Delegations: Brant Burrow Re: Counties' ED-19 Site Mr. Burrow spoke to the Counties Waste Disposal Site ED-19 and negotiations regarding the possible sale of the site. Mr. Burrow advised he had attended a public meeting held by the Counties in Spencerville, noting people living near the facility are upset. Mr. Burrow feels thesite should be considered a public asset as it is paid for with residents' taxes. Mr. Burrow does not think the Counties should sell the site as it was established to meet possible future needs, also voicing interest as to where the Regular Council meeting minutes dated February 27, 2017.Page 1 of 4 Page 4 of 120 AGENDA ITEM #4.1. proceeds will go if the site is sold. Mr. Burrow commented on his surprise that the Township did not have representation at the public meeting or that a staff report had not crossed the table, suggesting maybe the background was not known.

Mayor Pickard responded to some of Mr. Burrow's comments, advising the concerns that Mr. Burrow He advised that the Counties is still paying on a regular basis for studies. Mayor Pickard also commented that there are a series of implications from the Province, noting if the time does ever come (to sell ED-19), it will not be a mega dump, as it would be too expensive. Mayor Pickard noted the costs for dumping have gone up and this may make it more viable. The Mayor advised that discussions among councils are occurring and counties will be taking this matter to the councils within their county.

Johanna Pietersma, 3404 Parslow Road Ms. Pietersmal referred to her question at the February 13th Council meeting regarding the ingredients of the chemical used as a dust suppressant. Staff provided advised research on the ingredients had been done and provided this information verbally, but will email Ms. Pietersma a summary of the ingredients.

Ms. Pietersma asked if the Counties would be spraying this year. Mayor Pickard advised the Counties will proceed this spring, noting not all roads are sprayed every year. Ms. Pietersmal asked if Elizabethtown-Kitley Council has given that spraying their blessing, and if it was a blanket approval.

1. INTRODUCTION

This Annual Water Quality Report is for the period from January 1st to December 31st, 2016 and includes reporting for both the municipal drinking water treatment and distribution systems that the City of Brockville owns and operates and the water distribution system that the Township of Elizabethtown-Kitley owns and the City of Brockville operates.

This report contains three different reports required for the City of Brockville and the Elizabethtown-Kitley Drinking Water Systems:  Section 11 Annual Report, as per Section 11 of O. Reg. 170/03  Summary report as per Schedule 22 of O. Reg. 170/03  Summary of the raw water values that were submitted to the Ministry of the Environment and Climate Change under O. Reg. 387/04

This annual report is available to the public at no charge. Users of this drinking water system have been notified that this annual report is available by placing a notice on the City of Brockville’s website and water billing inserts. 2. LEGISLATED REQUIREMENTS

2.1 Drinking-Water Systems Regulation (O. Reg. 170/03)

Under Schedule 22 of the Drinking Water Systems Regulation (O. Reg. 170/03), Summary Reports for Municipalities, annual reports to the owners of large municipal residential systems and small municipal systems are required. The summary report must be submitted no later than March 31st to members of municipal council. The contents must list the requirements of the Safe Drinking Water Act, 2002, the regulations, the system’s approval and any order that the system failed to meet at any time during the reporting period covered, specify the duration of the failure, and the measures taken to correct the failure.

In addition, the report must include a summary of the quantities and flow rates of the water supplied during the period covered by the report, including monthly averages, maximum daily flows and daily instantaneous peak flows. The summary must be compared to the rated capacity and flows provided in the system’s Municipal Drinking Water Licence.

The City of Brockville is the Owner of the Water Treatment Plant, trunk and local water distribution systems, and the City of Brockville is the Operating Authority for the Township of Elizabethtown-Kitley’s water distribution system.

2.2 Summary of Regulatory Requirements

Acts and Regulations

Regulated systems must meet the requirements of Ontario's Safe Drinking Water Act, 2002 and its regulations. Most notably, the Drinking Water Systems Regulation sets out treatment and testing requirements for all categories of regulated water systems, including small non-municipal and seasonal operations.

