Roots of the Headscarf Debate: Laicism and Secularism in France and Turkey By Gulce Tarhan Introduction Laicism and secularism refer to two different possibilities of how to organize state policies toward religion. These concepts are, in a limited sense, similar to each other as they both include two elements: separation between state and religion (separation of political authority from religious authority) and freedom of religion. It is the visible appearance of religion that demarcates the difference between them. Secularism is usually described as more tolerant towards public visibility of religion; a secular state plays a passive role and allows religious symbols in the public domain. In laicism the state plays a more active role by excluding religious symbols from the public domain and thus confines religion to the private domain. Laicism or laicité in French is usually defined as a unique feature of French political culture. It emerged after the 1789 Revolution as a way of separating state and religion. Today, it is accepted as the foundation of the French Republic, which ensures national unity by securing tolerance towards different religious groups and by unifying citizens as rational, enlightened members of a collective unity. Yet today the principle of laicité seems to have produced the opposite result: the polarization of the French society into two. The recent debate over the ban on headscarves exemplifies this situation. The French public seems to be divided into two camps – supporters and opponents of such a ban. Turkey, which is the first and the most secular country in the Muslim world, is another country where a similar debate caused a similar polarization. -

Dal punto di vista economico, invece, i paesi asiatici hanno continuato a confrontarsi con le conseguenze della crisi mondiale. The purpose of the article is to identify how Hindutva functions as an informal institution. In this context, Hindutva has been evaluated based on three basic features of an institution: setting rules, shaping behavior and effecting the result. The rule- making feature has been studied through the ideas of ideologists such as Savarkar and Golwalkar with reference to the Hindu social order. Subsequently, it has been argued that these socio-political rules have been accepted by the huge social segments in the country and influenced the behaviors of the social base. Finally, it has been emphasized how Hindutva has influenced the result and brought the Hindu nationalists to power. Accordingly, it will be concluded how Hindutva has become the mainstream of politics in the country. However, with reference to the recent Citizenship Law protests in the country, it has been noted how other informal institutions, particularly secularism, threaten the future of Hindutva. Science and Rising Nationalism in India
COMMENT BOOKS & ARTS of conservatism has long mingled with Christian fundamentalism and the rejection of evolution. But as the examples in Holy Science show, the burgeoning complexity of this fusion in India is notable. Ancient India abounded in scientific advances, in fields from astronomy and mathematics to metallurgy and surgery. These achievements, along with traditional Indian knowledge systems, were egregiously sidelined during colonial rule. Yet some nationalist rhetoric overstates or distorts history. Subramaniam shows how modern science has been bolted to Hindu mythol- ogy: Modi has posited, for example, that the elephant-headed deity Ganesha was a prod- uct of ancient cosmetic surgery. Other claims have been made for the current relevance of ancient practices. For instance, Modi has made speeches declaring that yoga can help tackle climate change by nurturing a social conscience. At the heart of Holy Science are several case studies examining the interplay of biology, public policy and ancient traditions in today’s India, which Subramaniam frames as “bio- nationalism”. Hindu Fundamentalism and Christian Response in India
HINDU FUNDAMENTALISM AND CHRISTIAN RESPONSE IN INDIA Rev. Shadakshari T.K. (Bangalore, India and Pastoring Divyajyothi Church of the Nazarene) Introduction One of the purposes of religion, humanly speaking, is to enable people to live a responsible life. One desire is that religious people may not disturb the harmonious life; rather, they may contribute towards it. Today, religions have become a source of conflict and violence in many Asian societies. This is very evident in India where the inter-relationship among religions is breaking up. The contemporary problem in India is the question of nationalism and the issue of marginalized identities. Christians are caught between two: participation in the nationalism in the one hand and commitment to the cause of the marginalized on the other. There is an awakening of nationalism, which bears strong religious stamp, which is strongly promoted by the Hindutva ideology. At the same time there is a strong awakening of the Tribals and Dalits. In this context, the question comes to our mind: how do Christians in India serve both nationalism and marginal groups when both of them are opposing each other? I am not promising the absolute answer for the question raised. However, this article provides some clues by analyzing the historical development of religious fundamentalism and suggesting an appropriate response for Christians. Though there are several religious fundamental groups in the history of India (including Hinduism, Islam, Sikhism, and others), this article limits its study to the religious fundamentalism of Hinduism. The importance of Hindu fundamentalism lies in its very contemporary and nationalistic scope, compared to other, more regional expressions. -

NARIMAN, J. Leave granted. 1. The present appeal arises out of the demolition of Babri Masjid. We are concerned in this case with two FIRs lodged on 6th December, 1992. The first viz. Crime No.197 of 1992, is against lakhs of kar sewaks alleging the offences of dacoity, robbery, causing of hurt, injuring/defiling places of public worship, promoting enmity between two groups on grounds of religion, etc. The IPC offences were, therefore, under Sections 153-A, 295, 297, 332, 337, 338, 395 and 397. The second FIR 1 viz. FIR No.198 of 1992 was lodged against eight persons named therein - Mr. L.K. Advani, Mr. Ashok Singhal, Mr. Vinay Katiar, Ms. Uma Bharati, Ms. Sadhvi Ritambara, Mr. Murli Manohar Joshi, Mr. Giriraj Kishore and Mr. Vishnu Hari Dalmia, two of whom are dead due to passage of time viz. Mr. Ashok Singhal and Mr. Giriraj Kishore. The FIR alleges offences under Sections 153-A, 153-B and Section 505 IPC. 46 further FIRs pertaining to cognizable offences and 1 FIR pertaining to non- cognizable offences were also lodged. Initially, a Special Court set up at Lalitpur was to try these cases but subsequently notifications were issued by the State Government, after consultation with the High Court, dated 8 th September, 1993 whereby these cases were to be tried by a Special Court at Lucknow. -

Bennoune: Terror/Torture Terror/Torture By Karima Bennoune* ABSTRACT In the face of terrorism, human rights law's requirement that states "respect and ensure" rights necessitates that states take active steps to safeguard their populations from violent attack, but in so doing do not violate rights. Security experts usually emphasize the aspect of ensuring rights while human rights ad- vocates largely focus on respecting rights. The trick, which neither side in the debate has adequately referenced, is that states have to do both at the same time. In contrast to these largely one-sided approaches, adopting a radical universalist stance, this Article argues that both contemporary human rights and security dis- courses on terrorism must be broadened and renewed. This renewal must be in- formed by the understanding that international human rights law protects the in- dividual both from terrorism and the excesses of counter-terrorism, like torture. To develop this thesis, the Article explores the philosophical overlap between both terrorism and torture and their normative prohibitions.
