanent land acquisition for tower construction, whereas 186 HHs will be affected due to land use restriction on RoW. Regarding the compensation status in Tanahu district, the Compensation Determination Committee (CDC) of the Tanahu district formed the Sub-committee for the detailed measurement survey (DMS) of the affected landin the last monitoring period.The CDC has published the notice for the land acquisition in the national daily newspaper 'The Gorkhapatra" during this reporting period. The Sub-committee under Assistant Chief District Officerhas beenconductingthe field verification of the affected land parcels and the confirmation of land ownersin order to finalize the data presented in the cadastral map. The Sub-committee will also present the recommendation of the compensation rates and upon the receipt of the report of the Sub-committee, it is expected that the CDC will determine the value of the land and the structures by January 2021. The Package3 Contractor, M/S KEC International Limited, has started construction of tower foundation works, where possible, after due consultation with the local people.A joint meeting was conducted among the project affected land owners and the stakeholders, THL, ESMSP and Contractor’s representative at Sudure of Vyas-14 on 26, 27 and 28 November, 2020 to convince that the compensation would be made as per the decision of the CDC. The land owners agreed to provide the land for the construction of tower foundations at locations of 7E, 3B, 3A, 3/) and AP/2. However, the land acquisition process in Chitawan district is to be initiated soon.

5 REHABILITATION& INDIGENOUS PEOPLE PLAN

5.1 INCOME RESTORATION & REHABILITATION

Training Opportunities:According to the previous SSMR, the ESMSP has been conducting an assessment in terms of training demands starting from December 2019 in order to develop training programs. The assessment is being carried out through the Project Information Centers (PIC) with the coordination of THL. So far 146 AHs (120 male HHs and 26 female HHs) and 38 HHs (28 male HH and 10 female HH) not directly affected by the project responded to the assessment.According to the survey data, the training domains mostly requested by women are Tailoring, Beautician, Computer Operator and Accounting.

In the previous reporting period ESMSP has submitted two proposals for beautician and tailoring trainings with a target of 40 women participants.

For the tailoring training, a commitment letter from 38 female participants had been collected from Bhimad and Rishing in the month of October 2020. However, the proposed training could not be conducted due to the restrictions of COVID-19 at local level and the closure of Technical Training Center, Bhimad, the training provider under CTEVT. After regular follow up and coordination with CTEVT, it was decided that the tailoring training for 20 women couldbe conducted in the month of January2021at PIC of Bhimad-05. The revised training proposal is presented in Annex 5.

On the beautician training, the Technical Training Center, Bhimadrecommended to postpone the training in consideration of COVID-19 situation as the beautician training involves physical contact as well. It has been planned to conduct the proposed beautician training during the month of March/April 2021 depending upon the COVID-19 situation in coming days.

The ESMSP shallverify the feasibility and the modality to conduct the trainings in the remaining domains of preferences progressively during the next reporting period.

EmploymentOpportunities: As per the employment record of the Package 2 Contractoras of 30 November 2020, altogether364labors have been employed,of which186are from local communities including 22AP. In THL/PSC/ESMSP, there are currently 45 employees (36 male and 9 female) from the local communities, out of which 5 are affected people from the project. A list of APs employed in the Project as of December 2020 is presented in Annex 6.

Community Forest Users Groups: During the past monitoring period, ESMSP team collected the GIS boundaries of Affected CFUGs Community Forests. The GIS expert is in the process to define digital maps and the livelihood expert will define a dedicated FGD template to identity the use of the forest by the CFUGs and the potential impacts. The CFUGs survey will be undertaken during the next forestry and wild life survey for which, the tools to be applied will be presented in the next monitoring report.

6 COMMUNITY DEVELOPMENT PLAN

Community Development Plan:As per the CDS included in the PAM, the CDPis to be focused on the domains of education, health, wash, gender balance, social inclusion and local economic development of the communities in the project affected area.

For the identification, coordination and implementation of CDP, LCFs have been formed at each affected municipality and rural municipality. The LCF is chaired by the mayor of the respective municipality/rural municipality with representation from the AHs. The CDS target Municipalities are presented in Table 6-1.

The target communities of the Community Development Plan are 42 villages indicated in CDS.Though the secondary data on population are available, naming differences between CDS villages and official topographic sources required careful cross checking, which has been implemented in this reporting period. As a result of this checking, a list of 40 villages has been defined along with the community questionnaire and the Focus Group Discussions. The relevant survey started in December 2020 after the lifting of COVID-19 restrictions.

