Harvey Weinstein Trial News: Hollywood Mogul's Case Begins in NYC bloomberg.com/news/articles/2020-01-05/weinstein-on-trial-a-metoo-reckoning-two-years-in-the-making Harvey Weinstein on Trial: A #MeToo Reckoning Two Years in the Making Disgraced movie-mogul Harvey Weinstein arrives at state court in Manhattan, New York, for the start of his criminal trial on five felony counts, including predatory sexual assault and rape. More than two years and a lifetime ago, Hollywood’s open secrets about Harvey Weinstein finally spilled into public view. Few back then could have predicted all that would follow or where the #MeToo movement would go. Now, for Weinstein, a reckoning is at hand: His criminal trial, on five felony counts, including predatory sexual assault and rape, is scheduled to begin on Monday in state court in Manhattan. Jury selection could last two weeks, the trial six more. The proceedings will mark an extraordinary moment in the still-unfolding story of harassment and abuse by powerful men and the implications for every corner of society. For some in the movement, simply seeing Weinstein facing a jury, and charges that could send him to prison for life, will be a victory. “The fact that this has made it this far is remarkable in its own right,” said Tina Tchen, the chief executive of the advocacy group Time’s Up. Most rape accusations don’t make it to court. Much has changed since the New York Times and the New Yorker reported that dozens of women had accused Weinstein of rape, sexual assault and sexual abuse, unleashing a torrent of similar claims against others as the MeToo hashtag went viral and developed into an international movement.

This article explores the digital circulation of these affects and considers how the outpouring of tweets about sexual harassment and abuse contribute to a feminist politics centered on collective healing. The particular emotions expressed in the #MeToo Twitter archive subvert the logics of quan- tification and visibility that undergird popular feminism and the attention economy, and produce an affective excess that works toward movement founder Tarana Burke’s original project of “mass healing.” At a moment wherein popular feminism emphasizes individual empowerment and consumption, and carceral feminism relies on criminalization and incarceration, the #MeToo movement’s focus on shared emotions represents the potential for a feminist politics rooted in collective support and restorative justice. • Asia Argento and the Me Too Movement: a Complicated Pairing
Volume 5, Issue No. 1. Asia Argento and the Me Too Movement: A Complicated Pairing Lauren Flowers Tulane University, New Orleans, Louisiana, USA ÒÏ Abstract: In October 2017, producer Harvey Weinstein, one of the most powerful forces in the entertainment industry, was accused of decades of hidden sexual misconduct by The New Yorker and The New York Times. As a result of the Weinstein accusations, the Me Too movement began on a global scale. The Me Too movement was initially created by activist Tarana Burke in 2006, and then co-opted by actresses Asia Argento, Rose McGowan, and Alyssa Milano in the wake of Weinstein’s accusations. It successfully fought to promote awareness of sexual assault and harassment and connecting victims to resources that would help them heal from their trauma. Then, in August 2018, Asia Argento was publicly accused of sexually assaulting actor Jimmy Bennett five years prior. At the time of the assault, Bennett was 17 years old, and Argento was 37 years old. The two had shared a work relationship for years, with Argento serving as Bennett’s mentor. Suddenly, Argento’s role in the Me Too movement seemed much less clear. How could a movement against sexual misconduct be led by a perpetrator? What did this mean for Argento’s presence as a leader against sexual misconduct? For the greater Me Too movement as a whole? The Me Too Movement’s Origins The Me Too movement was initially founded on MySpace in 2006 by Black activist Tarana Burke. Burke began the use of the phrase “Me Too” to show support for primarily Black women and girls who identified as victims of sexual trauma.

  • A Recognitive Theory of Identity and the Structuring of Public Space
A RECOGNITIVE THEORY OF IDENTITY AND THE STRUCTURING OF PUBLIC SPACE Benjamin Carpenter [email protected] Doctoral Thesis University of East Anglia School of Politics, Philosophy, Language and Communication Studies September 2020 This copy of the thesis has been supplied on condition that anyone who consults it is understood to recognise that its copyright rests with the author and that use of any information derived there from must be in accordance with current UK Copyright Law. In addition, any quotation or extract must include full attribution. ABSTRACT This thesis presents a theory of the self as produced through processes of recognition that unfold and are conditioned by public, political spaces. My account stresses the dynamic and continuous processes of identity formation, understanding the self as continually composed through intersubjective processes of recognition that unfold within and are conditioned by the public spaces wherein subjects appear before one another. My theory of the self informs a critique of contemporary identity politics, understanding the justice sought by such politics as hampered by identity enclosure. In contrast to my understanding of the self, the self of identity enclosure is understood as a series of connecting, philosophical pathologies that replicate conditions of oppression through their ontological, epistemological, and phenomenological positions on the self and political space. The politics of enclosure hinge upon a presumptive fixity, understanding the self as abstracted from political spaces of appearance, as a factic entity that is simply given once and for all. Beginning with Hegel's account of identity as recognised, I stress the phenomenological dimensions of recognition, using these to demonstrate how recognition requires a fundamental break from the fixity and rigidity often displayed within the politics of enclosure.

