In 1974 he was appointed an Advocate of the Supreme Court of Pakistan and has served as Deputy Attorney General for three years 1997-2000. He is presently lecturing at the Hamdard University of Law on constitutional law in Pakistan. He is also serving as Legal Advisor to many Multinational Organizations. One of his cherished involvements is working with Civil Society organizations representing Citizens and Non Profit Organizations in Human Rights cases at both the High Court and Supreme Court. Research Coordination Transparency International – Pakistan has been involved in coordinating with Barrister Naimur Rahman in compiling this report. This report is draws upon interviews and meetings with senior public officials and major donor agencies and IFIs carried out in April 2002 during a 10-day visit by a three-member Mission of Transparency International. Pakistan is a key ally in U.S.-led counterterrorism efforts. The history of democracy in Pakistan is a troubled one marked by ongoing tripartite power struggles among presidents, prime ministers, and army chiefs. Military regimes have ruled Pakistan directly for 34 of the country’s 60 years in existence, and most observers agree that Pakistan has no sustained history of effective constitutionalism or parliamentary democracy. In 1999, the democratically elected government of then-Prime Minister Nawaz Sharif was ousted in a bloodless coup led by then-Army Chief Gen. Pervez Musharraf, who later assumed the title of president. In 2002, Supreme Court-ordered parliamentary elections—identified as flawed by opposition parties and international observers—seated a new civilian government, but it remained weak, and Musharraf retained the position as army chief until his November 2007 retirement. In October 2007, Pakistan’s Electoral College reelected Musharraf to a new five-year term in a controversial vote that many called unconstitutional. The Bush Administration urged restoration of full civilian rule in Islamabad and called for the February 2008 national polls to be free, fair, and transparent. U.S. criticism sharpened after President Musharraf’s November 2007 suspension of the Constitution and imposition of emergency rule (nominally lifted six weeks later), and the December 2007 assassination of former Prime Minister and leading opposition figure Benazir Bhutto. -

Distilling Eligibility and Virtue Distilling Eligibility and Virtue: Articles 62 and 63 of the Pakistani Constitution Saad Rasool* This article analyses the provisions regarding the qualifications and disqualifications for Parliamentarians set out in the constitution of Pakistan, and traces their evolution over the years. It establishes that the objective interpretation of these provisions in the past has given way to a more subjective and moralistic approach in the run-up to the 2013 general elections. It further argues that, for the most part, these provisions lay down unascertainable and subjective criteria for qualification and disqualification of a Parliamentarian. This in turn lends support to the main argument of this article that the fundamental right of an individual to contest for a public office, and an equal fundamental right of the citizenry to choose their representative cannot be refused, on the grounds of such ambiguous ideas. However, this is not to say that there should be no minimum criteria for qualifying to be a Parliamentarian; rather it is suggested that the present criteria suffer from serious defects which need to be remedied. Introduction The endeavour of law, in a democratic dispensation, is that of creating an ideal society – a society that is not simply a reflection of who we are, but, more importantly, of who we aspire to be. This endeavour, reflected in the corpus of our laws, emanates primarily from the legislature – the arm of the state that is entrusted with shaping the laws and freedoms that define the spirit of our society. When were the TNFJ and the ISO banned, and what are the names of their successors? Country Advice PAK33887 (November 2008) provides information on the history and names of the Tehrik-e-Nifaz-e-Fiqh-e-Jafaria (TNFJ). Ambiguities in the naming practices of the TNFJ, and the breakaway group Tehrik-e-Jafaria Pakistan (TJP) are discussed in both Country Advice PAK 14999 (February 2002) and Country Advice PAK33887 (November 2008). Country Advice PAK31967 (June 2007) provides detailed information regarding the Imamia Student Organisation (ISO). Pertinent information from these responses is summarised below. It is important to note, as does Country Advice PAK33887 (November 2008), that the various Shi‟a sectarian groups currently operating in Pakistan have a complex history, with factional splits in organisations, and the formation of militant factions creating a range of different actors. The names under which different Shi‟a groups have operated have varied over time, in response to factional splits and government bans. It is in this context that there is a degree of variance and inconsistency in the titles by which the Tehrik-e-Nifaz-e-Fiqh-e-Jafaria (TNFJ) and the Tehrik-e-Jafaria Pakistan (TJP) are referred to in news media, and political discourse; names tend to be used interchangeably.1 Tehrik-e-Nifaz-e-Fiqh-e-Jafaria (TNFJ) No information was located which indicated the TNFJ was a banned organisation in Pakistan. The group‟s website http://tnfj.org.pk/sec/cont.htm was active at the time this research was conducted, and lists its headquarters in Rawalpindi.2 The naming of the TNFJ and other organisations is discussed below. -

IOM PAKISTAN FLOOD RESPONSE 2011: MONSOON UPDATE Situation update • Badin, Tando Muhammad Khan, and Mirpur Khas are officially calamity hit districts. Till 15th August, 500 millimeters of rainfall count was recorded in Badin. National Disaster Management Authority (NDMA) has issued a flood warning from monsoon rain for lower Sindh, upper Punjab (Rawalpindi, Gujranwala, Lahore divisions) and Kashmir for the next 24 to 48 hours and a ‘low level flood’ warning from River Sutlej at Ganda Singh Wala. Flood affectees living along a • Over one million people have been affected in six districts of roadside in Badin, Sindh Sindh (GoP). Schools across the districts are being used as relief centers. Twelve thousand individuals are displaced in Tharparkar and additional 14,000 affected people have migrated from Badin and Mirpurkhas to Tharparkar. • Prime Minister Yousaf Raza Gillani visited Badin. He ordered immediate provision of 15,000 tents for the homeless, issuance of Watan Cards by Nadra for compensation, widening of Benazir Income Support Program area to the rain-affectees, interest-free loans by agricultural bank and for implementation of a drainage scheme to avoid such losses in future. Needs analysis Floods in Badin, Sindh • As of 14th of August 86 relief camps were set up in Badin, 63 in Tando Muhammad Khan and 102 relief camps in Mirpurkhas and 48 relief camps in Tharparkar. • Camps do not have enough resources to cater to the requirements of so many affectees. Open defecation is becoming a common problem because of non availability of latrines. This is leading to severe health problems.