In the Part Two Report of the Walkerton Inquiry, Justice O'Connor recommended that the Ontario government enact a Safe Drinking Water Act, 2002 to deal with matters related to treatment and distribution of drinking water. As articulated by Justice O'Connor, the purpose of the Safe Drinking Water Act, 2002 is to gather in one place all legislation and regulations relating to the treatment and distribution of drinking water.

3. ANNUAL WATER QUALITY SUMMARY FOR 2016

The City of Brockville’s Water Systems Division is responsible for the Brockville Drinking Water System under O. Reg. 170/03 including water treatment plant, trunk water distribution system (elevated storage, reservoirs, booster stations) and local water distribution systems. Staff’s primary responsibility is water treatment and distribution in compliance with all applicable legislation and municipal drinking water licences and drinking water works permits. Routine water quality testing and continuous monitoring of water quality and quantity is conducted to ensure compliance. All data from SCADA, process control point data, in-house laboratory results and external laboratory results are all captured in a WaterTrax data management system.

3.1 Water Quality Data

Raw and treated water is sampled and tested for chemical, physical and microbiological parameters in accordance with the requirements of O. Reg. 170/03 and individual municipal licences and permits. Sampling is also conducted in the distribution system primarily for bacteriological indicators and evidence of sustained chlorine residuals. Enhanced sampling programs are also defined by the Water Systems Division, and testing procedures followed and where necessary submitted to external accredited laboratory for analysis. This level of water quality monitoring ensures public health and public confidence in the water supply.

The majority of analysis is conducted by an external accredited laboratory, with some specialized analysis contracted to other accredited laboratories. In accordance with Schedule 16 of O. Reg. 170/03, all required notifications of adverse water quality incidents are provided to the Spills Action Centre and Medical Officer of Health.

4.1.1 Water Treatment Plant

The City of Brockville’s Water Treatment Plant is a Class III direct filtration facility located at 20 Rivers Avenue, located on the St. Lawrence River and serves the City of Brockville (population 22,000), and a portion of the Township of Elizabethtown-Kitley (population 350). The Water Distribution System is separated into a Trunk Water Distribution System and Local Water Distribution System. The Trunk WDS is a Class III System (Certificate #3811) and the Local

System is a Class II System (Certificate #2193). A 900 mm raw water intake pipe equipped with zebra mussel control lies on the bottom of the St. Lawrence River extending 300 metres off shore at a depth of 10.5 metres. The treatment process has a design maximum flow rate of 36.4 ML/d and is composed of a number of sub-units:

 low lift pumping station  coagulation and flocculation using polyaluminum chloride (PAC)  pre- and post-filter disinfection with chlorine gas  two granular activated carbon filters  fluoride addition  reservoir and high lift pumping station  final treated water UV disinfection  process (filter backwash residuals) wastewater treatment.

4.1.2 Treatment Chemicals Used

All chemicals used in the operation of the drinking water system meets all applicable standards set by both the American Water Works Association (“AWWA”) and the American National Standards Institute (“ANSI”) safety criteria standards NSF/60 and NSF/61

4.1.3 Water Distribution System – Trunk and Local Systems

The City of Brockville’s Distribution system comprises of a Class III Trunk Distribution and a Class II Local Distribution. The distribution system consists of a number of underground pipes ranging in size from 100 mm in diameter to 600 mm diameter and are made of a variety of materials including, cast iron, ductile iron, poly vinyl chloride, concrete, steel, HDPE and asbestos cement. In addition there are over 8,330 service connections, 890 fire hydrants and 2,800 valves. The distribution also consists of a number of treated water storage facilities and booster stations as indicated below.

 Parkedale Avenue Reservoir The Parkedale Avenue Reservoir, Booster Pumping Station and Re-chlorination Facility services two geographical areas which are Zone 1, which is the area South of Highway 401, and Zone 2 which is the area North of Highway 401. It is a 7,600 m3 capacity reservoir at-grade, single cell, concrete, non-baffled, treated water reservoir.

 Perth Street Elevated Storage Tank (Water Tower) The City of Brockville has a 1,900 m3 overhead storage tank located on Perth St. It is a single cell, steel, non-baffled treated water storage tank.

