THE DECISION

NOTICE IS HEREBY GIVEN THAT PERMISSION FOR THE PROPOSED DEVELOPMENT in the manner described on the application and shown on the accompanying plans and drawings is

GRANTED subject to the following conditions:

1. The development hereby permitted shall be begun within 5 years from the date of this permission.

2. The tree planting shown on 362/3 shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, '-' whichever is the sooner; and any trees or plants which within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Board gives written consent to any variation.

3. All new timber play equipment shall be dark-stained and permanently so maintained.

4. The detail of any additional play equipment shall be submitted to and approved in writing by the National Park Officer before being brought onto the site.

5. The cladding to the walls of the garage shall be extended down to ground level.

.If you are aggrieved by the decision of your local planning authority to refuse permission for the proposed development or to grant it subject to conditions, then you can appeal to the Secretary of State for the Environment under section 78 of the Town and Country Planning Act 1990.

.If you want to appeal, then you must do so within six months of the date of this notice, using a form which you can get trom the Department of the Environment at Tollgate House, Houlton Street, Bristol 8529OJ.

.The Secretary of State can allow a longer period for giving notice of an appeal, but he will not normally be prepared to use this power unless there are special circumstances which excuse the delay in giving notice of appeal.

.The Secretary at State need not consider an appeal if it seems to him that the local planning authority could not have granted planning permission for the proposed development or could not have granted it without the conditions it imposed, having regard to the statutory requirements, to the provisions of the development order and to any directions given under the order.

- In practice, the Secretary of State does not refuse to consider appeals solely because the local planning authority based its decision on a direction given by him.

I refer to the above application which was received on 19 January 1993.

The Authority has no objections in principle to the application subject to the inclusion of conditions which meet the following requirements:-

The foul drainage from the proposed development shall be discharged to a septic tank and soakaway system designed to meet BS 6297:1983 and which complies with the following:- a) There is no connection with any watercourse or land drainage system and no part of the soakaway is within 10 metres of any ditch or watercourse. b) Porosity tests are performed in conjunction with the Local Authority showing that suitable subsoil and adequate land is available for the soakaway as suggested in BS 6297:1983 Section 15.3 refers.

Care should be taken to protect the quality of any well/borehole.

\.r There shall be no discharge of trade effluent, sewage effluent or contaminated drainage from the site into any ditch or watercourse.

Surface water shall be disposed to a soakaway system designed and constructed in accordance with BS 8301: 1985 (Section 8.4).

Reasons To minimise the risk of pollution of surface water and groundwater.

To ensure the satisfactory provision of drainage facilities to serve the proposed development.

A copy of the subsequent decision notice would be appreciated.
