Jakmile jsem vešel do jejich pokoje v ho- telu Continental Hyatt House – nechvalně to proslulém příbyt- ku mnoha rockových hvězd sedmdesátých let, který byl bohužel před mnoha lety zbourán – byl jsem přijat s pravou jižanskou po- hostinností, takže jsem se hned cítil v pohodě a klidu. Billy patřil mezi nejmilejší, nejzábavnější a nejbystřejší lidi, na něž jsem kdy narazil, a také díky tomu jsem si ho od první chvíle zamiloval. Během následujících let jsme se ještě mnohokrát sešli a v této před- mluvě uvedu rozhovor, který se odehrál zhruba šest let po našem prvním setkání. Podle mě právě toto vyprávění nejlépe ilustru- je, jaká kapela byla a je a jací jsou její členové po lidské stránce. Asi vám nemusím říkat, jak důležitou roli ZZ Top sehráli v šíření blues mezi širší vrstvy posluchačů. Billy Gibbons patřil a stále pa- tří mezi nejunikátnější a nejtvořivější kytaristy, kteří kdy drželi šestistrunku v ruce. O tom již napsali mnozí jiní. COVER STORY Acting as Assistant to Richard Perna is Kimberly Jones. Her position encompasses everything from taking Richard's telephone calls to conducting meetings for Richard when he is unable to attend. Drawing upon her background in journalism and public relations, she also coordinates all public relations and publicity events for the Hamstein Group of companies. Hamstein Publishing Company, Inc. is the administrative branch of the Hamstein Group of companies. It consists of Business Affairs and Creative Affairs. Business Affairs is responsible for copyrighting songs, issuing licenses for copyrighted material, collecting/disbursing royalties, and negotiating and administering all contracts. Dean Migchelbrink is Director of Business Affairs. Creative Affairs handles the aquisition of writers and marketing of the songs. Richard Perna oversees both areas, working closely with Dean. Dean Migchelbrink joined the Hamstein Publishing companies in 1989 when he became Manager of Administration. He came into the company with a strong background in music publishing. In addition to studying at Belmont College in Nashville, Dean interned at PolyGram Records while he was taking classes. He worked for Copyright Management, Inc. for three years, where he was instrumental in helping them to develop separate Copyright, Licensing and Royalty departments. Currently, he manages all aspects of Copyright Administration, Licensing and Royalties. In addition, he is collaborating on writing a software program that is specific to music publishing administration, marketing and royalties, which is scheduled for commercial release in late 1994. Dean was also responsible for signing the members of Little Texas to Howlin' Hits Music. Oct. 19, 1993. Appeal from the United States District Court for the Southern District of Texas. Before POLITZ, Chief Judge, HIGGINBOTHAM and DeMOSS, Circuit Judges. POLITZ, Chief Judge: Bill Ham appeals the dismissal for lack of personal jurisdiction of his copyright declaratory judgment action against Bernard Besman and Besman's company, La Cienega Music. We affirm. Background In 1948 and 1950 Besman and John Lee Hooker wrote a song entitled "Boogie Chillen" and a derivative work entitled "Boogie Chillen No. 2." In 1970, Hooker recorded and released a second derivative with the musical group Canned Heat. Besman registered the three works with the United States Copyright Office and, through La Cienega, holds the copyrights. In 1973 Billy Gibbons, Joe Hill, and Frank Beard—popularly known as the rock band ZZ Top—authored a song entitled "La Grange" and registered it as an unpublished work. That song appeared on ZZ Top's 1973 hit album "Tres Hombres." Ham, doing business as Hamstein Music Company, acquired the rights to "La Grange" in 1973. On July 8, 1991, Besman wrote Ham claiming that "La Grange" infringed the copyrights on "Boogie Chillen" and its derivatives. Ham denied any infringement and, alternatively, asserted various defenses. After an exchange of conflicting expert musicology reports, on April 27, 1992 Ham filed the instant declaratory judgment action.1 Besman moved to dismiss for lack of personal jurisdiction.

She's Just Killing Me (4:57) ZZ Top began as a rough-and-ready blues-rock power trio from Texas that became a huge mid-1970s concert attraction. Their real commercial peak didn't come, however, until the 1980s, when the "Little Ol' Band from Texas" became MTV superstars and sold multiple millions of albums. ZZ Top was built around guitarist Billy Gibbons, whose career began with the popular Southwestern band Moving Sidewalks, whose "99th Floor" was a regional mid-'60s hit. They opened one night for Jimi Hendrix, and he later mentioned Gibbons on The Tonight Show as one of America's best young guitarists. After Moving Sidewalks broke up, Gibbons and manager/producer Bill Ham recruited Frank Beard and Dusty Hill from a Dallas band, American Blues. Beginning with the release of First Album in 1970, ZZ Top has toured constantly, building a national following that has made all the band's albums gold or platinum. A year-long tour in 1976, "The Worldwide Texas Tour," was one of the largest-grossing road trips in rock at the time.