 Water Booster Stations There are three (3) booster pump stations (First Ave., Sunset Blvd., Parkedale Ave.) which are part of the distribution system. The purpose of booster stations is to ensure consistent pressure is maintained throughout the system.

 Feeder Main & Local WDS 600 mm single feeder main from the WTP to the Church St./Perth St. area where flow splits between the Water Tower and the Local and Trunk distribution systems.

4.2 2016 Flow Summary

In 2016 the maximum or peak daily raw water flow was 35,376 L/min which occurred on June 14, 2016 and was above the permitted maximum amount of 25,278 L/min, or 140% of the Permit as indicated in the table below. In addition, the annual average daily raw water flow to the WTP was 10,231,478 L/day or 28% of its maximum approved treatment capacity of 36,400,000 L/day.

The Permit to Take Water specifies the maximum flow into individual treatment systems as indicated below.

The summary of the volume of water taken daily and the flows of the water supplied during the 2015 calendar year is provided in Appendix D, and includes 2015 flow data and historical flow of past years of pumping at the WTP.

The historical total plant effluent flow is also displayed in Appendix D. The total annual plant effluent flow for 2016 is 5.7% less than the total annual plant effluent flow from 2015. This information is provided for interest and to evaluate the treatment system trends over time in order to prepare for any future improvements required to meet this demand.

4.3 Adverse Test Results

In accordance with Schedule 16 of O. Reg. 170/03, all required notifications of adverse water quality incidents were provided to the Medical Officer of Health (MOH) and the Spills Action Centre (SAC). In 2016 there were a total of four (4) reports filed with SAC as summarized below.

4.4 Operator Certification

The Certification of Drinking-Water System Operators and Water Quality Analysts (O. Reg. 128/04) requires owners to ensure that every operator employed in the facility holds a license applicable to that type of facility. All operators in the Water Systems Division hold the required certifications for treatment and distribution.

4.5 Capital Projects

The 2016 Capital Project Highlights can be found in Appendix B of this Report. All works are subject to the annual budget process and approval by Council. A 30 Year Capital Replacement Equipment Plan has been developed that includes an extensive breakdown of all capital equipment that requires allocated funds for refurbishment or replacement. This is not included in the Annual Summary Report this year, but can be made available upon request.

5. TOWNSHIP OF ELIZABETHTOWN-KITLEY WATER DISTRIBUTION SYSTEM

5.1 Water System Description

The City of Brockville provides treated water from its Water Treatment Plant to the Elizabethtown-Kitley Water Distribution System (Class I) west of the City. This is facilitated through a 10 kilometer water main that extends along County Road #2 to the Country Club, through a meter chamber and associated appurtenances. This distribution system services approximately 350 residential customers. This system was installed in 1996 by the Ministry of Transportation and the Ontario Clean Water Agency and turned over to the Township of Elizabethtown-Kitley.

A booster station at Lily Bay provides for increased pressure only. The Township Fire Department is aware of this operational constraint and does not use the distribution system for firefighting or training purposes. An automated flushing station at the end of the service line is required to maintain free chlorine residual above the regulated minimum level of 0.20 mg/L. City Staff operate and maintain this system on behalf of the Township as the “Operating Authority”.

CONCLUSION

The City of Brockville serves approximately 22,000 residents and about 350 residents in the Township of Elizabethtown-Kitley. One of the City’s most important responsibilities is to protect public health by providing its residents with clean, safe drinking water. Routine water quality testing and continuous monitoring of the water quality and quantity is completed by City Staff at the Water Treatment Plant and throughout the distribution systems to demonstrate that the City consistently meets or exceeds the standards set by the MOECC.

In Ontario, water taking, treatment and distribution are governed by a number of Acts and Regulations. This report fulfills the reporting requirements of the Drinking Water System Regulation (O. Reg. 170/03) made under the Safe Drinking Water Act for all of the municipal drinking water treatment systems in the City of Brockville and the Township of Elizabethtown-Kitley, and covers the period from January 1st to December 31st 2016. As required under this same regulation, the report is prepared prior to March 31st and is filed for review and approved by both the City of Brockville’s and Elizabethtown-Kitley’s municipal council. Copies of the report are also on hand at the Public Library, the Revenue Office at City Hall, the Water Treatment Plant at 20 Rivers Avenue, Brockville and the Township of Elizabethtown-Kitley’s Municipal Office at 6544 New Dublin Road, RR#2 Addison.

