A Missing Link in the History of the Just War Doctrine Few will dispute that the just war doctrine historically has been among the most influen- tial and enduring legacies of the Late Middle Ages. Before the United Nations Charter of 1945, the doctrine formed the backbone of the ius ad bellum as it had been understood by writers and been paid lip service to by rulers since the Late Middle Ages.1 The just war doctrine obtained its classical outline during the thirteenth century. As in many matters of theology and political theory, Saint Thomas Aquinasʼs (1225-1274) synthesis gained canonical authority and outlived the ages as the common denominator for the doctrine. Of course, this did not mean that afterwards there were no variations on the theme. According to Aquinas, for a war to be just three conditions had to be fulfilled. First, the belligerent needed authority (auctoritas principis). In practice, this meant that only the Church or a secular prince who did not recognise a higher authority2 had the right to wage or authorise war. A ruler who did not enjoy ʻsovereigntyʼ could turn to his superior to have his rightful or supposedly rightful claim upheld. Second, a war had to be waged for a just cause (causa iusta). This could either be self-defence against prior armed ag- gression, the recovery of lost property or the restoration of injured rights. -

It is an immeasurable distance away from a secure text, and every element in it is subject to constant revision. In particular, most of the work has been done from microfilm and fiche of varying quality. Direct inspection of the manuscript would often resolve our uncertainties. The text here differs from the earlier version in four main respects. Firstly, a number of further copies have been studied, and more details on their character have been inserted in the list of manuscripts; occasional variants have been added from them in the apparatus. The process has helped to identify a number of errors in the earlier text, while making the apparatus even more cumbersome than before. Secondly, the cross-references to Gratian have been revised and corrected – though the process is doubtless neither accurate nor complete. Two new documents have been added. The first is a map, but not an edition, of the material found at the end of many copies, panend.doc. The second is the Conspectus; this provides an overview of the canons omitted or inserted in a larger number of copies than have been collated in detail. -

Manuscripts of Ivo’s Correspondence Adapted from C.J. Rolker, ‘Canon law and the letters of Ivo of Chartres’, Cambridge PhD thesis 2006, Appendix A. See further his Canon law and the letters of Ivo of Chartres (Cambridge University Press 2010), esp. 127-32, 303-38. The letters of Ivo survive in a remarkable number of widely diffused copies. A provisional list of 127 known mss (of which three are lost) containing a significant number of the letters is attached. It is too soon to attempt a detailed account of the transmission. What follows is a preliminary discussion of the classification of the surviving copies, based on detailed study of some forty manuscripts. I have concentrated on those collections of Ivo’s letters which were compiled in his lifetime or not much later from Chartrain sources; later derivative forms have largely been ignored. 2 The standard model of the manuscript tradition is still that developed by Jean Leclercq in the context of his partial edition.1 While his editorial principles have been severely criticised,2 his account of the manuscript tradition has been widely accepted.3 However, working in war-time Paris, Leclercq had only limited access to the manuscripts, and his achievements must be seen in the light of these circumstances. He knew of some fifty copies but seems to have worked only with a selection of the manuscripts now in the Bibliothèque Nationale. His comments on non-Parisian manuscripts are not always reliable and suggest only indirect knowledge.4 In fact, a significant number even of Paris manuscripts seems to have escaped Leclercq, while two Paris manuscripts he refers to do not contain Ivo’s correspondence.5 The comments on manuscripts he presumably had seen suggest that 1 J.
