While it is customary to tender one’s resignation at the time a change of administration takes place, officers remain formally at the head of their department until a successor is appointed. Subordinates acting temporarily as heads of departments are not con- sidered Cabinet officers, and in the earlier period of the Nation’s history not all Cabinet officers were heads of executive departments. The names of all those exercising the duties and bearing the respon- sibilities of the executive departments, together with the period of service, are incorporated in the lists that follow. The dates immediately following the names of executive officers are those upon which commis- sions were issued, unless otherwise specifically noted. Where periods of time are indicated by dates as, for instance, March 4, 1793, to March 3, 1797, both such dates are included as portions of the time period. On occasions when there was a vacancy in the Vice Presidency, the President pro tem- pore is listed as the presiding officer of the Senate. Garrison* ABSTRACT Although much research has been done on the opinions issued by the Office of Legal Counsel (OLC) regarding the power of President Bush to order enhanced interrogations of captured enemy combatants, and the power of the President, as commander in chief, to act to address the events of September 11, 2001, and prevent future attacks, there has been much less research on explaining the source of the power and significance of OLC opinions within the Executive Branch. This article will focus on the historical basis and legal significance of opinions by the Attorney General, and later those of the OLC. This article will explain why and how opinions on the meaning and applicability of the law issued by the Attorney General, dating from those of General Randolph to General Holder and those of the OLC, have historically been quasi-judicial in approach and determinative within the Executive Branch. I. INTRODUCTION After the attacks of September 11, 2001, the Bush Administration‘s Department of Justice OLC issued a series of memos that stated that the President had the exclusive constitutional power (1) to detain enemy combatants, (2) to bypass the Uniform Code of Military Justice (UCMJ) and initiate military commissions to try such combatants, and (3) to determine what types of techniques could be initiated to secure information from captured enemy combatants from the military operations in * Arthur H. LEDERMAN* Congress has recently authorized military commissions to try enemies not only for violations of the international law of war, but also for domestic-law offenses, such as providing material support to terrorism and conspiring to commit law-of-war offenses. Moreover, President Trump has indicated support for further military trials, including trials against U.S. citizens. Such military tribunals lack the civilian jury and independent judge that Article III of the Constitution prescribes. The constitutionality of such an abrogation of Article III’s criminal trial guarantees has been debated during many of the nation’s wars without clear resolution, and the constitutional question is now at the heart of a potentially landmark case, al Bahlul v. United States, currently before the Supreme Court. In the rare cases where the Supreme Court has recognized exceptions to Article III’s criminal trial protections, it has typically invoked functional and normative justifications.

I scrutinize congressional and legal records, newspapers, and correspondence to show how the Nineteenth Amendment, which removed sex as a legal barrier to voting, ultimately strengthened white political control in the state. My dissertation analyzes how Anglo, black, Mexican American and Mexican immigrant women, working separately or collectively, participated in and at times benefitted from the woman suffrage movement, which caused unforeseen relaxations of minority voting restrictions before the legislature acted to further restrict voting rights. I analyze how laws regulating elections affected women differently based on race and citizenship status. I maintain that politicians pass enfranchising legislation when it in some way benefits those already in power, and likewise they deploy fears of unethical or illegal voting when it benefits them as well. I argue that from WWI through the early 1920s, full citizenship was increasingly defined by the ability or right to vote.

    A 1910s postcard of Isaac Gilberg, the “leader of Topeka radicalism.” Kansas History: A Journal of the Central Plains 41 (Summer 2018): 106-123 106 Kansas History Liberty in the Line of Fire: The Topeka Antidraft Conspiracy during World War I by Thomas Rosenblum n January 15, 1918, in a federal courtroom in Kansas City, Kansas, Ike Gilberg arrived with three other defendants charged with violating the 1917 Selective Service Act, which made it a misdemeanor to obstruct the recruiting service of the United States. They also stood charged with violating sections 37 and 332 of the U.S. Penal Code, which declared it a felony to enter into a conspiracy to commit any offense against the United States or to induce another to violate a federal law. Each faced a prison sentence of up to two years and/or a fine Oof $10,000. Gilberg, a tailor by trade, sewed as he sat in the dock.1 The charges stemmed from an alleged anticonscription meeting held the afternoon of May 27, 1917, at the Topeka Unitarian Church on Kansas Avenue. On May 31, acting on warrants issued by Fred Robertson, U.S. attorney for the District of Kansas, federal authorities arrested six Kansans for conspiring to obstruct the Selective Draft Act, which was scheduled to go into effect June 5. Taken with Gilberg were physician Eva Harding, garage owner Fred Felten, and carpenter Ernest Newman of Topeka.