The contents of this report highlight the requirements of the Safe Drinking Water Act, the regulations, and the systems’ approval including any reportable events and the corresponding corrective actions undertaken in 2016. In addition, the report also includes a summary of the quantities and flow rates of the water supplied during the calendar year, including monthly averages, maximum daily flows, and daily instantaneous peak flow rates. The summaries are compared to the rated capacity and flow rates in the system approvals.

The Water Systems Division has taken all necessary steps to comply with all regulatory requirements in the production and distribution of safe drinking water and to conform to the requirements of implementing and maintaining a Drinking Water Quality Management System. The dedication and commitment of all Water Systems Staff ensures a safe reliable drinking water supply to consumers of the City of Brockville and the a portion of the Township of Elizabethtown-Kitley.

A-17-14: Limerick Environmental Services Ltd. 2009 Annual Summary Report for Council ______The Township entered into a waste collection agreement with Limerick Environmental Services Ltd. for the collection and disposal of waste from the north end of the municipality in 2014. This contract was for a three year period to end on May 31st, 2017.

Under Article 4 of the agreement, the municipality, at its option may choose to enter into two one year (1) extensions of this agreement with Limerick Environmental Services Ltd. Recently Limerick Environmental Services Ltd. met with Township staff and have requested a two year extension. They have confirmed that the extension will be at the same price as originally tendered.

A discussion with staff noted that there have not been any significant issues with this contractor. Therefore, it is recommended to Council that a two year extension be granted, in accordance with the June, 2014 agreement.

Recommendation: THAT Report A-17-14 be received; AND THAT Council approve the extension of the Limerick Environmental Services Ltd. waste collection agreement for a two year period commencing June 1, 2017.

A-17-16: 2018 Municipal Election Alternative Voting ______Amendments to the Municipal Election Act require the municipal Council to adopt the vote counting equipment or alternative voting by-law prior to May 1st, 2017. Previously, this by-law was required to be passed in the spring of the election year. It is believed that part of the reasoning around this movement in date is the requirement to have all procedures and forms established before December 29, 2017.

Another change to the Municipal Election Act requires the Clerk to prepare a pre-election accessibility plan identifying potential accessibility issues and how the municipality will be addressing the issues with either removal, prevention or mitigation.

As noted in past reports regarding municipal elections, the Municipal Elections Act states that “in choosing a location for a voting place, the clerk shall have regard to the needs of electors with disabilities”; municipalities must now provide accessible customer service. The Accessibility Standards for Customer Service, Regulation 429/07 requires the following provisions:  Allow for the use of service animals and support persons  Provide notice of temporary disruptions of service  Provide accessibility customer service training for all election staff, including election officials and third parties  Establish procedures for responding to feedback  Provide documents in alternate format to take into account a person’s disability  Provide notice of availability of the above documents

In keeping with Regulation 429/07, specifically, the AMCTO’s elections guide for the previous election recommends that municipalities consider incorporating more than one method of casting a ballot. Alternative forms of voting also provide the voter with the opportunity to “vote anywhere any time”, further facilitating the elector’s ability to cast their ballot no matter the disability.

There continue to be benefits to providing alternative voting methods, including electronic (internet and telephone) as well as paper ballots:

1. Voter Choice and Flexibility The voter does not have to be at a specific poll at a specific time but can be anywhere in the municipality, province or anywhere in the world as long as telephone or internet services are available. This will ensure business travellers, students, snowbirds and non-resident voters have a voice in the municipal election.

2. Fast and Accurate Results Results of internet and telephone voting would be available immediately upon the close of polls. Tabulators will provide a prompt counting of all paper ballots rather than relying on manual counts.

