Constantin, Boniface a French theologian, belonging to the Jesuit order, was born at Magni (near Geneva) in 1590, was professor of rhetoric and philosophy at Lyons, and died at Vienne, Dauphine, November 8, 1651. He wrote, Vie de Cl. de Granger Eveque et Prince dae Geneve (Lyons, 1640): — Historiae Sanctorum Angelorum Epitome (ibid. 1652), a singular work upon the history of angels. Relationship Between Church and State, Canon Law and Civil Law: Problems and Prospects
IUSTITIA Vol. 9, No. 1 (June 2018) Page: 11-50 RELATIONSHIP BETWEEN CHURCH AND STATE, CANON LAW AND CIVIL LAW: PROBLEMS AND PROSPECTS Paul Pallatir First of all the author examines the Lateran Pacts between the Holy See and the Italian State which constitutes the foundation for the relationship between the Catholic Church and the State even in modern times. Then an overview of the teaching of Vatican II on the autonomy and independence of the Church and civil society in their respective fields is presented, indicating the possibility and manner of observing canon law in democratic, theocratic, confessional, secular, atheistic or totalitarian states. After attempting a compendium of the canons on the theme, the final sections are dedicated to highlight the principles and directives provided by the Codes of canon law regarding the relationship between canon law and civil law, followed by the exemplification of three particular themes: marriage, temporal goods of the Church and penal law. 1. Introduction The Christian faithful, including cardinals, bishops, priests, religious and lay people, are at the same time members of the Church and citizens of a nation. Hence their life and activities are regulated by two orders, canonical and civil, deriving rights and obligations from both. Hence the peaceful life of Christian citizens in any country depends on the harmonious and equilibrated application of canon law and civil Prof. Paul Pallath holds doctorate in Eastern canon law from the Pontifical Oriental Institute in Rome and in Latin canon law from the Pontifical Lateran University. From 1995 to 2011 he rendered service as an official of the Congregation for Divine Worship and the Discipline of the Sacraments and then for two years as an official of the Tribunal of the Roman Rota. -

Hembury, Devon). c.3500-3000 - First appearance of long barrows and chambered tombs; at Hambledon Hill (Dorset), the primitive burial rite known as "corpse exposure" was practiced, wherein bodies were left in the open air to decompose or be consumed by animals and birds. c.3000-2500 - Castlerigg Stone Circle (Cumbria), one of Britain's earliest and most beautiful, begun; Pentre Ifan (Dyfed), a classic example of a chambered tomb, constructed; Bryn Celli Ddu (Anglesey), known as the "mound in the dark grove," begun, one of the finest examples of a "passage grave." c.2500 - Bronze Age begins; multi-chambered tombs in use (ie. West Kennet Long Barrow) first appearance of henge "monuments;" construction begun on Silbury Hill, Europe's largest prehistoric, man-made hill (132 ft); "Beaker Folk," identified by the pottery beakers (along with other objects) found in their single burial sites. c.2500-1500 - Most stone circles in British Isles erected during this period; pupose of the circles is uncertain, although most experts speculate that they had either astronomical or ritual uses. c.2300 - Construction begun on Britain's largest stone circle at Avebury. c.2000 - Metal objects are widely manufactured in England about this time, first from copper, then with arsenic and tin added; woven cloth appears in Britain, evidenced by findings of pins and cloth fasteners in graves; construction begun on Stonehenge's inner ring of bluestones. -