The results of the community survey will allow to define a social profile of target community in the domain of education, occupation, livelihood, demography, WASH, health, use of natural resources, cultural heritage and rural electrification. By the next monitoring period,the ESMSP will design a draft CDP framework indicating the priority ranking for each village in each domain of intervention.Accordingly, it will be possible to start with the micro-planning phase taking also into consideration of the already requested demands to THL by local communities and the approved,but waiting for funding, projects at the VDC level.

Community Request of Development: Even in the absence of the CDP, THL has been receiving a series of spontaneous requests by the communities and channeled by the LCF since the beginning of the project. THL has been evaluating and processing the limited requests on the priority basis.

Presently, the requestsof local community are mostly related to development works and are processed from the LCFs. Each affected Municipality and Rural Municipality has a LCF chaired by the mayor of the respective Municipality/Rural Municipality with representation from the AHs. The communities of project area submit the demands of community development works to the LCF and the LCF meetings recommend community development works to THL in a priority basis for implementation.

As of December 2020, THL has received a total number of 57 demands inclusive of 8 demands of the current reporting. Out of the total demands, 23demands have been completed, 8 demands are in process andthe remaining 26 demands are still to be initiated.

Demand of community development registered during the reporting period (July – December 2020) are as follows: • Drinking water for the affected community of Ladan, Aamdaanda and Tutuwa; • Road upgrading of Milan Motor Way for local developmentof Rishing Rural Municipality; • Upgrading of road from Phedi Khola – Ladan – Aamdannda – Tutuwa; • Support to protection of the solar panel station for local development by Rishing Patan Solar Lift Irrigation Canal Users Committee; • Construction of Fulbari Community Building at Gharedi; • Construction of vegetable market Centre at Dhobla settlement; • Construction of shed for- plants and herbs; and • Skill base training for Fulbari Community.

Implementation of Community Requests of Development: Out of three scholarship programs requested in the last reporting period, the ESMSP has recommended the Scholarship Proposal for Students of Shree Shukla Secondary School Rishing Rural Municipality as the pilot program.The school authority has selected10 students including 5 girls of the indigenous community. A draft proposal for proposed scholarship program is presented in Annex 7.Based on the effectiveness of the pilot program, further scholarship programs will be extended to the schools of the affected R/Municipalities

After the formal approval of THL, the following two community development programs are currentlyunder implementation:

1) Construction of Kitchen Block for Parashar Old Age People Home, Ward No. 5 of Vyas Municipality; and 2) Upgrading of drainage system of the Road from Barahi to Bhimsen Chowk (Junction), Ward No. 5 of Vyas.

The progress of the two above listed community development works are attached as Annex 8.

Although no additional community support program was endorsed during this reporting period in the LCF meeting, LCFs have been reiterating for the implementation ofalready endorsed community support programs. Numbers of endorsed community support programs are yet to be processed due to the imposition of the national lockdownby the GoN and further the local level restrictions in the mobility due to COVID-19. However, it is expected that some of the proposed community developments works will be implemented in 2021 depending on the COVID situation.

As the numbers of the demands from localcommunities are increasing, there is a need of dissemination of the information on the THL's available budget for community development programs. In this respect, THL conducted a consultation meeting with all LCF chair-persons to discuss on the availability of the budget for community development program and the implementation modality of such programs. THL informed the available budget of NRs. 20 million for the FY 2020/211, which shall be shared by all affected R/Municipalities. THL advised the LCF chairpersons to rank the demands on the priority basis so that THL with the supports from the ESMSP could implement the recommended community development works within the ceiling of theallocated budget annually.

7 GENDER EQUALITY AND SOCIAL INCLUSION

GESI action plan encourages the involvement of women, disabled people, Dalit and Janajati to participate in public consultation activities/meeting/involvement in order to be part of the decision making process as well as their involvement in economic opportunities in the project areas according to the following targets: • Participatory and Meaningful Consultation, Information Sharing and Grievance Redresses Though the presence of women in the LCFs and in the Community meetings has been encouraged by THL from the beginning of the project,their participation is still limitedas shown in Table 7-1, 7-2 and 7-3 and needs to be improved in the coming days.

However, majority of the APs are from Janjati, the Magar community and their participation in the project activities and consultation is relatively encouraging.

• Facilitating Access to Local Jobs, and Creating Gender and Socially Inclusive Workplaces THL has planned two training programs namely beauticians and tailoring targeting the women participation. THL has also been encouraging local authority and other stakeholders for the participation women in the project related activities.

The ESMSP will deploy a GESI expert from January 2021 for the revision and updating of GESI status along with the implementation plan.The further tools, surveys and plan in this specific sector will be presented in the next monitoring report.