3. Accessibility Issues As discussed above, the various forms of voting will provide alternatives to ensure accessibility to all. Paper ballots would be available at a poll located at the Township office which is fully accessible as well as at the three nursing homes and the Brockville Mental Health Centre. It has been noted that voters with vision disabilities can make use of telephone voting and voters with a hearing impairment can use the internet to vote with little or no assistance.

4. Voter Participation Though the Township’s voter participation numbers have reduced over the past two elections, other municipalities have seen a significant increase in voter turnout when offering internet/telephone voting. Using the electronic voting method combined with a paper option eliminates the complicated proxy process.

It should be noted that there are other events that affect voter turnout including but not limited to a race for the Mayoral position and a hot topic that spurs the interest of the electors.

In the 2014 election the greatest numbers of voters were between 50 and 70 with the majority of those using electronic/telephone voting. Those over 80 years of age used both electronic/telephone voting and paper ballot equally. This could be due to the travelling polls (those that attend seniors housing) offering only paper ballots.

Electronic voting also allowed voters from outside the area to vote including Quebec, Saskatchewan, Florida, Illinois, Minnesota, North Carolina, New York, Ohio, Pennsylvania, South Carolina, Texas and Virginia.

5. Candidate Election Tools It is possible for a candidate to be able to monitor voter turnout throughout the voting period by defined areas in order to more effectively direct campaigning efforts. With this option, a candidate would no longer need scrutineers as the candidate and his/her approved supporters could monitor participation online (secure login would need to be provided).

Other companies have entered the market since the Township first participated in electronic voting in 2010. The Leeds and Grenville CAO/Clerk’s group hosted an open house last fall where the various companies could provide information on their programs. As in the past, municipal staff from across the United Counties of Leeds and Grenville will be working together to develop a request for proposal from all companies for review and consideration. By partnering with other municipalities, there is a savings in training costs and support services. As well, it is hoped that by buying together, there may be a price reduction.

As a point of consideration by Council, there are a number of Ontario municipalities that have opted for electronic voting only (no paper ballots).

It is recommended that Council authorize the use of electronic voting, including internet and telephone as well as paper ballots for the 2018 municipal election, with vote counting equipment.

Recommendation: THAT Report No. A-17-16 be received; THAT staff be instructed to draft the necessary vote counting equipment and alternate voting by-law for Council’s consideration.

A By-Law To Amend Assessment Schedule Due To Changes In Ownership And Subdivided Lands In The Township Of Elizabethtown - Kitley For The Garland Municipal Drain

Whereas By-law Number 1746, enacted the 12th day of June, 1978, provided for the maintenance of the South Nation Municipal Drain based on the Engineering report dated the 28th day of January, 1976, as submitted by A.J. Graham from the firm of A.J. Graham Engineering Consultants Limited.

AND WHEREAS the Assessment Schedule requires updating due to changes in property ownership and the subdivision and severances of lands within the Drain.

AND WHEREAS Council complied with Section (2) of the Drainage Act, R.S.O. 1990, as amended.

NOW THEREFORE the Council of the Corporation of the Township of Elizabethtown - Kitley, pursuant to the Drainage Act, R.S.O. 1990, and amendments thereto, hereby enacts the updated assessment schedule attached to this By-law as well as the following:

1. The Municipality does hereby adopt the Drain Assessment submitted with this By-law and in pursuant to Section 65 (2) of the Drainage Act will update said assessment schedule if lands become subdivided or there is a change in property ownership from time to time.

2. That the provisions of the By-law shall come into force and take effect upon the passing thereof.

Ms. Robert,

Greer Galloway, as requested by the Township of Elizabethtown-Kitley, has completed an updated assessment schedule for the Kitley portion of the Garland Creek Municipal Drain. The Garland Creek Municipal Drain was originally constructed in 1978 under an engineering report completed by R.F. Mucklestone Limited. In 1981 additional work was completed on the drain under an additional report completed by R.F. Mucklestone Limited. Since the drain was completed in 1981, some of the properties identified in the original assessment have hence been severed into smaller parcels.

As per section 65(1) of the Drainage Act, reapportionment of the assessment for the municipal drain has been completed by an Engineer for the properties subject to severance.

