The group of nominated persons will prepare dossiers which will be put before the council. Rules regarding the conduct of the groups will be published shortly. Montmaurin Village newsletter – n¡1 – January 2015 – page 3 The Quarry Case : the position of the local council (03/01/2015) Mme the Mayor addressed the council : Ç This question of where we stand had already been put to the council meeting of 13 April 2014. The proposal did not get the consent of the old majority. Therefore I am tabling this question particularly since the population of Montmaurin is waiting for a clear stand to be taken by the new council. A brief history of the case might be helpful for the whole council : M. Gaspin, in his position as mayor, signed on the 17 April 2007 a concession allowing the operating of a limestone quarry by the DRAGAGES GARONNAIS and the installation of a crushing and screening plant situated in the commune of Montmaurin at Coume day Hourquat Garriga and GaŸsère. A concession to last for 30 years for the extraction of 150.000 tonnes per year of limestone over an area of 8 hectares 71 a and 5 ca of village forest. During and after the public enquiry in March / April 2008 and right up till now, the residents, various associations, local and scientific figures were mobilised against the working of this quarry. Thus : - The department assembly of the Conseil General de la Haute-Garonne confirmed that it was not in favour of the project (28 January 2009) - The association Entre Save et Seygouade lodged a request with the Administrative Tribunal in June 2009 asking for the cancellation of the prefectural order of 10 April 2009 - The Association ADAQ-VIE did the same in September 2009 - The association NATURE COMMINGES lodged an intervention report with the Administrative Tribunal of Toulouse in February 2010, having voted to do this at their AGM in February - Occupation of the site between 23 March and the end of July 2010 : before and after the precautionary archaeological diagnosis carried out by INRAP (June/July 2010) - Motions in the full Assemblies of the Conseil RŽgional de Midi-PyrŽnŽes and the l’Académie des Sciences – Inscriptions Belles Lettres de Toulouse, … - On 22 June 2011 a decree by the prefect brought an order for the carrying out of archaeological excavations, the cost to be born by the developer after a medieval dwelling was found on the project site - 24 October 2013 : notification of the cancellation by the Administrative Tribunal of Toulouse of the Authorisation given by the prefect. For seven years the request lodged by associations asking for the cancellation of the prefectoral order of April 2009, with their scientific reports and studies of the land have been leading to the justified conclusions of the Toulouse Court of first instance. On the basis of these various documents provided for the Tribunal and which we heard about, I ask the Montmaurin Council once again to state its position on this case which will impact not only on the daily life of the residents of Montmaurin and beyond, but will destroy for ever the natural, archaeological and historic heritage of the Montmaurin sites. The risk of accidents, increased because of surrounding roads not adapted for heavy traffic brought about by quarrying, were also taken into account by the judge. È Mme the Mayor wished to put the question to debate by the council. At this meeting M. AMIEL showed quite clearly that he was in favour of the quarry. M. BAQUE was astonished at M. Amiel’s position : this definite position was not that held during the election campaign in recent weeks !! Citizens will realise that there is ambiguity ! Mme the Mayor called for councillors to vote on the motion against the quarry in the village : Number of voters : 10 Number of votes cast : 10 Votes : In favour of the motion against the quarry : 6 ; Against the motion : 3 et 1 Abstention. The council adopts the absolute majority opinion against the quarry project in the commune of Montmaurin. Montmaurin Village newsletter – n¡1 – January 2015 – page 4 CARTE COMMUNALE : Stance of the municipal council (03/01/2015) Mme the Mayor revealed that Ç the numerous interventions by village residents during the public enquiry from 27 May to 27 June 2014 were not taken into account in the planning document and the case put forward by the Association Entre Save et Seygouade with the Administrative Tribunal of Toulouse on 1 December 2014 and the mail from the prefectoral services of 25 November 2014 show the incoherences and gaps in the carte communale case”. Mme the Mayor asked the council to discuss and to cancel this planning document in these terms : Ç The case of the carte communale previously approved by the old council date 2 October 2014, after a public enquiry (from 27 May 2014 to 27 June 2014), - Considering that the various interventions by residents of Montmaurin during the public enquiry have not been sufficiently taken into account when it was approved ; - Considering the request of the Association Entre Save et Seygouade lodged with the Administative Tribunal in December 2014 asking for cancellation following incoherences resulting from changes between the document submitted to the public enquiry and the approved document, following the omissions and the absence of precautions linked to preservation of the SSSI type 1 and the historic and archaeological heritage of Montmaurin, and equally following the excessive power with conflicts of interest by municipal councillors taking a stand ; - and in the light of the letter from M. le Sous-PrŽfet of Saint Gaudens, Jean-Luc Brouillou of 25 November 2014, a copy of which has been given to each councillor, refusal to accept the prefectoral order on the case because of incoherences. The law ordering the reinstatement of the previous planning document, applying article L.121-8 of the Planning Code, RNU (rules for national town planning) is immediately applicable to the commune of Montmaurin. È During the sitting, M. AMIEL persisted in the plan to establish the carte communale and the related taxes, amongst which is the conversion tax which he wanted to put in place with a council vote on November 2 2014. M. BAQUE expressed regret that such a planning document forces the village to vote for extra-taxes largely imposed on tax payers. So, Mme the Mayor proposed that the council vote for the cancellation of the Carte communale – a document validated by the council on 2/10/2014.
