In event of NDDC being minded to grant permission requests that this should be only subject to prior completion of Sec.106/278 agreement and imposition of conditions to secure matters listed in Development Control Committee report (EEC/07/73/HQ) and be referred to GOSW as a departure from the Development Plan. 09/01665/MAJ Outline Application for the Proposed Residential Committee resolved 02/12/09 (Minute *29(a) that Teignbridge District Development of approximately 590 Dwellings at Council be advised that Devon County Council: Land to East of Old Exeter Road, Newcross, Kingsteignton. (i) As Mineral Planning Authority does not object to the proposal, subject to the application entering into an appropriate legal agreement to ensure that: (1) No dwellings are built in Phase 2 of the proposed site within 80 metres of the final eastern working face of Broadway Quarry unless it can be demonstrated by further detailed analysis that dust will not cause a problem to residents, or that the dust can be satisfactorily controlled. (i) As Mineral Planning Authority does not object to the proposal subject to the imposition of a condition to prohibit development within 80 metres of the final eastern working face of Zitherixon Quarry, and to secure alternative noise and dust mitigation measures, such as bunding, screen planting, or acoustic barriers, so as to avoid the potential sterilisation of nationally important reserves of ball clay contrary to the provisions of Policy MP13 of the Devon County Minerals Local Plan; Application Description of Proposal [District] Devon County Council's Response [date/minute no. of Decision issued/Comment Ref.