  • The Fall of Harvey Weinstein – Mcgowan Suggest Coercion in Drug Warrant
The Fall of Harvey Weinstein – McGowan Suggest Coercion in Drug Warrant Rose McGowan (Photo source: Twitter) Ronn D. Torossian, CEO, 5WPR When the story of Hollywood producer Harvey Weinstein’s fall from his ivory tower is written in full, there’s better than even odds the beginning of the end will be traced to actress Rose McGowan. Her repeated vociferous Twitter accusations shined a bright light on Weinstein that brought many other women out of the woodwork. Accusation after accusation and Weinstein was unemployed and a public pariah. But now it’s McGowan who is answering negative press accusations after an arrest warrant for felony possession of a controlled substance was issued for the 44-year-old actress. Immediately after the warrant was issued, McGowan accused authorities of a conspiracy to “silence” her from speaking out against sexual harassment in Hollywood. According to multiple media reports, the arrest warrant is the result of an investigation of an incoming flight at Washington Dulles International Airport last January. According to the investigators, items left behind on the plane tested positive for narcotics. Subsequently, the Metropolitan Washington Airports Authority PD issued a warrant for McGowan’s arrest. For those keeping notes, that was months ago. So, how long ago did McGowan learn about the warrant? That’s the question many are asking … and that doubt is casting aspersions on the actress’ other allegations. The timing is interesting. No one but McGowan can definitively know when she actually learned of the warrant, but it’s forgivable that some people would wonder why she kept silent for so long.

  • Scandal, Social Movement, and Change: Evidence from #Metoo in Hollywood∗
Scandal, Social Movement, and Change: Evidence from #MeToo in Hollywood∗ Hong Luo† Laurina Zhang‡ First draft: April 24, 2020 Revised version: December 2, 2020 Abstract Social movements have the potential to effect change in strategic decision making. In this paper, we examine whether the #MeToo movement, spurred by the Harvey Weinstein scandal, leads to changes in the likelihood of Hollywood producers working with female writers on new movie projects. Since #MeToo affected the entire industry, we use variation in whether producers had past collaborations with Weinstein to investigate whether and how #MeToo may spur change. We find that producers previously associated with Weinstein are, on average, about 35-percent more likely to work with female writers after the scandal than they were before, relative to non-associated producers; and the size of this effect increases with the intensity of the association. Female producers are the main drivers of our results, perhaps because they are more likely than male producers to resonate with the movement’s cause and face relatively low costs of enacting change. Changes made by other groups, such as production teams with the most intense association with Weinstein and less-experienced all-male teams, may be better explained by motivations to mitigate risk. We also find that producers do not sacrifice writer experience by hiring more female writers and that both experienced and novice female writers have benefited from the increased demand. Our study shows that social movements that seek to address gender inequality can, indeed, lead to meaningful change. It also provides perspective for thinking about whether, and to what extent, changes may occur in broader settings.

  • Affirmation in Opposition to Defendant's Motion
Deadline because, from the beginning, the defendant’s lawyers have contributed to the media coverage they now complain about by making extrajudicial statements about the case, portraying the defendant as a scapegoat who has been targeted by the “Me Too” movement, thus employing the well-worn strategy of trying his case outside of the courtroom. Because (1) defendant’s allegations are unfounded and (2) the trial court can ensure the selection of a fair and impartial jury, defendant’s motion should be denied and his case should go forward according to the schedule previously set by the court and the parties. ARGUMENT A motion to change venue from the county where the crime was committed may be granted only where the movant demonstrates “reasonable cause to believe that a fair and impartial trial cannot be had in such county.” CPL § 230.20(2). “A pretrial change of venue for the purpose of protecting the right to a fair trial is an extraordinary remedy reserved for the rarest of cases.” People v. Boss, 261 A.D.2d 1, 2-3 (1st Dept. 1999). It is long settled that extensive press coverage, “even if pervasive and concentrated,” does not automatically result in an unfair trial. Nebraska Press Ass’n v. Stuart, 427 U.S. 539, 565 (1976); Murphy v. Florida, 421 U.S. 794, 799 (1975); People v. Boudin, 90 A.D.2d 253, 255 (2d Dept. 1982). Accordingly, a change of venue motion at this stage of the proceedings should be denied as premature, subject to renewal only if during voirDeadline dire a fair and impartial jury cannot be selected.
