The project is within 1 km of ancient and active riverine features (Seine River, relic oxbows of Seine River) in well drained sandy soils, factors which suggest the development has the potential to impact heritage resources. Therefore, the Historic Resources Branch has concerns with the project.

Concerns.

Further to your e-mail regarding the above-noted lagoon proposal, the Historic Resources Branch has examined the location in conjunction with Branch records for areas of potential concern. The project is within 1 km of ancient and active riverine features (Seine River, relic oxbows of Seine River) in well drained sandy soils, factors which suggest the development has the potential to impact heritage resources. Therefore, the Historic Resources Branch has concerns with the project.

Under Section 12(2) of The Heritage Resources Act, if the Minister of Sport, Culture and Heritage has reason to believe that heritage resources or human remains are known, or thought likely to be present, on lands that are to be developed, then the owner/developer is required to conduct at his/her own expense, a heritage resource impact assessment (HRIA) and mitigation, if necessary, prior to the project’s start.

The developer must contract a qualified archaeological consultant to conduct a Heritage Resources Impact assessment (HRIA) of the proposed development location, in order to identify and assess any heritage resources that may be negatively impacted by development. If desirable, the Branch will work with the developer/land owners and its consultant to draw up terms of reference for this project.

Good Morning, please be advised that according to our records as of this date, NW 29‐06‐08 EPM (160.00 acres) was transferred by the Dominion of in 1909 along with the Sand and Gravel with the Crown retaining the Mines and Minerals. As our office does not maintain a record of private land ownership transactions, we are not able to comment as to whether or not the sand and gravel has been transferred from the surface title without seeing a copy of the current status of title.

I’m preparing an Environment Act Proposal for the RM of La Broquerie and require the mineral rights (Mines and Minerals, and Sand and Gravel) for Plan no. 54938 (Lot B & C, Winnipeg Land Titles Office) in NW 29‐6‐8 EPM. Unfortunately, I don’t have a Status of Title for this land as it was just transferred to the RM at the beginning for the month and they have yet to send it to us.

Thank you for your information request. I completed a search of the Manitoba Conservation Data Centre's rare species database and found no occurrences at this time for your area of interest.

The information provided in this letter is based on existing data known to the Manitoba Conservation Data Centre at the time of the request. These data are dependent on the research and observations of CDC staff and others who have shared their data, and reflect our current state of knowledge. An absence of data in any particular geographic area does not necessarily mean that species or ecological communities of concern are not present; in many areas, comprehensive surveys have never been completed. Therefore, this information should be regarded neither as a final statement on the occurrence of any species of concern, nor as a substitute for on-site surveys for species as part of environmental assessments.

Because the Manitoba CDC’s Biotics database is continually updated and because information requests are evaluated by type of action, any given response is only appropriate for its respective request. Please contact the Manitoba CDC for an update on this natural heritage information if more than six months pass before it is utilized.

Third party requests for products wholly or partially derived from Biotics must be approved by the Manitoba CDC before information is released. Once approved, the primary user will identify the Manitoba CDC as data contributors on any map or publication using Biotics data, as follows as: Data developed by the Manitoba Conservation Data Centre; Wildlife & Fisheries Branch, Manitoba Sustainable Development.

This letter is for information purposes only - it does not constitute consent or approval of the proposed project or activity, nor does it negate the need for any permits or approvals required by the Province of Manitoba.

As per your request and map, there is one licensed irrigation surface water project in our database on the route indicated.

Please note, that we do not licence a project if the water use associated with the project falls below the domestic exemption category (< 25 000 Litres/day). Therefore, we would not have any records of domestic users in the area of interest.