The reapportionment was completed using a proportional percentage system, allocating a percentage of the original assessment to the new severed parcels based on its percentage of the original land size. The Land areas of the new land parcels were based on the original assessment map in the 1978 engineering report and by the updated lot and roll number map supplied by the Township. The acreage of the severed areas has been calculated where not provided on the assessment map. The calculations associated with the roll numbers subject to severance are located in Appendix A.

In review of the original engineers drain report no information could be obtained on how the properties where assessed for benefit or outlet (i.e. Land use factor, distance from drain) therefor the percentage land area system was used.

Attached are the reapportionment values for the Garland Municipal drain. The following roll numbers have been subject to reapportionment since the 1978 assessment:

A By-Law To Authorize The Execution Of A Grant Funding Agreement Number 2 Between The Township Of Elizabethtown-Kitley And Her Majesty The Queen In Right Of Ontario (Minister Of The Environment) For The Source Protection Municipal Implementation Fund

Whereas Section 9 of the Municipal Act S.O. 2001, c. 25, as amended, provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act;

And Whereas Council deems it desirable to enter into a terms and conditions agreement with Her Majesty the Queen in Right of Ontario (the Minister of the Environment) for the Source Protection Municipal Implementation Fund.

Therefore, the Council of the Corporation of the Township of Elizabethtown-Kitley enacts as follows:

1. That the Council of the Corporation of the Township of Elizabethtown-Kitley authorize the execution of a terms and conditions agreement with Her Majesty the Queen in Right of Ontario (Minister of the Environment) for the Source Protection Municipal Implementation Fund.

2. And That the Mayor and Clerk be authorized to execute the said agreement, attached hereto as Schedule “A”, on behalf of the Corporation of the Township of Elizabethtown-Kitley.

AMENDMENT NO. 2 to a Grant Funding Agreement under the 2013-14 Source Protection Municipal Implementation Fund (SPMIF_1314_118)

THIS AMENDMENT NO. 2 made in duplicate, as of the 8th day of March 2017,

B E T W E E N:

HER MAJESTY THE QUEEN IN RIGHT OF ONTARIO as represented by the Minister of the Environment and Climate Change

(the “Province”)

- and -

The Corporation of the Township of Elizabethtown-Kitley

(the “Municipality”)

WHEREAS the parties entered into a grant funding agreement under the Source Protection Municipal Implementation Fund dated as of December 13, 2013 for the Municipality to build municipal capacity to implement source protection plans and support sustainable, local actions to protect drinking water (the “Agreement”);

AND WHEREAS the parties entered into Amendment No. 1 as of August 12, 2015 to extend the term of the Agreement, add an additional report and include new timelines;

AND WHEREAS pursuant to Section 20.2 of the Agreement, the parties may amend the Agreement in writing;

NOW THEREFORE in consideration of the contractual relationship between the Municipality and the Province referred to above and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by both parties, the Municipality and the Province hereby acknowledge, agree and undertake as follows:

1. Unless otherwise specified in this Amendment No. 2, capitalized words and phrases have their prescribed meaning as set out in the Agreement.

2. The Agreement is amended as follows:

2.1 The following definitions are added to Section 1.1, Definitions, in alphabetical order:

“Lower Tier Municipalities” as defined by the Municipal Act, 2001 means a municipality that forms part of an upper-tier municipality for municipal purposes. Within regions, they are responsible for providing certain local services that are not provided by the regional municipality. Within counties, they are responsible for providing a wider range of local services since counties as upper-tier municipalities provide less local services than regions.

“Ministry” means the Ontario Ministry of the Environment and Climate Change presided over by the Province. When “Ministry” is referred to in this Agreement, the reference is to the “Ministry” as the regulator.

“RMI” means a risk management inspector appointed under Part IV of the Clean Water Act, 2006.

“RMO” means a risk management official appointed under Part IV of the Clean Water Act, 2006.

“SPMIF” means the Province’s Source Protection Municipal Implementation Fund.