8 ESTABLISHMENT AND IMPLEMENTATIONOFGRM

8.1 GRIEVANCE ADDRESS MECHANISM

Hydropower Component: THL has established four local consultative forums (LCF’s) as part of the Grievances Redress Mechanism to address the related issues from locals level in four project affected Rural/Municipalities, namely Vyas Municipality, Bhimad Municipality, Rising Rural Municipality and Myagde Rural Municipality. OnePublic Information Center (PIC)has also been established at BhimadMunicipality to act as a bridge between the community and THL. All PIC are facilitated and supported with two staffs to record grievances of the APs at the local level.

TL Component:The RIPP has made a provision of GRM in following four stages:

Stage 1:Complaints of APs/HHs and community on any aspect of compensation, relocation, or unaddressed losses of private and community property shall in first instance be settled verbally or in written form in the field based project office. The complaint can be discussed in a meeting between the PAPs/HHs and the Land Acquisition and Rehabilitation Cell of the project. This cell will be created within the ESMU with vertical linkage with THL. The Cell will resolve the issues at the field level in close coordination with the construction Contractor and APs within 7 days of the received of the grievances. If the complaint remained unresolved at field level the ESMSP will forward the complaint to the second level of GRM.

Stage 2:If the grievances are not solved at the local level within 7 days, the ESMU will take over the case. The ESMU supported by the ESMSP will made field observation and discuss the issues with concerned R/Municipality and APs/HHs.Those issues thus brought to the ESMU will be resolved within 15 days from the date of the complaint received. The chief of ESMU along with the Social Safeguard Specialist and Public Relation Officer of ESMSP will play active role to resolve the issues.

Stage 3:If no understanding or amicable solution reached or no response from the ESMU, the PAPs/HHs or community can appeal to the CDC, particularly if the issue is related with loss of private assets and compensation. As a formal body with legal standing, all other 15 | P a g e

relevant complaints/ grievances not resolved at earlier stages, may also be registered with CDCs for timely resolution. While lodging the complaint, the PAPs/HHs and community shall produce documents to support their claim. The CDC after close coordination with THL will provide the decision within 30 days of the receipt of the appeal.

Stage 4:If the PAPs/HHs and local community are not satisfied with the decision of CDC or in absence of any response of its representatives, within 35 days of the complaint, the PAPs/HHs and community may submit its case to the district court. The decision of the court shallbe acceptable to both Parties.

8.2 IMPLEMENTATION OF GRIEVANCES

Regarding Hydropower components a grievances record has been maintained since the beginning of 2016 by the LCFs and the Project Site Office.The summary of complaints including both grievances and the demands is updated in Table 8-1below.

A large group of the people (51 numbers) representing 2 Community Forest User Groups, 2 Mothers Groups and 1 Youth Club presented 35 points demands to the THL along with recommendation from the Rishing Rural Municipality on October 06 2020. The Status of 35 points demands is presented in Annex9.

Regarding thetransmission line component, THL has not yet started collecting of grievances from AP. However, consultations are being carried out to assure the adequate compensation to the AP. THL, the Package 3Contractor along with the Land/house owners jointly went to Land SurveyDepartment to sort out the issues of differences in names of land/house owner noted in the detail survey along the alignment.

9 STATUS OF COMPLAINT TO OSPF (ADB)&CM (EIB)

A group of project affected people in the reservoir organized as “the Directly Inundation Affected Peoples Collective Rights Protection Committee” (the Complainants) supported by the Indigenous Women’s Legal Awareness Group (INWOLAG) and the Community Empowerment and Social Justice Network (CEMSOJ) lodged the complaint to the ADB and EIB with the specific concern on the compensation rate. The complaint, received by the Office of the Special Project Facilitator (OSPF) on 12 February 2020, requested problem- solving under the ADB’s Accountability Mechanism Policy. The OSPF submitted Final Review and Assessment Report prepared in English, Nepali and Magar languages on 19 November 2020. The report has proposed a course of actions so as to resolve the complaint through the problem solving process by conducting independent studies to fill information gaps and/or clarify difference of positions of stakeholders and to continue dialogue among stakeholders.

The proposed two independent studies include (i) indigenous people socio-cultural-economic study and (ii) land valuation study. It is expected that the individual consultants will be mobilized to the field in January 2021 to initiate the studies as proposed. THL has made a commitment to support the problem solving process so that the complaint could be resolved as early as possible.

10 PUBLIC CONSULTATION, AWARENESS, MEETING & DISCLOSURE

The ESMU/ESMSP continued to conduct the meetings and consultations, as possible, with the stakeholders during the reporting period from July to December 2020. However, themeetings/consultations could not take place on a regular basis in the month of August and September 2020 due to the local level restriction of COVID-19. The staff mobility was

During this reporting period, three LCFsmeetings, five consultation meetings were conducted for the hydropower component. The minutes of the meeting enclosed as Annex 10 are summarized in Table 10-1.

