Qualms About Public Meaning Originalism
TONE DEAF TO THE PAST: MORE QUALMS ABOUT PUBLIC MEANING ORIGINALISM Jack Rakove* With some apologies for a vast degree of oversimplification, let us stipulate that there are two main forms of originalism. One is known as “semantic” or “public meaning” originalism. Its leading advocates include Lawrence Solum, Keith Whittington, and Randy Barnett (professional friends, all). The leading premise of semantic originalism is that the meaning of the constitutional text—or, more specifically, of its individual clauses—was fixed at the moment of its adoption. Under this view, the goal of constitutional interpretation is to recover that original meaning, and the best way to do that pivots on reconstructing how an informed reader, whether a citizen or a judge—and using the best linguistic resources available—would have understood the language in question. This approach does not assume that the Constitution’s entire content was fixed at the point of adoption. Ample room is left for the subsequent construction of additional meanings, in places where the Constitution is silent or ambiguous; originalists can differ—and differ substantially—over where to draw the boundaries between the realms of fixation and construction.1 In this approach, evidence of the political intentions and purposes of the adopters of the text—whether Framers or ratifiers—appears to have relatively little if any bearing on the Constitution’s meaning. The statements they made in debate matter not as evidence of political intention, but rather as additional linguistic clues to the semantic meaning of disputed terms. The second form of originalism involves an approach that academic historians naturally favor. -
Adam Smith at the Constitutional Convention

Peterson* Abstract Adam Smith is not referred to in the records of the U.S. Constitutional Convention of 1787, but he indirectly influenced the substance of the framers’ decisions on several matters, especially the Establishment and Free Exercise Clauses of the First Amendment. We argue that good grounds exist for the founders’ failure to make explicit reference to Smith during the debates in Philadelphia: he had alienated political leaders in Britain and the United States. Nevertheless, his hand is present in the instigation of the American War for Independence, whether the cause be taken as taxes or the Quebec Act 1774, and in British plans for after the war. Smith’s intellectual heritage—and that of the Scottish Enlightenment—defines the positions of the leading constitutional thinkers concerning religion: James Madison and Thomas Jefferson. Madison’s Memorial and Remonstrance and Jefferson’s 1802 letter to the Danbury Baptist Association (“wall of separation between church and state”) carry Smith’s theme to its logical end, not just as political rhetoric but as a matter of principle. The invisible hand of Adam Smith did more to shape the Establishment and Free Exercise Clauses than those of, for instance, Richard Hooker, Roger Williams, or James Burgh. * Iain McLean: Nuffield College, Oxford OX1 1NF, UK, [email protected]. From his student days he had been an avid book collector. He formed relationships with antiquarian booksellers throughout the north of England. His interests were eclectic but focused on English literature of the 17th and 18th centuries. Several of my father’s books have survived in the present collection. The publications in this series should reflect studies of both religion in society and society in religion. This opens up a discursive horizon for a wide range of themes and phenomena: the politics of local, national and transnational religion; tension between private conviction and the institutional structures of religion; economical dimensions of religion as well as religious motives in business endeavours; issues of religion, law and legality; gender relations in religious thought and practice; representation of religion in popular culture, including the mediatisation of religion; the spatialisation and temporalisation of religion; religion, secularity, and secularism; colonial and post-colonial construction of religious identities; the politics of ritual; the sociological study of religion and the arts. SMITHt It is not usual for legal scholars working in establishment clause jurisprudence-and it is especially not usual for me-to say nice things about what the Supreme Court has done to the subject. But that is what I mean to do today. I don't want to be too agreeable or cheerful, though, so this time, although commending the Court, I am going to take issue with the commentators. More specifically, I want to praise a recent development that most commentators seem to deplore-namely, the Court's recent practice of using the slightly disreputable doctrine of standing as a device to avoid deciding Establishment Clause cases on the merits. Thus, in Elk Grove Unified School District v. Newdow,' the Court used a dubious "prudential" standing doctrine to avoid deciding whether the words "under God" in the Pledge of Allegiance were unconstitutional. -

While ‘Freedom of Religion’ bills contend to represent the power of the Hindu nationalist cause, these pieces of legislation refl ect both the political mobility of Hindutva as a symbolic discourse and the prac- tical limits of its enforcement value within Indian law. This resurgence, how- ever, highlights the enduring nature of questions regarding the quality of ‘conversion’ as a ‘right’ of individuals and communities, as well as reigniting the ongoing battle over the line between ‘conversion’ and ‘propagation’. Ul- timately, I argue that, while the politics of conversion continue to represent a decisive point of reference in debates over the quality and substance of reli- gious freedom as a discernible right of Indian democracy and citizenship, the widespread negative consequences of this legislation’s enforcement remain to be seen. -
Utilitarianism in the Age of Enlightenment
UTILITARIANISM IN THE AGE OF ENLIGHTENMENT This is the first book-length study of one of the most influential traditions in eighteenth-century Anglophone moral and political thought, ‘theological utilitarianism’. Niall O’Flaherty charts its devel- opment from its formulation by Anglican disciples of Locke in the 1730s to its culmination in William Paley’s work. Few works of moral and political thought had such a profound impact on political dis- course as Paley’s Principles of Moral and Political Philosophy (1785). His arguments were at the forefront of debates about the constitution, the judicial system, slavery and poverty. By placing Paley’s moral thought in the context of theological debate, this book establishes his genuine commitment to a worldly theology and to a programme of human advancement. It thus raises serious doubts about histories which treat the Enlightenment as an entirely secular enterprise, as well as those which see English thought as being markedly out of step with wider European intellectual developments. niall o’flaherty is a Lecturer in the History of European Political Thought at King’s College London. In the popular perception the distinction between social and cultural geography is not very clear. The idea which has gained popularity with the geographers is that social geography is an analysis of social phenomena expressed in space. When the term emerged within the Anglo-American tradition during the 1960s, it was basically applied as a synonym for the search for patterns in the distribution of social groups. • Social geography is the branch of human geography that is most closely related to social theory in general and sociology in particular, dealing with the relation of social phenomena and its spatial components. Though the term itself has a tradition of more than 100 years,[ there is no consensus • However, the term ‘ social phenomena’ is in its developing stage and might be interpreted in a variety of ways keeping in view the specific context of the societies at different stages of social evolution in the occidental and the oriental worlds. The term ‘social phenomena’ encompasses the whole framework of human interaction with environment, leading to the articulation of social space by diverse human groups in different ways. • The end-product of human activity may be perceived in the spatial patterns manifest in the personality of regions; each pattern acquiring its form under the overwhelming influence of social structure. Besides the patterns, the way the social phenomena are expressed in space may become a cause of concern as well. -

However, Islam like all other religions is multivocal and it has strong theorethical elements that can also work for a basis of a democratic polity. Throughout the Muslim world there are certain countries that achieved a considerable level of democratization. It is only the Arab world, not the Muslim world, that so far represents a complete failure in terms of democratic transition. The failure of Arab world should be attributed to more political reasons, such as oil economy and the rentier state model than to Islam. Lack of international support for pro-democracy movements in the region, under the fear that they might move towards an Islamist political system is also an important factor in the democratic failures in the region. However, democratic record of Turkey’s pro-Islamic Justice and Development Party challenges these fears. With the international attention it attracts, particularly from the Arab world, Turkish experience provides a strong case for the compatibility of [ 121 ] democracy and Islam.
