Michigan Ave. (1928; Holabird & Roche/Holabird & Root) The 333 NORTH MICHIGAN BUILDING is one of the city's most outstanding Art Deco-style skyscrapers. It is one of four buildings surrounding the Michigan A venue Bridge that defines one of the city' s-and nation' s-finest urban spaces. The building's base is sheathed in polished granite, in shades of black and purple. Its upper stories, which are set back in dramatic fashion to correspond to the city's 1923 zoning ordinance, are clad in buff-colored limestone and dark terra cotta. The building's prominence is heightened by its unique site. Due to the jog of Michigan Avenue at the bridge, the building is visible the length of North Michigan Avenue, appearing to be located in the center of the street. ABOVE: The 333 North Michigan Building was one of the first skyscrapers to take advantage of the city's 1923 zoning ordinance, which encouraged the construction of buildings with setback towers. The Symposium banquet will be held in the evening at Navy Pier in downtown Chicago. It will begin with a reception at 6:30 p.m., followed by dinner at 7:30 p.m. There will be a lakefront fireworks display right off the pier at 9:30 p.m. Buses will depart from Navy Pier around 10:00 p.m. We hope that many of you will take advantage of the time to visit Chicago. We will run several buses to Chicago in the morning. There will be a few additional buses in the afternoon. Detailed schedules will be available at the beginning of the conference and sign-up for the bus transportation is requested. We have some suggestions for tours you might take or sights you might see depending on your interests. Please be aware that many of the attractions are internationally renowned and, depending on the time of the year and the weather, can be quite crowded and have long waits for admission. We increased the dividend by nearly 13% and paid a special dividend resulting in a total common stock dividend of $1.06 per share.

(collectively “APAC”), alleging APAC acted in bad faith (Count I) and breached a contract (Count II) by failing to settle a patient’s malpractice lawsuit against Surgery Center. APAC now moves to dismiss both claims against it pursuant to Rule 12(b)(6). For the reasons stated below, the Court denies in part and grants in part the motion. Background The following facts taken from the complaint are accepted as true for purposes of ruling on the motion to dismiss now before the Court. APAC provided malpractice insurance to Surgery Center from 1999 through 2005. Dkt. 1 ¶ 20. The insurance policies APAC issued to Surgery Center had one million dollar per-claim limits of liability. Id. In 2003, Ms. Tate, whose post-surgery complications rendered her quadriplegic, sued Surgery Center, where the surgery had been performed, and Dr. Hasson, the doctor who performed the surgery (“the Tate Suit”). Id. ¶ 21-23. APAC retained defense counsel to defend Surgery Center in the Tate suit.