Similarly, numbers of consultation meetings were also held to convince the people to allow the construction of the transmission tower with the assurance that they will be adequately compensated as per the rules and regulation of Government of Nepal. 11 OTHER ACTIVITIES

11.1 VIRTUAL REVIEW MISSION OF ADB

The Asian Development Bank (ADB) undertook a virtual review mission on Loan 2990/Loan 2991–NEP: Tanahu Hydropower Project from 17-27 November, 2020. The main objectives of the mission was to review the overall implementation status, the environment and social safeguard compliances and the progress on actions agreed during the last review mission.

Except for the unavoidable severe delay in the conclusion of the Package 1 Contract, the mission noted the progress on other awarded Contracts of the project. It was agreed to meet the following deadlines to conclude the procurement of Package 1:

- Approval of Financial Bid Evaluation Report by ADB 15 December 2020 - Contract Signing by 28February 2021

The mission requested THL to submit the updated RIPP for transmission line component as early as possible and toprioritize in resolving pending issues related to safeguards- especially the complaints related to land acquisition Asthe project is not likely to complete within its original closing period, it was advised that THL shall undertake thedetail analysis of additional time and funds (if required) and discuss with the Government of Nepal, ADB, EIB and JICA.

12 CONCLUSION

After lifting of the national lockdown by the GoN, both Package 2 and Package 3 Contractors resumed the construction activities at the site following the operational health and safety protocols. However, the subsequent restriction in movement in and out from the project site due to surges in COVID cases has affected the field activities such as community survey, 22 | P a g e

Only two community support programs and one scholarship scheme approved in last reporting period are being implemented. However, the substantial progress has been made in the data scrutinizing, finalizing GIS database framework, preparation of the GIS maps and database in different layers.This will enable to have consistent data and ease in preparing MIS in future. Community survey in 22 settlements was completed in the month of December.

Except for the compensation payment of NRs. 1,168,750 to three AHs, there was no significant progress in the compensation payment. In respect of the complaint lodged by a group of project affected people in the reservoir organized as “the Directly Inundation Affected Peoples Collective Rights Protection Committee” (the Complainants) The OSPF submitted Final Review and Assessment Report prepared in English, Nepali and Magar languages on 19 November 2020. The report has proposed a course of actions so as to resolve the complaint through the problem solving process by conducting independent studies to fill information gaps and/or clarify difference of positions of stakeholders and to continue dialogue among stakeholders.

However, there has been a significant progress in the land acquisition process of transmission line component located in Tanahu district. • Assess resettlement efficiency, effectiveness, impact and sustainability, drawing lessons as a guide to future resettlement policy making and planning; and Ascertain whether the resettlement entitlements were appropriate in meeting the objectives, and whether the objectives were suited to AP conditions.

• Monitor the progress and status of Resettlement and Indigenous People Plan (RIPP) implementation with regard to achieving objectives of the ADB’s safeguard policy on involuntary resettlement and indigenous peoples. 2. The scope environmental external monitoring: The Consultant has been engaged under the project to conduct third party (external) monitoring on mitigation and monitoring activities on the physical and biological environmental components. The consultant is expected to conduct site visits twice a year during project construction period, to conduct third party monitoring of implementation of the EMP by the Contractor and Supervision by the Environmental and Social Management Service Provider (ESMSP). The Specific tasks include but are not limited to: (i) participating in field inspections together with onsite environment engineers of the contractors and THL’s environment management unit officers, or undertake independent field inspections, as appropriate, to verify the EMP implementation. (ii) conducting qualitative monitoring on EMP implementation status and additional quantitative environmental monitoring, if necessary, to verify that findings reported in THL’s environmental monitoring reports are accurate, and to confirm if the project in compliance with the EMP, the SPS 2009 and Nepal legislated standards. (iii) preparing periodic environment monitoring verification reports, which should verify the accuracy of the THL’s environmental monitoring reports, confirm the project’s compliance with the EMP, the SPS and Nepal legislated standards, identify any environment related implementation issues or problems, and, as needed, reflect these in a corrective action plan agreed with the THL; (iv) making recommendations to resolve any issues or problems on implementing the EMP and providing advice on ensuring compliance with SPS 2009 and Nepal legislated standards. (v) Submitting periodic monitoring reports (EEMR) to THL and ADB with quality acceptable to ADB on regular basis during project implementation period, and final environmental evaluation report addressing the project’s overall environment compliance.
