SUBJECT: ( S ) Recommendationto Retain under Control for Guantanamo Detainee, Gha'im Yadel, ISN: US9FR-000371DP

1. (FOUO) PersonalInformation: Gha'imYadel is a Frenchnationalbornon 17March 1971 (age 33) in Aubervilliers, . He is in goodhealth .

2. (S) Detention Information: In March2000, detainee traveled to the United Kingdom , to help facilitate his further travels to Afghanistan (AF) and to participate in Jihad against the NorthernAllianceon behalfofthe Taliban. Detaineearrivedin Afghanistan in August 2000 and received weapons trainingat the Al-Qaida sponsored Al- Farouq training camp for six weeks. After leaving Al- Farouq, detainee traveledto an Algerian safehouse in Jalalabad, AF, where he was given specialized instruction inexplosives and electronic circuitry. Detainee remained in Afghanistan where he continued to receive traininginto 2001. After the attacks of 11 September2001, detainee traveled throughout Afghanistanparticipatinginthe fighting, and facilitatingthe travels ofother GSPC and Al-Qaida members. As the Talibanbeganto break apart on the battlefield, detainee fled to the Tora Bora Mountains along with other members ofAl-Qaida, until he was captured by the Northern Alliance and turned over to U.S. Forces . Detainee was subsequentlytransported to Guantanamo Bay Naval Base, Cuba, on 25 January 2002 because ofhis affiliation with Al-Qaida.

3. (S) Reasons for Continued Detentionat GTMO: Detainee has never been cooperative or forthright duringhis time indetention. Detaineehas consistently lied inorder to misdirect any investigative leads and has refused to reveal any concrete information about his associations. Detainee is a probable member ofAl- Qaida with direct affiliations and memberships to several other Islamic extremist groups, includingthe Salafist Group for the Call and Combat (GSPC), the Armed Islamic Group (GIA), and the TunisianCombat Group. All three organizations, known and recognized as terrorist organizations, have alliances with Al-Qaida. Detainee has been identified through sensitive reporting, as having direct terrorist associations with Al-Qaida members who were involved inplanned attacks in several

Western countries. Detainee has been linkedby the Frenchthrough his affiliations as a conspirator to a planned terrorist attack by the GSPC in Strasbourg, Germany , in late 2000 as well as affiliations with the group that carried out the murder of the Afghan Northern Alliance commander Shah Masood. Detainee traveled to Afghanistan to participate in Jihad and while there, he received additional specialized training in explosives includingTNT, C-4 , RDX, and building remote detonators. Al-Qaida operatives, some ofthem senior Al-Qaida leaders, facilitated the detainee's travels and training while in Afghanistan, and he resided in several safehouses either run or sponsored by these individuals. Furthermore, detainee was given a Computer Voice Stress Analysis, which showed deception on a number ofquestions. Detainee, through his actions, remains dedicated to Jihad against the US and its allies.

4. ( S) Assessment Basedon information collected and available to Joint Task Force Guantanamo as of 27 January 2004, detainee : US9FR-000371DP is assessed as being a probable member ofAl-Qaida and a confirmed member ofthe Salafist Group for Call and Combat (GSPC). Moreover, based on the detainee's folder, the knowledgeabilitybrief, and subsequent interrogationsby Guantanamo, the detainee is ofhighintelligencevalue to the United States. Based on the above, detainee poses a high risk, as he is likely to pose a threat to the U.S., its interests or its allies.

5. ( S) EC Status: Detainee's combatant status was reassessed on 15 February 2003 , and he remains an enemy combatant.

6. (S ) Recommendation : Retain under DoD control.

7. ( S) Coordination : JTF Guantanamo notified the Criminal Investigative Task Force of this recommendation on 6 January 2004. Inthe interest of national security and pursuant to an agreement between the CITF and JTF GTMO Commanders, CITF will defer to JTF GTMO's assessment that the detainee poses a high risk.
