Client Agreement Please read and initial each line below:

______I acknowledge and understand that there are certain risks involved in participating in group socialization of dogs, including, but not limited to broken nails, abrasions and cuts, raw paw, dog fights, dog bites to humans or other dogs as well as the transmission of communicable illnesses, such as canine cough, warts and/or parasites.

______I further understand that any problems with my dog, behavioral, medical or otherwise, will be treated at the staff’s discretion.

______I assume full financial responsibility and all liability for any and all expenses in regards to the behavior and health of my dog.

______If my dog becomes ill or injured, Central Park shall have the right to call a veterinarian of their choice; or to administer medicine or give other advisable attention, within their judgment, and such expenses, being reasonable in amount, shall be paid promptly by me, the owner of the dog.

______I understand that I am solely financially responsible for any damage to the property of Central Park Dog Daycare caused by my dog(s) while under their care.

______I agree that in admitting my dog(s) to Central Park, they have relied on my representation that my dog(s) is/are in good health and have not harmed or shown aggressive or threatening behavior towards any person or other dog.

______If my dog cannot safely adapt to the group daycare environment, Central Park shall have the right to place my dog in a traditional kennel of their choice.

______I understand that reservations must be canceled no later than 72 hours prior to the day of the reservation. I will be subject to applicable charges if I fail to do so.

______I understand that holiday boarding reservations require a two night non-refundable deposit per dog, and that reservations must be canceled 72 hours prior to the day of the reservation to avoid forfeiture of the deposit.

______I understand that I will be charged a late fee for picking my dog up after hours. Late charge for after- hours pick-up is $20 per dog and must be scheduled ahead of time and pre-paid.

Training Agreement

Training. Both the dog and the owner will receive the training indicated in this Agreement. The dog will be trained to perform as shown by demonstration at the conclusion of the boarding/day/private lesson training. Included in the boarding/day training program shall be follow up training sessions with the owner following the dog’s boarding/day training. The owner understands and agrees that they have responsibility to cooperate fully in completing the owner training sessions, and that the trainer cannot and does not assume or accept responsibility for the behavior or performance of the dog after it has been returned to the owner. The dog is welcome to drop in for two refresher visits during regular daycare visits in order for the trainer to reinforce any specific area of training. *Occasionally, some training activities will take place in the facility parking lot or offsite in order to expose the dog to more distractions. If you do not consent to offsite training, you must notify Central Park Dog Daycare in writing prior to the program start date.

Expectations. Owner understands and agrees that genetics and environmental history (e.g. past experiences, lack of training, nutrition, health, etc.) will affect the dog’s behavior. Owner understands and agrees that training may not be able to cure aggression, and assumes all risks associated with owning and harboring a dog that may be aggressive. Owner agrees to maintain the dog’s training after the board and training is complete. I understand that because the training of a dog is a dynamic process not fully in the control of any party, there are no guarantees of any specific result, and there will be no refunds for this training.

Medical Problems. If the dog shows evidence of a medical problem while under the care and control of trainer, the facility shall have the right to take such measures as it deems necessary for the health and safety of the dog, without being liable for the cost of the same or to the owner in relation to results thereof, including the right to administer medication or obtain an evaluation and treatment by a vet of facilities choice. Reasonable attempts will be made to contact owner, and/or the Vet designated by the owner, above, for further instructions. In the event that the owner or designated Vet cannot be contacted, a Vet selected by the facility may provide such emergency medical treatment as is deemed necessary to preserve the life and health of the dog. Owner shall pay cost of all treatment provided for in this paragraph, in addition to the contract price, prior to the dog being picked up by the owner and the delivery of the dog, by trainer, to the owner.

Liability. Trainer agrees that, while the dog is on its premises and under its control for daycare boarding or training, trainer will exercise due and appropriate diligence and care to protect the health and safety of the dog. However owner agrees that trainer has no liability for loss or damage to the dog or owners other property resulting from fire, disease, illness, virus, escape, theft, death or other unavoidable causes, in spite of due care. After the dog has been returned to the owner by trainer, and is off trainer’s premises, trainer cannot and does not accept any responsibility for the illness, injury or death of the dog or of any person or animal, or damage to any property, caused by the dog or resulting from its activity.

Termination. In the event that training is disrupted, with no reason communicated to Central Park Dog Daycare from the client for more than a ten (10) day period, Central Park Dog Daycare reserves the right to terminate the contract. If training, for any reason, needs to be put on hold, it is the client’s responsibility to make arrangements with Central Park Dog Daycare.

