The mission was undertaken from 22 to 24 July 2012 and held extensive and open discussions with Government Representatives and a wide range of political stakeholders, leaders of Political Parties and the two previous Prime Ministers, as well as civil society and non-state actor representatives. Brief historical background to the current Fiji political crisis The current political crisis in Fiji can be traced back to the ethnic make-up of the population, which is divided between indigenous Fijians and Indo-Fijians (the descendants of indentured labourers brought from India a century ago). At independence, Indo-Fijians were roughly 51% of the population until the mid-2000s, by which time political issues had prompted thousands of Indo-Fijians to leave the country. They currently make up 39% of the population. For 17 years after independence from British rule in 1970, the country was relatively stable until Colonel Sitiveni Rabuka‟s 1987 coup against an Indo-Fijian dominated government. -

Hybrid Constitutional Courts: Foreign Judges on National Constitutional Courts ROSALIND DIXON* & VICKI JACKSON** Foreign judges play an important role in deciding constitutional cases in the appellate courts of a range of countries. Comparative constitutional scholars, however, have to date paid limited attention to the phenomenon of “hybrid” constitutional courts staffed by a mix of local and foreign judges. This Article ad- dresses this gap in comparative constitutional schol- arship by providing a general framework for under- standing the potential advantages and disadvantages of hybrid models of constitutional justice, as well as the factors likely to inform the trade-off between these competing factors. Building on prior work by the au- thors on “outsider” models of constitutional interpre- tation, it suggests that the hybrid constitutional mod- el’s attractiveness may depend on answers to the following questions: Why are foreign judges appoint- ed to constitutional courts—for what historical and functional reasons? What degree of local democratic support exists for their appointment? Who are the foreign judges, where are they from, what are their backgrounds, and what personal characteristics of wisdom and prudence do they possess? By what means are they appointed and paid, and how are their terms in office structured? How do the foreign judges approach their adjudicatory role? India–Fiji Relations Fiji, in the heart of Pacific Ocean, is an archipelago of 332 islands of which around one-third are inhabited permanently. The total land area is 18,333 square kms. English, Fijian and Hindi are widely spoken. Main ethnic groups include Fijian, Indian, European, other Pacific Islanders and Chinese. India’s links with Fiji commenced in 1879 when Indian laborers were brought here under indenture system to work on sugarcane plantations. Between 1879 and 1916 around 60,000 Indians were brought to Fiji. Beginning with early 20th century, Indian traders and others also started arriving in Fiji. Agitation by the workers and the reports of C.F. Andrews, who visited Fiji in 1915 and 1917, led to the abolition of the indenture system in 1920. Currently, of the 849,000 population (2009 estimates), 37% are people of Indian origin. Prior to Fiji’s independence in 1970, India had a Commissioner since 1948 to look after the interests of people of Indian origin. The Commissioner’s post was upgraded to that of High Commissioner after independence. Fiji’s Prime Minister Ratu Sir Kamisese Mara visited India in 1971 and Prime Minister Smt. Indira Gandhi visited Fiji in 1981. Fiji had several coups starting from 1987. After the 1987 coup-s, the High Commission of India and Indian Cultural Centre were closed on May 24, 1990. The High Commission of India was subsequently reopened in March 1999 and the Indian Cultural Centre in February 2005. Fiji established its first High Commission in New Delhi in January 2004. India-Fiji bilateral relations have grown steadily during the past few years due to several ongoing initiatives and bilateral visits to and from Fiji. -

Current state of the judiciary/police force following the coup. There are reports that the Military has detained and abused people: Non-government organisations have voiced their disappointment at recent allegations of people being detained and abused by the military. In a statement yesterday, NGO Coalition on Human Rights chairperson Virisila Buadromo said despite the reassurances by the interim Government to the international community, human rights abuses continued. The coalition called for an immediate end to human rights violations. "The coalition is disappointed that the interim Government continues to insist that human rights are still intact, despite the recent well-publicised cases of gross human rights violations, said Ms Buadromo. "The interim Government says citizens' rights are "intact", but the front page of the daily newspapers lists gross violations, such as cruel and degrading treatment under military detention." She said if the interim regime believed certain people were a threat to national security, those people should be interrogated by the police. -