“Upper Tier Municipality” as defined by the Municipal Act, 2001 means a municipality of which two or more lower-tier municipalities form part for municipal purposes

2.2 Section 2.1 as amended by Amendment No. 1 is again deleted in its entirety and replaced with the following:

The term of the Agreement shall commence on the Effective Date and shall expire on March 31, 2018 unless terminated earlier pursuant to Article 9. The Municipality shall, upon expiry or termination of the Agreement, return to the Province any Funds remaining in its possession or under its control.

2.3 Section A.2.2 (Project Objectives) is deleted and replaced with the following:

The objectives of the Project are for the Municipality to use the Funds to implement, or prepare to implement, one or more of the significant drinking water threat policies set out below in an approved source protection plan, or proposed source protection plan, that has been submitted to the Ministry for approval, provided that:

ii. The implementation of the policy provides source protection implementation benefits to the Municipality, the Municipality’s stakeholders, the Municipality’s watershed, and/or the Municipality’s Lower Tier Municipalities.

Significant drinking water threat policies are limited to:

(a) Policies for the purpose of Part IV of the Clean Water Act, 2006 to address significant drinking water threats;

(b) Policies that govern Planning Act decisions to address significant drinking water threats;

(c) Policies that establish education and outreach programs to address significant drinking water threats; or

(d) Policies that specify other types of actions the Municipality is required to take to address significant drinking water threats.

B.1 Eligible Activities

The Municipality may only spend the Funds on the following eligible activities that are undertaken by the Municipality, or that are undertaken on the Municipality’s behalf, between December 13, 2013 and December 4, 2017 that are directly related to the following:

Risk management

a) Establishing and enforcing risk management plans under Part IV of the Clean Water Act, 2006;

b) Communication with landowners affected by policies pertaining to Part IV of the Clean Water Act, 2006;

c) Refining the number of threats within the Municipality pertaining to Part IV of the Clean Water Act, 2006;

e) Implementing education and outreach policies to address significant drinking water threats, including: a. Installation of municipal road signs indicating areas of a wellhead protection area or an intake protection zone where significant threat policies apply;

Other activities

f) Working with the local source protection authority and local source protection committee to understand the Municipality’s requirements under the source protection plan;

g) Developing and/or modifying the Municipality’s business processes in order to implement significant drinking water threat policies;

h) Establishing processes for information sharing among municipalities and source protection authorities;

i) Developing a reporting framework for the Municipality that aligns with the collection of data under Section 65 of Ontario Regulation 287/07, made under the Clean Water Act, 2006;

j) Other activities the Municipality undertakes to fulfill its requirements to implement significant drinking water threat policies, including: a. Establishing a mandatory septic re-inspection program for vulnerable areas delineated in approved assessment reports; and, b. Installation of road signs indicating areas of a wellhead protection area or an intake protection zone where significant threat policies apply.

k) Activities identified in subsections B.1 (a) through (j) for another municipality with a current agreement under the SPMIF, provided that such activities: a. Will provide source protection implementation benefits to the Municipality, the Municipality’s community (Upper Tier Municipality and/or Lower Tier Municipalities), and/or the Municipality’s watershed; and b. Are not ineligible under the other municipality’s own SPMIF agreement.

B.2 Ineligible Activities

The following activities are not eligible for funding under the Agreement and the

Municipality may not spend the Funds on the following:

a) Refining the number of threats within the Municipality not pertaining to Part IV of the Clean Water Act, 2006;

b) Threat refinement work already funded by the Province through source protection authorities;

c) Activities that are already funded through another program, funding body, partners, or other means;

d) Activities that are funded by the SPMIF through an agreement between the Province and another municipality;

e) Fulfilment of the Municipality’s responsibilities as a property owner undertaking activities identified as significant drinking water threats;

f) Fulfilment of the Municipality’s responsibilities under other legislation (e.g., Building Code), except as noted in Section B.1(j)(a), including; a. Establishment of a septic re-inspection program for areas delineated through other legislation (i.e. Lake Simcoe Protection Act, 2008); b. Establishment of a discretionary septic re-inspection program for areas where an activity is not considered a significant drinking water threat under the source protection framework; and,

g) Activities not related to fulfilling the Municipality’s requirements to implement significant drinking water threat policies specified in an approved source protection plan, or proposed source protection plan that has been submitted to the Ministry for approval.