Abandonment. If, at the completion of the agreed training time, the dog is not picked up by the owner and payment of all charges made in full, including applicable medical, Vet or boarding charges as provided herein, the facility shall notify owner by certified mail at the address shown above that the dog will be held for an additional ten days following the date of the mailing notice. At the end of the ten day period, if there is no response from owner, the dog may be sold at public or private sale. The proceeds of such sale shall be first applied to the charges of trainer and the balance, if any, shall be returned to the owner at the address shown above. Owner shall be charged Central Park Dog Daycare’s daily boarding rate of forty-five ($45.00) per day for any additional boarding days following notice to the owner.

Representations. Owner represents that owner is the legal owner of the dog; that the dog is free and clear of any mortgage or other encumbrances; that the dog has not been exposed to Distemper, Rabies, Parvo or any upper respiratory virus within the last thirty days; that the dog has been inoculated as shown above and that owner has read this agreement in its entirety.

Payments. Payments may be made in the form of check, cash, or credit card. The non-refundable deposit for all training programs is 50% of the program price. The balance will be due on the date of drop off for training or on the first day of a private lesson program. Payments hold a place in the schedule and facility of Central Park Dog Daycare to provide these services in lieu of taking other dogs; therefore any payments (including deposits) are non-refundable. In the event of a cancellation within 48 hours of drop-off time, all fees become immediately due in full due to Central Park Dog Daycare being unable to fill that dog’s reserved place in their schedule and facility. Overdue amounts, including bounced payments or chargebacks, will be assessed a late payment charge at a monthly rate of 1.5% or the maximum provided by law, whichever is less. Facility shall have the right to recover expenses including collection costs and reasonable attorney's fees incurred in collecting overdue amounts.

Legal Terms. If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, or enforceability of the remainder of this Agreement shall not in any way be affected or impaired. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any right hereunder. This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous written or oral agreements between them or any of their affiliates, with respect to the subject matter contained herein. This Agreement may not be modified or altered except by written instrument executed by a corporate officer of Central Park Dog Daycare.

__ (Initial) Media Release. I consent to be photographed, videotaped, or recorded in or around my participation at a Central Park Dog Daycare service or event. I acknowledge and agree Central Park Dog Daycare may use such photography, videography, or audio recordings (“Media”), including my name, likeness, or image, and/or the name, likeness, or image of my dog, for internal education and training purposes, in or around the promotion, marketing, or sale of any product or service of Central Park Dog Daycare, or in or around any other media regarding Central Park Dog Daycare, now existing or hereinafter devised, without any additional compensation or payment to me. If I do not want to consent to this recording or use, I must notify Central Park Dog Daycare in writing before my participation in their service or event.

I hereby release and discharge Central Park Dog Daycare and any of its employees, contractors, staff, officers, directors, representatives, agents, associates, successors, and assigns, including photographers and videographers, from any and all legal liability, damage, loss, claim, or demand that may arise out of or in connection with the use of such Media, including without limitation any and all claims for defamation, infringement, moral rights, or violation of any right of publicity or right to privacy, arising from the use of the above photography, video, or recording.

__ (Initial) Release and Indemnification. As a condition of my dog’s boarding with Central Park Dog Daycare, I agree to waive all claims against Central Park Dog Daycare, its officers, agents, and employees, and to indemnify and hold Central Park Dog Daycare, its officers, agents, and employees, harmless for any and all liability or claims I may have or that any other person or entity may have because of any death, bodily injury, personal injury, or because of any loss of property that may arise out of or in any way be connected with my dog’s boarding and/or training and/or rehabilitation.

__ (Initial) Arbitration. I agree to submit any disputes that may arise between myself and Central Park Dog Daycare, and/or the agents of Central Park Dog Daycare to binding arbitration in Oklahoma County, Oklahoma, according to the rules of the American Arbitration Association. It is further agreed that a judgment upon any award rendered by an arbitrator may be entered in any court having competent jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. In any arbitration arising out of or related to this Agreement, the arbitrator(s) shall award to the prevailing party, if any, the costs and attorneys’ fees reasonably incurred by the prevailing party in connection with the arbitration.

I have read and agree to all the conditions above. Return of this contract and/or drop off of owner’s dog, shall constitute full acceptance of the terms and conditions above.