D’AVRAY Fellow of the British Academy Abstract: Papal law is known from the late 4th century (Siricius). There was demand for decretals and they were collected in private collections from the 5th century on. Charlemagne’s Admonitio generalis made papal legislation even better known and the Pseudo-Isidorian collections brought genuine decretals also to the wide audience that these partly forged collections reached. The papal reforms from the 11th century on gave rise to a new burst of papal decretals, and collections of them, culminating in the Liber Extra of 1234. The Council of Trent opened a new phase. The ‘Congregation of the Council’, set up to apply Trent’s non-dogmatic decrees, became a new source of papal law. Finally, in 1917, nearly a millennium and a half of papal law was codified by Cardinal Gasparri within two covers. Papal law was to a great extent ‘demand- driven’, which requires explanation. The theory proposed here is that Catholic Christianity was composed of a multitude of subsystems, not planned centrally and each with an evolving life of its own. Subsystems frequently interfered with the life of other subsystems, creating new entanglements. This constantly renewed complexity had the function (though not the purpose) of creating and recreating demand for papal law to sort out the entanglements between subsystems. For various reasons other religious systems have not generated the same demand: because the state plays a ‘papal’ role, or because the units are small, discrete and simple, or thanks to a clear simple blueprint, or because of conservatism combined with a tolerance of some inconsistency. -

TT ΤΠΉ THE EXCEPTION of satisfaction, no Reformation issue concern- W ing the sacrament of penance was so hotly debated as integrity of confession, the requirement that one must make a complete confes sion. In part, the heated discussion was related to the role integrity played in Catholic penitential life. Speaking of the Catholic practice just prior to the Reformation, T. N. Tentler contends that 'to exagger ate the importance of completeness seems hardly possible."1 The Fourth Lateran Council (1215) gives the classical formulation: the faithful "must confess all their sins ... to their own priest at least once a year."2 The Protestant historian of penance, H. C. Lea, calls this "the most important legislative act in the history of the Church,"3 partly because a legislated confession is not free. The Council of Flor ence (1438-45) modified the Lateran decree; integrity is defined as "all the sins one remembers."4 Luther objects that even this is an impossible task, like "counting the sands," endlessly numbering and weighing sins, detailing their circumstances, thus leading to torments of conscience, ending in de spair.5 Though Luther himself retains the catalogue of sins as an aid to the examination of conscience,6 as does Melanchthon,7 both cite Psalm 19:13: "Who knows how often one sins?"8 No command exists for 1 Sin and Confession on the Eue of the Reformation (Princeton, Ν J.: Princeton Univ., 1977) 109. -

Although the territory of today´s Moravia (eastern part of the Czech Republic) and Slovakia came into contact with Christianity already at the end of antiquity, the more intensive Christianization of these lands took place only from the 8th century, when this territory was settled by Slavs. Mis- sionaries from the Frankish Empire, from the territory of Istria, Dalmatia and northern Italy came here. Domestic Slavic elites started to convert to Christian- ity as from the 9th century. For them, Christianity became a means of recogniz- ing their social status externally and allowed them to integrate with the more culturally advanced Christian world. Archaeological findings (e.g. crosses and captorgs, plaques and bells from Bojná, objects of secular character), written sources, sacral architecture and burying methods testify to the existence of Christianity in the territory of today´s Moravia and Slovakia, especially in cen- ters of the power. Signed: Date: 3 Abstract In the history of crime and punishment the prisons of medieval London have generally been overlooked. This may have been because none of the prison records have survived for this period, yet there is enough information in civic and royal documents, and through archaeological evidence, to allow a reassessment of London’s prisons in the later middle ages. This thesis begins with an analysis of the purpose of imprisonment, which was not merely custodial and was undoubtedly punitive in the medieval period. Having established that incarceration was employed for a variety of purposes the physicality of prison buildings and the conditions in which prisoners were kept are considered. This research suggests that the periodic complaints that London’s medieval prisons, particularly Newgate, were ‘foul’ with ‘noxious air’ were the result of external, rather than internal, factors. Using both civic and royal sources the management of prisons and the abuses inflicted by some keepers have been analysed. This has revealed that there were very few differences in the way civic and royal prisons were administered; however, there were distinct advantages to being either the keeper or a prisoner of the Fleet prison. Because incarceration was not the only penalty available in the enforcement of law and order, this thesis also considers the offences that constituted a misdemeanour and the various punishments employed by the authorities. -