B.3 Eligible Costs

The eligible costs listed below must be directly related to the source protection implementation activities outlined in Section B.1:

a) Municipal staff salaries and benefits for time spent working on the Project (such as hiring or re-assigning Municipal staff to serve as RMOs and RMIs as specified under the Clean Water Act, 2006; or administrative support required to establish and/or maintain the Risk Management Office);

b) Fees incurred for contracted professional services from professionals, technical personnel, consultants, and contractors for work on the Project (such as hiring a consultant to support the RMO in determining appropriate measures the Municipality should include in a risk management plan);

c) Printing and distribution costs related to education and outreach programs and activities necessary to implement a source protection plan;

d) Purchase and/or production costs of municipal road signs indicating areas of a wellhead protection area or an intake protection zone where significant threat policies apply;

e) Transportation (including mileage), meals and accommodation for an appointed RMO/RMI to attend Ministry legislated RMO/RMI training; and, mileage for an appointed RMO/RMI to undertake negotiating risk management plans; a. The amount from the Funds used for transportation, meals and accommodation must be calculated according to the rates in the Ontario Government’s Travel, Meal and Hospitality Expenses Directive (https://www.ontario.ca/document/travel-meal-and-hospitality-expenses- directive) that is current as of the date that the expense is incurred; b. Transportation will be by the most practical and economical method; tickets (e.g. train, airplane) purchased must be for economy/coach class and when renting a vehicle, the Funds may only be used for a compact model or its equivalent unless approval for a different model is obtained from the Province prior to rental; c. Accommodation will be in a standard room; the Funds may not be used for hotel suites, executive floors or concierge levels. d. Meals refer to the provision of food or beverages, subject to the limitations below: i. The Municipality may only use the Funds for food and beverage if it is collecting and retaining itemized receipts that verify the expenditure. The Funds may not be used for: 1. non-meal food and beverages; 2. alcohol; or 3. meals when the travel period is less than 5 hours, calculated from the time the appointed RMO/RMI leaves their normal place of business (or reasonable alternative origin) to the time the RMO/RMI or returns to the normal place of business (or reasonable alternative destination);

f) Equipment purchased for an appointed RMO/RMI to undertake negotiating risk management plans; a. Costs for equipment are limited to a maximum of 10% of the Municipality’s Maximum Funds; b. Eligible equipment would include items listed in the Ministry of the Environment and Climate Change legislated RMO/RMI training (i.e. industrial personal property entry equipment and biosecurity protocol equipment)

g) Training (registration fees for courses) for an appointed RMO/RMI, directly related to negotiating risk management plans (such as training on the Nutrient

Management Act); a. Costs for training are limited to a maximum of 10% of the Municipality’s Maximum Funds; and,

h) Any other expense approved by the Province, for which the Province has provided Notice to the Municipality.

For clarity, should the Municipality collaborate with one or more other municipalities to get a “bulk rate” for a similar expense, the bulk rate does not have to be allocated equally between all municipalities. However, the Municipality’s share of the bulk rate cannot be any more than it would have paid for its own expense in the absence of a bulk rate and the Municipality may be required by the Province to verify this cost.

B.4 Ineligible Costs

The following costs are not eligible for funding under the Agreement and the Municipality may not spend the Funds on the following:

a) Travel, meals, accommodation and hospitality; a. Penalties incurred for non-cancellation of guaranteed hotel reservations; and b. Except as noted in Section B.3(e);

b) Overhead (such as rent, utilities, human resources services, office supplies);

c) Capital (such as vehicles, office furniture, computers, software licenses, etc.) and equipment; a. Except for municipal road signs indicating areas of a wellhead protection area or an intake protection zone where significant threat policies apply as noted in Section B.3(d); and b. Except for equipment as noted in Section B.3(f);

d) Training (including staff and contracted professional services associated with training); a. Except as noted in Section B.3(g);

e) Land expropriation or purchase;

f) Incentives or compensation for property owners; and

g) Costs for establishing risk management plans if costs have been or will be recovered from property owners.
